AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA AMENDING CHAPTER 2 "ADMINISTRATION,"
OF THE VILLAGE CODE BY AMENDING ARTICLE IV,
"FINANCE," BY ENACTING SECTION 2-62 "LATE
PAYMENT CHARGE, SPECIAL ASSESSMENT LIEN FOR
DELINQUENT SOLID WASTE AND RECYCLING SERVICE
FEES," PROVIDING FOR IMPOSITION AND COLLECTION
OF SUCH LIENS AND LATE PAYMENT CHARGES;
PROVIDING FOR SEVERABILITY, INCLUSION IN THE
CODE, AND AN EFFECTIVE DATE.
WHEREAS, the Village Council finds that it is necessary to
provide for a charge for late payment of solid waste and recycling
service charges provided by the Village; and
WHEREAS, the Village Council further finds that it is
necessary to impose a lien, as a special assessment, for solid
waste and recycling service charges which remain unpaid, and to
authorize the collection and enforcement of such liens, as provided
in this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS1:
Section 1. That Chapter 2, " Administration," of the Village
Code is hereby amended by amending Article IV "Finance" by enacting
Sec. 2-62, "Late Payment Charge, Special Assessment Lien for
Delinquent Solid Waste and Recycling Service," to read as follows:

Section 2. Severability. The provisions of this Ordinance
are declared to be severable and if any section, sentence, clause
or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the

validity of the remaining sections, sentences, clauses, and phrases
of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding
the invalidity of any part.
Section 3. Inclusion in the Code. It is the intention of the
Village Council, and it is hereby ordained that the provisions of
this Ordinance shall become and made a part of the Code of Key
Biscayne, Florida; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that
the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 4. Effective Date. This Ordinance shall be effective
upon adoption on second reading.

Notice is hereby given that the following ordinance will be consid-
ered on Second Reading by the Key Biscayne Village Council at a
meeting to be held on Tuesday, April 9, 1996, at 7:00 p.m., in the
Council Chamber, located at 85 West McIntyre Street, Second Floor,
Key Biscayne, Florida:
