Roll Call: Present: Stickler, Grindle, Halsey, Ulrich, and Franklin Absent: None Also present were Jim Rose (AMENT), Floyd Bruns, Ann Zemo, John Kempton and Marie Randol. Agenda: The agenda was modified with Public Communications moved to follow Warrants and Ament agreement moved to follow Public Communications. A motion to approve the modified agenda was made by Franklin and seconded by Halsey. Roll call vote: Grindle-yes, Halsey-yes, Franklin-yes, Ulrich-yes, Stickler-yes. Motion carried. Minutes: Motion was made by Ulrich and seconded by Grindle to accept the minutes of the regular meeting of October 17, 2006. Roll call vote: All ayes, motion carried. This topic will be on the next meetings agenda. NEW BUSINESS: Jim Rose from Ament, Inc. discussed with the council the professional services agreement for the Belmont Road Reconstruction project. Franklin asked Mr. Rose the percentage of Riverdale’s cost compared to the total cost of the project. Mr. Rose stated he will get back to Franklin regarding that number. Mayor Wren will check into some issues that were raised regarding a signal light at SCC, sidewalks and water detention. A motion to approve the Professional Services Agreement for Belmont Road Reconstruction between the City of Bettendorf, the City of Riverdale and AMENT, Inc. was made by Franklin and seconded by Halsey. Roll call vote: Grindle-yes, Halsey-yes, Franklin-yes, Ulrich-yes, Stickler-yes. Motion carried. COMMITTEE REPORTS: The City Clerk gave a copy of the 2006 year end financial report to the council. OLD BUSINESS: The council viewed a proposal from Creative Decks & Fence for split rail fence at Haven’s Acres Park. The proposal was broken down into two sections. Stickler made a motion to approve section (A) a 60’ foot section of split rail fence between the park and the Hill’s property for the amount of $660.00, seconded by Grindle. Roll call vote: all ayes, motion carried. The other portion of fence for Haven’s Acres Park will be budgeted for fiscal year 2008. Halsey informed the council about a bid he had received from Midwest Sales for a bike rack at Haven’s Acres Park. The council asked Halsey to acquire another bid for comparison. This issue will be discussed at a future meeting. NEW BUSINESS: A motion to approve the corrected Resolution 2006-9, a resolution acknowledging the Riverdale Fire Departments 501C7 Foundation was made by Grindle and seconded by Ulrich. Roll call vote: Grindle-yes, Halsey-yes, Franklin-yes, Ulrich-yes, Stickler-yes. Motion carried. A motion to approve Resolution 2006-10, a resolution adopting the NIMS (National Incident Management System) concept of emergency planning and unified command for use in the City of Riverdale, Iowa as its system of preparing for and responding to emergencies, and direct that appropriate city officers and employees be trained in the use of NIMS was made by Stickler and seconded by Franklin. Roll call vote: all ayes, motion carried. A motion to approve requests to serve alcohol in the community room on the dates of 11/11, 12/2, 12/8, 1/17 was made by Halsey and seconded by Grindle. Roll call vote: 5 ayes, motion carried. A motion to approve Resolution 2006-11, a resolution designating the Mayor and City Clerk as responsible for implementing the requirements of Iowa Code Chapter 22 which deals with public records was made by Ulrich and seconded by Stickler. Roll call vote: Grindle-yes, Halsey-yes, Franklin-yes, Ulrich-yes, Stickler-yes. Motion carried. A motion was made by Stickler and seconded by Grindle to accept a proposal from Scott Carlson to remove and trim trees at the corner of Valley and Fenno. Roll call vote: all ayes, motion carried. Mayor Wren quoted sections of the ruling from Judge Mark J. Smith regarding the lawsuit. Mayor Wren stated the city has assembled additional office staff to help comply with the judge’s order for documents to the plaintiffs. Mayor Wren asked the council to suggest a fee to remunerate the clerk and temporary help. A motion was made by Franklin to pay the office help, other than the Mayor and Council, twenty dollars an hour and the City Clerk time and half for over her normal hours of 8 hours a day, three days a week seconded by Halsey. Roll call vote: all ayes, motion carried. Franklin suggested the ruling by the court be put in the city minutes. Mayor Wren stated the ruling is an open record and can be viewed anytime. John Kempton questioned the Mayor and Council if some of the cost that is incurring from compiling records will be reimbursed by the plaintiffs. Mayor Wren answered yes. Ann Zemo asked if the costs will be published and the payment noted why it was being made. The City Clerk answered yes. Mayor Wren would like to put together a job description for a records support clerk. Franklin would like to look for a system that scans records for easier retrieval. He questioned if the scanned document would be as legal as the original. This issue was tabled until another meeting. Mayor Wren suggested a committee including Mary Hanson, John Ulrich, Theresa Ralfs and Norma Wren to explore hiring an accounting firm for City Hall a few hours a month. Duties that the accounting firm will manage will be considered. A records request form was examined by the council. The records request form was approved by legal council. Stickler would like the requester’s phone number and a more complete description of records requested added to the form. Franklin asked how request made at meetings would be handled. Mayor Wren stated that all requests need to be made to the Mayor or City Clerk. Franklin would like a redacting fee added to the records request form. A motion was made by Stickler and seconded by Grindle to approve the records request form with modification. Roll call vote: all ayes, motion carried. Franklin would like the new records request form be published in the next newsletter. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Stickler thanked the Riverdale Fire Department and everyone working at City Hall compiling records. Halsey updated the council regarding the new 25 mph and children playing signs. Halsey will meet with John Channon to determine where the signs will be located. The flags will be taken off the stop signs on Kensington at that time. Halsey also reported cement trucks are dumping material at the end of Kensington and would like to get a “No Dumping” sign. Mayor Wren thanked everyone for their help fulfilling the judge’s order. Mayor Wren thanked John Ulrich for acting as Mayor Pro Tem at the October 17th meeting. OLD BUSINESS: Ulrich reported the first section of fence at Haven’s Acres Park has been completed. NEW BUSINESS: A motion to approve Resolution 2006-12, a resolution adopting the Statewide Mutual Aid Compact, was made by Stickler and seconded by Grindle. Roll call vote: all ayes, motion carried. RESOLUTION # 2006-12 WHEREAS, emergencies and disasters transcend jurisdictional boundaries, making intergovernmental coordination essential in successful emergency response efforts; and WHEREAS, there will inevitably be emergencies which require immediate access to outside resources due to the fact that few individual governments have all of the resources they may need in every type of emergency; and WHEREAS, Senate File 2124, approved by the Second Session of the 79th General Assembly in 2002, creates Iowa Code section 29C.22, the Statewide Mutual Aid ompact; and WHEREAS, the Statewide Mutual Aid Compact allows participating counties, cities and other political subdivisions to provide in advance for mutual assistance in managing any emergency or disaster; THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF RIVERDALE, IOWA that in order to maximize the prompt, full and effective use of resources of all participating governments in the event of an emergency or disaster, the City hereby adopts the Statewide Mutual Aid Compact which is attached hereto and incorporated by reference. Franklin shared some information he had received regarding electronic document management systems. The council discussed advantages and disadvantages of an electronic system. Franklin will research this topic further, and report his findings to the council at an upcoming meeting. The council discussed the current practice of taping council meetings. It was suggested that the City Clerk type the minutes on a computer during the meeting, and eliminate the need for a tape. The council agreed this would make the process more efficient. A motion was made by Stickler to direct the City Clerk to take minutes of City Council meetings on a computer as soon as the equipment becomes available, seconded by Grindle. The City Clerk will research cost for a computer. Roll call vote: Grindle-yes, Franklin-yes, Ulrich-yes, Stickler-yes. Motion carried. A motion was made by Franklin and seconded by Grindle to extend the mowing contract with Cribbs through November 2006. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Franklin to secure Scott DePaepe to clean the gutters on City Hall. Roll call vote: all ayes. PUBLIC COMMUNICATIONS TO THE COUNCIL: John Kempton inquired about the City complying with the judge’s order. Mayor Wren informed Mr. Kempton that the city has complied and an affidavit has been signed by the Mayor and City Clerk stating that fact. Harry Pelton thanked Beth & Jim Mahler, Don Fisher, Larry Shoultz, Jeff & Bonnie Grindle, John Ulrich, Jim Beran, Ralph Parry and George Seaburg for all of their help with the holiday lights. Mr. Pelton suggested the city buy some new lights at the end of the season. Mr. Pelton would also like to remind the residents of Riverdale to drive carefully, because of the huge deer population. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Ulrich thanked everyone for the major effort it took to assemble documents. Ulrich also thanked everyone involved with putting up the Christmas lights. Stickler reported the Tower Park committee will be meeting November 22. Stickler thanked Fire Department and City staff for helping comply with the judge’s order. Stickler also thanked everyone for their work putting up the lights. Grindle reported the flag light will be fixed this week and he will be contacting the street sweeper. Grindle thanked everyone for their time and work the past couple of weeks. Grindle told the council, Diercks and Picton acknowledged to him how smoothly the viewing of the documents went, and the amount of work that was needed to prepare the documents. The City Clerk also thanked everyone for their help with complying with the judge’s order. Mayor Wren spoke with Aunt Rhodies for their suggestions regarding trees for the side yard of City Hall. Notes from Norma November 2006 Another Thanksgiving is now past. Despite the occasional sad events that come into everyone’s life from time to time, we come to the table and listen to Grace from a child listing all the relationships, all the events, all the hopes to come, that they are thankful for. It is humbling to listen to a child in their moments of innocent thankfulness. They are so uncluttered in their vision of where they are in a moment of time. I am aware of a book “Clear Your Clutter with Feng Shui by Karen Kingston”. I have not read but snippets of it as yet, but it’s not just about ‘stuff’, but about the psychological clearing of the clutter like the sound of cacophony, which prevents the essence of living, working, and caring for one another to come through. There is a burden in carrying the clutter of resentment, hostility, or despair, or the stronger burdens of hate and distemper. We know there is a union of health and stress and either the infliction of hatefulness or the carrying of it. In clearing the clutter in our lives, the author of this book may be on to something.
