ORDINANCE NO. 1460
AN INTERIM ORDINANCE OF THE CITY OF
LYNWOOD DECLARING A MORATORIUM ON
THE ESTABLISHMENT OR EXPANSION OF
CERTAIN AUTOMOTIVE USES WITHIN ALL
LAND USE ZONES OF THE CITY, AND
DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF TFIr: CITY OF LYNWOOD DOES ORDAIN AS
FOLLOWS:
Section 1. Notwithstanding any other ordinance or provision of the Lynwood Municipal
Code, no person may establish or expand, and the City of Lynwood may not accept or approve
applications for business licenses, building permits, variances, conditional use permits, or other
entitlements to establish or to expand, the following uses in any land use zone of the City:
(a) Any automotive use, as defined in Subsection 25-16.15 of Chapter 25 of the Lynwood
Municipal Code, which use includes the sale, repair, servicing, reconditioning, painting,
upholstering, body work, or washing of vehicles, whether new or used.
(b) The operation of anv business as an automotive repair dealer, as defined in Subsection
25-16.15 of Chapter 25 of the Lynwood municipal Code, which business involves the
repair or diagnosis, for compensation, of malfunctions of motor vehicles.
Section 2. The moratorium established in Section 1 above does not apply to the
following:
(a) Construction of buildings or structures for which all permits have been obtained as of

(b) The processing and approval by the Lynwood Redevelopment Agency of any project
involving a new or expanded automotive use where the governing board of the Agency
has made a determination that the project will substantially advance the goals and
objectives of the redevelopment process and will contribute towards the elimination of
blight in a redevelopment project area.
Section 3. This interim ordinance is adopted in accordance with Section 65858 of the
Government Code and will expire and terminate forty-five (45) days after the date of its adoption
unless extended by the City Council following a noticed public hearing. That public hearing is
hereby called and will be held before the City Council on Tuesday, August 12, 1997, at 7:30 p.m.
at the regularly scheduled meeting of the City Council.
Section 4. The City Council finds and determines that the City's Zoning Ordinance, in
authorizing the uses described above in Section 1 of this interim ordinance, has resulted in a
proliferation and, in some areas on the City, an undue concentration of automotive uses. This
proliferation and undue concentration or automotive uses aas, i:: some insia~~ces, caused, or is
alleged to have caused, the depreciation of property values, adverse impacts on the aesthetics of
the surrounding areas, jeopardy to public health and safety, and interference with the quiet and
peaceful enjoyment of adjacent properties, all to the detriment of the welfare of the community
and to the optimum development of real property which is zoned for commercial and industrial
uses. The City Council intends forthwith to conduct studies as to appropriate modifications to the
City's Zoning Ordinance and other regulatory ordinances for the purpose of prohibiting or further
restricting the use of land for purposes described in Section ] of this interim ordinance. Pending
the completion of these studies, it is necessary for the immediate preservation of the pubic health,
safety, and welfare that this interim ordinance take effect immediately. In the absence of

immediate effectiveness,. new automotive uses may be established, or existing automotive uses
may be expanded, so as to conflict with regulations or requirements ultimately adopted with
respect to these uses, and this interim ordinance is therefore necessary to prevent a current and
immediate threat to the public health, safety and welfare. This interim ordinance is an urgency
ordinance and it takes effect immediately.
Section 5. The City Clerk is directed to certify to the passage and adoption of this
ordinance and to cause it to be published or posted as required by law.
