ORDINANCE NO. 1469
FOLLOWS:
AN ORDINANCE OF THE CITY OF LYNWOOD EXTENDING
URGENCY ORDINANCE N0.1444, AS AMENDED BY
URGENCY ORDINANCE N0.1448, WHICH IMPOSES A
MORATORIUM ON THE ESTABLISHMENT OR EXPANSION
OF RECYCLING FACILITIES WITHIN THE CITY, AND
DECLARING THE URGENCY THEREOF
THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS
Section 1. In accordance with Government Code
Section 65858(d), the City Council, on December 04, 1997, caused
to be issued a written report describing the measures taken to
alleviate the conditions which led to the adoption of Ordinance
No.1444 and thereafter, on December 16, 1997, conducted a noticed
public hearing as required by Government Code Section 65858(a).
In accordance with applicable law, Ordinance No. 1444, as amended
by Ordinance No. 1448, is extended for a period of one year to
December 17, 1998, and shall thereupon be of no further force and
effect.
Section 2. The City Council, the Planning
Commission and the Department of Community Development are
continuing to study various measures to alleviate the conditions
which led to the adoption of Ordinance No. 1444, which conditions
are recited in Section 4 of Ordinance No. 1444, and which continue
to pose a current threat to the public health, safety and welfare.
This Ordinance extending Ordinance No. 1444, as amended by
Ordinance No. 1448, will ensure that no approvals or entitlements
for recycling facilities uses will be granted under the zoning
ordinance or other ordinances so as to conflict with future zoning
regulations now under consideration and study.
Section 3. The City Council incorporates by this
.reference the findings set forth in Section 4 of Ordinance No.
1444 and further determines that this Ordinance extending
Ordinance No. 1444, as amended by Ordinance No. 1448, is necessary
to prevent a current and immediate threat to the public health,
welfare and safety and will take effect immediately.
