ORDINANCE NO. 1459
AN ORDINANCE OF THE CITY OF LYNWOOD REPEALING
IN ITS ENTIRETY SECTION 13-8 OF CHAPTER 13 OF
THE LYNWOOD MUNICIPAL CODE, AND DECLARING THE
URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF LYNWOOD ORDAINS AS
FOLLOWS:
Section 1. Section 13-8 of Chapter 13 of the
Lynwood Municipal Code is hereby repealed in its entirety. The
title of that section is "Benches Along Public Ways."
Section 2. The City Council finds and determines
that the public health, welfare and safety can best be served if
the City assumes sole responsibility for providing all benches
that are to be located on public property and in public rights-
of-way. The City Council further finds and determines that the
permitting procedures set forth in Section 13-8 of Chapter 13 of
the Lynwood Municipal Code are inconsistent with the assumption
by the City of responsibility for providing benches for use by
the public, and that immediate repeal of those permitting
procedures is necessary and desirable in order to implement this
policy and to avoid the further proliferation of benches.
Consequently, it is essential that this ordinance become
effective immediately. For these reasons, this ordinance is an
urgency ordinance that is necessary for the immediate
preservation of the public peace, health and safety within the
meaning of Section 30937(c) of the Government Code, and it will
take effect immediately.

published or posted as required by law.
