HomeMy Public PortalAbout1996-03 Amending Chapter 2 Administration of the Code by amending Finance re Solid Waste and Recycling Service FeesORDINANCE NO. 96-3 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AMENDING CHAPTER 2 "ADMINISTRATION," OF THE VILLAGE CODE BY AMENDING ARTICLE IV, "FINANCE," BY ENACTING SECTION 2-62 "LATE PAYMENT CHARGE, SPECIAL ASSESSMENT LIEN FOR DELINQUENT SOLID WASTE AND RECYCLING SERVICE FEES," PROVIDING FOR IMPOSITION AND COLLECTION OF SUCH LIENS AND LATE PAYMENT CHARGES; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE, AND AN EFFECTIVE DATE. WHEREAS, the Village Council finds that it is necessary to provide for a charge for late payment of solid waste and recycling service charges provided by the Village; and WHEREAS, the Village Council further finds that it is necessary to impose a lien, as a special assessment, for solid waste and recycling service charges which remain unpaid, and to authorize the collection and enforcement of such liens, as provided in this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS1: Section 1. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the 3 validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 3. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the Code of Key Biscayne, Florida; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 4. Effective Date. This Ordinance shall be effective upon adoption on second reading. PASSED AND ADOPTED on first reading this 12th day of March , 1996.
