ORDINANCE N0. 1479
AN ORDINANCE OF THE CITY OF LYNWOOD
AMENDING SECTION 25-34.?_ a.12 AND
SECTIONS 25-16.20 d.and e. OF CHAPTER
25 OF THE LYNWOOD MUNICIPAL CODE TO
ELIMINATE THE 500 FOOT DISTANCE
RESTRIC`PION ON THE SALE OF ALCOHOLIC
BEVERAGES BY BUSINESSES LOCATED 1N THE
PCD(PLANNED COMMERCIAL DEVELOPMENT)ZONE
THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND AND
ORDAIN AS FOLLOWS:
Section 1. The City of Lynwood wishes to encourage a variety
of commercial development within i.ts large scale planned
commercial development (PCD) zones. Current ordinance provisions
would preclude businesses such as bone fide restaurants,
supermarkets and drug stores within PCD zones from selling
alcoholic beverages if they were within 500 feet of any business
located outside the zone that sold alcoholic beverages for on sit
or off site consumption. Such prohibitions act to discourage
supermarkets, restaurants and similar uses from locating with the
PCD zone.
In addition, a suggestion was made during public hearing that
fraternal organizations be included as uses that are exempt from
the 500 ft. distance requirement, that lighting standards be
expressed in metric units and that minimum lighting standards be
required when survei7.lance cameras are required. This ordinance
has been revised to include these suggestions.
Section 2 Section 25-34.2 a.12 of Chapter 25 of the Lynwood
Municipal Code is hereby amended to read as follows:
25-34.2 a.12 Sales of alcoholic beverages for on or. off site
consumption (provided subsection 25-16.20 requirements are
met) except that such uses within the PCD zone are exempt
Prom the requirement to be at least 500 feet away from other
uses selling alcoholic beverages, from residential. uses and
other specified consideration points.
Section 3 Sections 25-16.20 d. and e. of Chapter 25 of the
Lynwood Municipal Code is hereby amended to read as follows:
d. On-Sale Liquor. Establishments. No on-sale liquor
establishments shall be maintained within five hundred (500)
feet of any other establishment wherein alcoholic beverages
are sold, for on-site and/or of-si.te consumption, or from any
residential use or from such consideration points as schools
(public and private); established churches or other places of
~.aorship; hospitals, clinics, or other health care facilities;
public parks and playgrounds and other uses, except that
veterans and fraternal clubs, bona fide restaurants-and any
uses selling alcoholic beverages in the PCD (Planned
Commercial Development) zone are exempt from the distance
requirements. All distances shall be measured between the
nearest entrances used by patrons of such establishments
along the shortest route intended and available for public
passage to other. such establishments, or to the nearest
property line of any of the above-referenced consideration
points.
1. A masonry wall of six (6) feet in height shall. be
constructed around the parking area of such establishments
when said area is adjacent to properties zoned or used for
residential purposes;
2. The noise levels generated by the operation of
such establishment shall not exceed 60 dBP. on adjoining
properties zoned or used for residential purposes;
3. Exterior lighting of the parking area shall be
kept at an intensity of between one (1) and two (2) foot
candles (10 and 20 lux/mZ)so as to provide adequate lighting
for patrons while not disturbing surrounding residential or
commercial areas.
If exterior surveillance cameras are required,
adequate exterior lighting shall be provided for operation of
such cameras.
4. A minimum of fifty-one (51%) percent of
restaurants' gross receipts shall be from food sales. 1'he
owner/operator shall summit evidence of total food sales to
the Account:i.ng Department of the City of Lynwood, one year
after approval of the Conditional Use Permit by the Planning
Commission.
e. 0:[f Sa].e Liquor Establishments. No off-sale liquor
establishment shall be maintained within five hundred (500) feet
of any other establishment wherein alcoholic beverages are sold
for both off-site and on-site consumption or such consideration
points as schools (public and private), established churches or
other places of worship, hospitals, convalescent_ homes, public
parks, and playgrounds and/or other similar uses except that any
uses selling alcoholic beverages in the PCD (Planned Commercia].
Development) zone are exempt from the distance requirements. The
distance of five hundred (500) feet shall be measured between the
nearest entrances used by patrons of such establishments along the
shortest route to other establishments, or to the nearest p.r.operty
line of any of the above referenced consideration points.
Section 9_ The City Clerk is directed to certify to the
passage and adoption of this ordinance and to cause the same to
published or posted as :required by law.
