HomeMy Public PortalAboutOrd. 1478ORDINANCE NO. 1478 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 1335 WHICH ESTABLISHES THE COMMUNITY DEVELOPMENT BLOCK GRANT ADVISORY BOARD WHEREAS, the Community Development Block Grant Advisory Board was previously established by the adoption of Ordinance No. 1335; and WHEREAS, the City Council desires to amend Ordinance No. 1335 in order to institute a more equitable appointment method. THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES ORDAIN AS FOLLOWS: Section 1: Ordinance No. 1335 is hereby amended by adding the following: Composition: Appointment of Members The Lynwood Community Development Block Grant Commission shall consist of seven (7) members who shall be residents of the City. Members shall not be officers or employees of the City. All members shall serve at the will and pleasure of the City Council. Each member of the City Council shall appoint a person to serve on the Community Development Block Grant Advisory Board to represent Chat councilmember's interest with the community. 'The Mayor shall appoint an additional two (2) persons to serve on the' Commission. 2. Term of Office The five (5) members of the Lynwood Community Development Block Grant Commission appointed by their respective Councilmembcrs shall serve afour-year term commencing on January 1st following a general municipal election zt evhich the appointing councilmember was elected. in the event the office of any appointing councilmember becomes vacant during the term thereof, the term of the commission member appointed by such councilmember shall terminate thirty (30) days after such vacancy occurs. The additional two (2) members of the Lynwood Community Development Block Grant appointed by the Mayor shall serve terms concurrent with the Mayor. Vacancies and Dismissals. Vacancies on the Lynwood Community Development Block Grant Commission shall be filled by nomination of the councilmember who made the appointment or that cormcilm.ember's successor. Any dismissal shall be without cause or merit and shall be affirmed by the appointing councilmember of each respected commissioner appointed by City Council. 4. Absence from Meetings 1f a member of the Lynwood Community Development Block Grant Commission is absent from three (3) successive regular meetings without being excused by the Commission or is absent for any reason for more than four (4) regular meetings during a tweh~e (I2) month period, the office of such member shall be vacated and the chairperson shall immediately notify the appointing city councilmember that said office is vacant. Upon such notification, a successor for the remainder of the term of such member shall be appointed by the appointing councilmember. 5. Regular Meetings Regular meetings of the Lynwood Community Development Block Grant shall be determined by resolution of the Commission, except that the commission shall meet at least once a month. Commission meetings shall be on weekdays, either day time or night time hours. 6. Records. The Lynwood Community Development Block Grant Commission shall cause proper, accurate and permanent records of official acts and proceedings to be kept, and such records shall have the same status as records of other administrative departments of the City. Minutes, resolutions, and official records of the Commission shall be filed with the City Clerk. Oreanization. The Lynwood Community Development Block Grant Commission shall elect one of its members as chairperson, and such election shall be held as soon as practicable. Appointment as chairperson shall be for 12 months. No member shall be re-elected to serve as chairperson after having served a 12 month appointment during his/her term on the Community Development Block Grant Commission. Elections of chairpersons by the Commission shall be fair and without any bias or prejudice to that commissioner. 8. Compensation. Members of the Lynwood Community Development Block Grant Commission shall receive compensation for their services as set by resolution of the City Council. The secretary of the Lynwood Community Development Block Grant Commission shall submit to the Finance Officer at the end of each calendar month, a statement showing the number of meetings of the Community Development Block Grant attended by each member during each month. A member shall not be paid for attendance at a Commission meeting if that member was absent from that meeting, regardless of whether the absence was excused or unexcused. No additional compensation shall be paid for expenses incurred by the members of the Commission in the performance of their duties, except that the City Council may from time to time authorize hr advance, expenditures for attendance at seminars, institutes, or other meetings which the City Council finds Co be beneficial to the commissioners in the performance of their duties, and in the best interest of the City. All claims shall be filed with the Finance Officer and shall be subject to audit and approval by the City Council. Section 2: If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance is held invalid, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed each section, sebsectiom, subdivision, paragraph, sentence, clause or phrase of this ordinance irrespective of the fact that any one or more section, subsection, subdivision, paragraph, sentence, clause or phrase be declared invaaid. Section 3: This ordinance shall take effect thirty (30) days after its final passage and within fifteen (15) days after its passage, the City Clerk shall cause it to be published in a local newspaper of general circulation in the City of Lynwood and hereby designated for that purpose.
