Ordinance No. 07-168 states: Section 1. Appointment. The Mayor may appoint, subject to Council approval, an Assistant City Clerk to serve at the discretion of the Mayor. Section 2. Compensation. If appointed, the Assistant City Clerk is paid such compensation as specified by resolution of the Council. Section 3. Duties of the Assistant City Clerk. The duties of the Assistant City Clerk are as follows: Learn and implement the processes and policies of the City of Riverdale. Assist the City Clerk in management of documents and management of City business. Be present during vacation periods of the City Clerk. Assist the City Clerk in the performance of the duties of the City Clerk. Perform such other duties as designated by the Mayor and/or City Clerk from time to time. Roll call vote: Franklin-yes, Stickler-yes, Grindle-yes, Halsey-yes, Ulrich-yes. All ayes, motion carried. The council discussed the donation of the 1984 Ford Pumper Fire Engine. After some discussion, a motion was made by Franklin and seconded by Halsey to approve resolution #2007-06 with inclusion of “as is” regarding condition of pumper fire engine which states: Resolution Authorizing the Donation of City’s “As Is” 1984 Ford Pumper Fire Engine to Eastern Iowa Community College District Foundation. Whereas the City of Riverdale owns a 1984 Ford Pumper Fire Engine (“Fire Engine”), Vehicle Identification No. 1FDYD80U9DVA40557; Whereas the City of Riverdale is no longer in need of the Fire Engine for operational purposes on account of changed governmental standards; Whereas Eastern Iowa Community College District Foundation, a governmental body, is in the process of establishing a firefighting training center to serve neighboring cities, including the City of Riverdale; Whereas the City of Riverdale has entered into mutual aid agreements with certain neighboring communities pursuant to Iowa Code Section 364.4; Whereas all members of the City of Riverdale Fire Department must attend and actively participate in regular or special training drills or programs pursuant to Iowa Code Section 372.13; and Whereas donating the Fire Engine to Eastern Iowa Community College District Foundation would be for a public purpose and benefit the City of Riverdale and neighboring communities, NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF RIVERDALE, IOWA, that the Fire Engine be donated to Eastern Iowa Community College District Foundation for use in its firefighting training center. Roll call vote: all ayes, motion carried. Stickler updated the council on Tower Park and introduced Tully Heath from Ament to discuss a proposal for surveying and engineering services to create site plans, drainage, calculations, and specifications for converting the existing former water tower area into a city park. Jim Beran expressed concern regarding a storm drain that is in need of repair in that area and is a safety hazard. Beran stated to the council that the repair of this storm drain should not be included in the cost of the park. Mayor Pro tem Ulrich replied that the issue of the storm drain would be checked into. After some discussion, a motion was made by Stickler and seconded by Franklin to authorize Ament to proceed with the proposal agreement for the amount of $4,800.00. Roll call vote: all ayes, motion carried. Ulrich informed the council that the picnic tables have been ordered. Midwest Sales will assemble and deliver the picnic tables to the appropriate areas in the city. Stickler stated there were some issues regarding new fiber optic lines where the tree was to be planted at the entrance on Manor Drive; the tree will be planted so it does not interfere with the fiber optic lines. NEW BUSINESS: Angela Reier (Attorney) updated the council about an open records request for information regarding donations made to the Riverdale Fire Department. The Riverdale Fire Department has set up a foundation that is a separate legal entity, but a claim may be made that it is an instrumentality of Riverdale. Ms. Reier recommends Riverdale proceed by filing an action seeking an injunction and declaratory judgment on this issue, which will clarify the issues and ensure compliance by Riverdale and its officials with the obligations of the open record laws. A motion was made by Franklin and seconded by Stickler to give Angela Reier (Attorney) authority to file action for an injunction and declaratory judgment regarding the open records request for donations made to the Riverdale Fire Department. Roll call vote: Franklin-yes, Stickler-yes, Grindle-yes, Halsey-yes, Ulrich-yes. All ayes, motion carried. A motion was made by Halsey and seconded by Grindle to approve Resolution 2007-07 a resolution approving the agreement between the city of Riverdale, Iowa, and Allied Waste Services for service of the City’s waste/refuse collection. Roll call vote: all ayes, motion carried. A motion was made by Franklin and seconded by Halsey to table Resolution 2007-08 a resolution approving the agreement between the City of Riverdale, Iowa, and Mahler concrete for service of the city’s removal of snow/ice from streets and public entities within the City of Riverdale until contract is renewed. Roll call vote: all ayes, motion carried. A motion was made by Franklin and seconded by Grindle to approve Resolution 2007-09 a resolution approving the agreement between the City of Riverdale, Iowa, and Cribbs Landscaping for service of mowing, trimming, spraying and general maintenance of city lawns and flower beds throughout the City of Riverdale. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Grindle to approve Resolution 2007-10 a resolution approving payment of outstanding invoices after the June 19, 2007 meeting and before July 1, 2007 (the end of the fiscal year). Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Franklin to approve Resolution 2007-11 a resolution naming official publications. Roll call vote: all ayes, motion carried. A motion was made by Franklin and seconded by Halsey to table Amendment to Ordinance 15.04 and Amendment to Ordinance 17.06 because ordinance numbers were listed incorrectly on the agenda. Roll call vote: all ayes, motion carried. This issue will be on the regular council meeting agenda for June 19, 2007. Franklin informed the council that there are subsided areas around streets and gutters in the City of Riverdale. After some discussion a motion was made by Franklin and seconded by Stickler to contact Ament to provide an estimate for inspecting street and gutter for subsidence throughout the city. Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: Grindle informed the council that he is in the process of painting flag pole at top of Manor Drive. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Halsey asked for an update on how the city is proceeding with the removal of the stop signs on Kensington. Ulrich stated he is going to handle the process of getting the new fence and informed the council that Steve Wilson is interested in bidding on that. The city clerk informed the council that Jeff Grindle and Larry Shoultz removed tree stumps from Bicentennial Park. PUBLIC communications: Dallas Paustian stated to the council that he is concerned about weeds within Haven’s Acres Park area and asked the council to have it sprayed. Mayor Pro Tem Ulrich stated Cribbs Landscaping will be contacted and the City Clerk will call Mr. Paustian when the spraying has been completed. Marie Randol stated a sink hole was a problem on Manor Drive before. Marie Randol asked when the last park committee meeting was held. Stickler replied today. Marie Randol asked who is on the park committee. Stickler listed Linda Veit, Jim & Sandy Partridge, Ralph & Rosie Parry, Judy Hiles, Linda Hupp, Jim Beran and Teri Stickler. Marie Randol asked where the official site of postings is for the city. Larry Shoultz stated that everyone has been given the opportunity to be on the park committee and it is not true that certain people were put on the committee. Jim Beran stated the gutter problem is due to a gap in the concrete that water gets into. Jim Beran asked Angela Reier (attorney) what is considered a meeting. Ms. Reier responded that it is not an easy answer, and will work on a letter to clarify for the city what is required from committees regarding meetings. Franklin asked Ms. Reier to check into what other towns do that are comparable in size to Riverdale. Larry Shoultz stated it is not a committee it is volunteers. Jim Beran questioned the repair of the sewer in the tower park area. A motion to adjourn was made by Franklin and seconded by Halsey. Roll call vote: all ayes, motion carried. The committee is waiting for a report from AMENT for the engineering portion of the park project. The committee expects the report back from AMENT around July 3rd and would like the council to schedule a Public Hearing to allow the community to view the design and give feed back on the parks development. After some discussion a motion was made by Stickler and seconded by Franklin to schedule a Public Hearing for Tower Park on Thursday, July 12, 2007 in the community room at City Hall from 7-8:30 p.m. Roll call vote: all ayes, motion carried. The City Clerk will put the date of the public hearing in the June newsletter. Mike Larson from Computer Team gave a presentation of a document management system that he has proposed for the City of Riverdale. After some discussion regarding the compensation for Mayor a motion was made by Franklin and seconded by Halsey to accept the first reading of the Amendment to Ordinance 15.04 which states: Amendment to Ordinance 15.04 The City of Riverdale Ordinance Number 15.04 is revoked and replaced with the following Ordinance Number 15.04 effective January 1, 2008: 15.04. Compensation. The salary of the Mayor is $7,200.00 dollars per calendar year, payable quarterly. Roll call vote: Franklin-yes, Stickler-yes, Grindle-yes, Halsey-yes, Ulrich-yes. After some discussion regarding the compensation for Council members a motion was made by Franklin and seconded by Halsey to accept the first reading of the Amendment to Ordinance 17.06 which states: Amendment to Ordinance 17.06 The City of Riverdale Ordinance Number 17.06 is revoked and replaced with the following Ordinance Number 17.06 effective January 1, 2008: 17.06. Compensation. The salary of each Council member is $2,400 dollars per calendar year, payable quarterly. Roll call vote: Franklin-yes, Stickler-yes, Grindle-yes, Halsey-yes, Ulrich-yes. All ayes, motion carried. A motion was made by Stickler and seconded by Grindle to accept the bid from Creative Decks and Fence for the amount of $2180.00 to install a split rail fence at Haven’s Acres Park. Roll call vote: all ayes, motion carried. NEW BUSINESS: Angela Reier (Attorney) updated the council regarding a new public request fee schedule that was drafted by the city attorney’s office. After some discussion, a motion was made by Franklin and seconded by Stickler to change the phrasing of the 15 minute “free service” from calendar day to calendar month. Roll call vote: Halsey-no, Grindle-no, Stickler-no, Ulrich-no, Franklin-yes. There were four no’s and one yes, motion failed. After more discussion regarding the matter of the 15 minute “free service” a motion was made by Ulrich and seconded by Halsey to change the phrasing of the 15 minute “free service” from calendar day to calendar week. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Grindle to change the amount of advance deposits (Section C) of the fee schedule from $25 dollars to $10 dollars. Roll call vote: all ayes, motion carried. A motion was made by Ulrich and seconded by Grindle to change the updated records request form to reflect the 15 minute “free service” per week change and also to remove all wording from “for office use only” and below. Roll call vote: all ayes, motion carried. A motion was made by Ulrich and seconded by Franklin to approve resolution #2007-12 which states: RESOLUTION # 2007-12 A RESOLUTION ADOPTING A FEE SCHEDULE FOR EXPENSES INCURRED IN FULFILLING IOWA CODE CHAPTER 22 PUBLIC RECORDS REQUESTS. WHEREAS, the Riverdale City Council recognizes the public’s right to inspect public documents as outlined in Iowa Code Chapter 22; WHEREAS, the Riverdale City Council has incurred substantial expense to date in fulfilling public records requests made pursuant to Iowa Code Chapter 22; and WHEREAS, Iowa Code Chapter 22 authorizes fees to be charged in fulfilling public records requests. A motion was made by Franklin and seconded by Ulrich to approve Resolution #2007-13 which states: RESOLUTION # 2007-13 A RESOLUTION DECLARING A CLASS OF SECURITY RECORDS CONFIDENTIAL PURSUANT TO IOWA CODE SECTION 22.7. WHEREAS, the Riverdale City Council is considering installing a new security system which would alter its security procedures and emergency preparedness, for the protection of City of Riverdale employees, visitors to City Hall, and the property located in City Hall; WHERAS, the Riverdale City Council is accepting bids which include schematic designs and other information regarding the potential security system, the disclosure of which the Riverdale City Council reasonably believes would be expected to jeopardize the effectiveness of the system to the detriment of the City of Riverdale employees, visitors to City Hall, and the property located in City Hall; WHERAS, the Riverdale City Council believes it is necessary to declare certain classes of records confidential pursuant to Iowa Code Section 22.7 to protect the effectiveness of the system and the City of Riverdale employees, visitors to City Hall, and the property located in City Hall. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Riverdale, Iowa, the following class of records are deemed confidential pursuant to Iowa Code Section 22.7 with regard to information supplied by vendors who are bidding on installation of a new security system for the Riverdale City Hall: records which contain information related to security procedures or emergency preparedness which are developed or maintained by the City of Riverdale for the protection of its employees, visitors, and the property, which include, but are not limited to, information directly related to vulnerability assessments; information contained in records relating to security measures such as security and response plans, security codes and combinations, passwords, restricted area passes, keys, and security or response procedures; emergency response protocols; and information contained in records that if disclosed significantly increase the vulnerability of critical physical systems or infrastructures of a government body to attack. Roll call vote: all ayes, motion carried. Franklin asked Angela Reier (attorney) to prepare a separate resolution dealing with the Fire Departments preparedness for security. A motion was made by Ulrich and seconded by Franklin to approve resolution #2007-14 which states: RESOLUTION NO. 2007-14 A RESOLUTION AMENDING CITY CLERKS SALARY FOR THE CITY OF RIVERDALE Be it resolved by the Council of the City of Riverdale, Iowa: That the amount of salary to be paid to the city employee holding the position of City Clerk be in the amount of $25,000 per year, payable semi monthly and effective July 1, 2007 Roll call vote: all ayes, motion carried. Mayor Wren informed the council that a leak has been discovered around the fireplace in the community room and needs to be fixed immediately. A motion was made by Halsey and seconded by Franklin to have the water problem around the fireplace fixed and not to exceed the amount of $5000.00 (five thousand).Roll call vote: all ayes, motion carried. Mayor Wren also mentioned the wallpaper in the community room needs to be replaced but the leak will need to be fixed first. A motion was made by Stickler and seconded by Halsey to purchase two love seats for the community room. Ulrich suggested the love seats be scotch guarded .Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: A motion was made by Ulrich and seconded by Franklin to accept the 2007 May financial report with one correction. Roll call vote: all ayes, motion carried. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Franklin updated the council regarding the amount of bids that came back for the inlet repair on Bellingham road. Franklin feels the bids are too high and would like to look for other companies. Franklin reported a tree limb down at Bicentennial Park. Ulrich told the council that Scott Carlson has been contacted. Stickler reported a broken picnic table on the sand at Bicentennial Park. Grindle reported the old fire station flag pole has been painted and an American Flag and Riverdale Fire Department flag will be flown on it. Grindle also thanked firemen for helping put the pole back up. Grindle updated the council on work that will be happening around the city. A manhole cover on Fenno will be fixed, Manor Hill will receive a slag coat and concrete work will be done at the fire station. Grindle also reported the street sweeper will be coming by soon and that the electrical work on generator has been finished. Halsey reported that Cribbs has sprayed both parks, and that he has contacted the railroad company regarding downed tree branches. Mayor Wren stated she will attend a steering committee meeting for the Belmont Road project on June 20th. The Mayor stated more public meetings will be held but they have not been set at this time. Mayor Wren reported she will also be attending a meeting regarding the Recreational Trail. Mayor Wren informed the council that the City will be in court July 17th as a plaintiff, for a judgment regarding records from the Riverdale Firefighters Foundation. PUBLIC communications: Carl Bulat asked about the old fire truck. Mayor Wren stated it was donated to the EICCD foundation. A motion to adjourn was made by Halsey and seconded by Franklin.
