HomeMy Public PortalAboutOrdinance #343 TOWN OF FRASER ORDINANCE NO. 343 Series 2008 AN ORDINANCE PROVIDING FOR THE LEASING OF REAL PROPERTY OWNED BY THE TOWN OF FRASER FOR A TERM EXCEEDING ONE YEAR. WHEREAS, the Town of Fraser is the fee owner of the property described below, located in the Town of Fraser, Colorado; and WHEREAS, the Tenant named below desires to lease said property from the Town for a term which may extend beyond one year; and WHEREAS, the Board of Trustees hereby finds and determines that said lease is in the best interest of the Town, by facilitating public visitor center services at a lesser cost than can now be provided by the Town, NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE TOWN OF FRASER, COLORADO, THAT: SECTION I, The Board of Trustees hereby approves and authorizes the leasing of the following real property located in the Town of Fraser, County of Grand, and State of Colorado, to-wit: The building located on Lot 9, A Resubdivision of Tracts Band C of Clayton Subdivision, situate in the Town of Fraser, County of Grand, State of Colorado, in which the visitor center for the Town of Fraser is currently located (the "Visitor Center Building"); to BUTLER ENTERPRISES INC., a Colorado corporation, doing business as DESTINATIONS WEST ("Tenant"), for a term extending to no later than June 30, 2010, pursuant to the terms provided in the Lease Agreement dated as of June 4, 2008, in the form and content presented to and reviewed by the Board. The Mayor and the Town Clerk are authorized to execute and deliver said Lease Agreement, to effectuate such lease, SECTION 2. The Board of Trustees finds and determines that the leasing of said Visitor Center Building, as authorized by this Ordinance, is in the best interest of the Town, that said Lease Agreement is made pursuant to the provisions ofC.R.S. 31-15-713, and that all requirements of said statute have been complied with. SECTION 3, The Board of Trustees further finds and determines that this Ordinance is necessary to the immediate preservation of the public health and safety, in order to allow the Town to extend the existing lease of said property and continue the provision of visitor center services as provided in said Lease Agreement; and this Ordinance shall therefore take effect immediately upon adoption, ýÿ SECTION 4, This Ordinance shall be published rin fulll rbv title onlvl, READ, PASSED, ADOPTED AND ORDERED PUBLISHED BY THE BOARD OF TRUSTEES AND SIGNED THIS t..jtl-- day of ::I ~ ,2008, Votes in favor: !2...- Votes opposed: ~ Votes abstained: r') , /' ef J' ". /.<c,,,-'-.)
