Present: Franklin, Ulrich, Stickler, Grindle and Halsey Absent:Wren Also present: Floyd Bruns, Marie Randol and Steve Townsend Mayor Pro Tem Ulrich asked for comments or questions from the council and public regarding the 2007-2008 budget. No comments or questions were made from the public. After some review and discussion from the council a motion was made by Franklin and seconded by Halsey to close the public hearing. Roll call vote: all ayes, motion carried. The public hearing closed at 7:07pm. Mayor Pro Tem Ulrich opened the regular meeting of the Riverdale City Council at 7:08 p.m. on Tuesday, March 6, 2007. Roll Call: Present: Stickler, Ulrich, Halsey, Grindle, Franklin Absent: Wren Also present: Floyd Bruns, Marie Randol and Steve Townsend Agenda: A motion to approve the agenda was made by Stickler and seconded by Grindle. Roll call vote, 5 ayes, motion carried. Minutes: A motion was made by Halsey to accept the minutes of the regular meeting of February 20, 2007 with one spelling correction. After some discussion, Halsey requested his motion be withdrawn. A motion was made by Franklin and seconded by Halsey to accept the minutes of the regular meeting of February 20, 2007 with one spelling correction and add for clarification that Mr. Wilson and Mr. Mahler supported the suggestion to divide the land, were the proposed new park would be, into two lots and sell it. Cause to be kept records of the fire department personnel, the number of responses to alarms, their cause and location, and an analysis of losses by value, type and location of buildings was made by Stickler seconded by Franklin. NEW BUSINESS: A motion was made by Halsey and seconded by Grindle to approve Resolution 2007-02 which states: RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A FINANCIAL AGREEMENT WITH THE IOWA DEPARTMENT OF TRANSPORTATION FOR THE BELMONT ROAD PROJECT FROM CORRAL COURT TO VALLEY DRIVE Roll call vote: all ayes, motion carried. A motion was made by Franklin and seconded by Stickler to approve Resolution 2007-03 which states: RESOLUTION APPROVING THE CERTIFICATION OF THE 2007-2008 ANNUAL CITY BUDGET FOR THE FISCAL YEAR ENDING JUNE 30, 2008 Roll call vote: all ayes, motion carried Chief Bruns discussed with the council what work would be needed to rewire the generator to the community room and kitchen at City Hall so the community room could be used as an emergency shelter. Franklin asked if the generator had enough capacity to handle the fire station and the community room, and Chief Bruns replied that it would. Grindle and Bruns will research cost to rewire the generator and report their findings at the next council meeting. A motion was made by Stickler and seconded by Franklin to upgrade the mailing system at City Hall from Pitney Bowes. Roll call vote: all ayes, motion carried. Franklin will research the cost of a digital camera with SD chip for use at City Hall. This issue will be discussed at the March 20, 2007 meeting. COMMITTEE REPORTS: Stickler reported there may be a tower park meeting Thursday, March 8th in the community room at City Hall. The council discussed the issue of downed tree branches and whether they should have them picked up now or wait for the first pick up which begins the first week of April. Stickler stated this is a nice service to the community. Franklin will call Allied Waste and see if they will pick it up now or if they will wait until April. If there is an additional cost to pick them up, it will be discussed at the next council meeting. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Chief Bruns stated the crack sealant in both parking lots at City Hall and the Fire Station are in need of repair. The City Clerk will contact Tri City Blacktop and request a quote to reseal the cracks in both parking lots. Grindle reported the steps at City Hall need to be repaired, but suggested this work be done when the weather is warmer. This issue will be discussed at the next council meeting. PUBLIC COMMUNICATIONS TO THE COUNCIL: Steve Townsend thanked the council for opening the community room during the power outage. Mr. Townsend asked for an update on the Belmont Road Project. Franklin and Ulrich will try to attend a meeting about Belmont on March 13, 2007 with the City of Bettendorf. Marie Randol asked if there will be any more pubic hearings regarding the Water Tower Park. Stickler stated there are no public hearings scheduled at this time. Ms. Randol asked how the call list, to report the community room was open during the power outage, was determined and whose list she was on. John Ulrich stated the Riverdale phone directory was divided into three sections, with a section given to Franklin, Grindle, and himself and she was on his list. Ms. Randol suggested the public have a phone other than cordless phones in use so people could be reached. Ulrich suggested updating the Riverdale phone directory. The Scott Community College Roadway Improvement Project is in the early stages of survey work and property owners have been notified. A public meeting will be held in the future with drafts and a schedule of this SCC roadway project. Jim Beran stated there is a 300 ft. buffer zone between Manor Drive and SCC and that Shive Hattery has a copy of the boundaries. Mr. Molison stated he has heard that from a couple people, but has not received that material yet. Mr. Molison emphasized that the road placement will not be established until the survey work is done. Mr. Molison also informed the council and public about an upcoming meeting regarding the Belmont Road Project. A Residents Meeting/Open House will be held Tuesday, March 27, 2007 from 6:00 to 8:00 p.m. at the Pleasant Valley High School Library. The purpose of the Open House is to discuss and answer resident’s questions regarding the planned reconstruction of Belmont Road from the Pleasant Valley High School to Valley Drive. PUBLIC COMMUNICATIONS: Rosie Parry presented a petition to the council with 140 signatures that stated: We the undersigned totally support the Mayor, each Council member, the Clerk and the Treasurer and stand behind them. We feel that they are being harassed by a small group of residents. We know that oversights will occur from time to time but we believe there is no malice or criminal intent. If an oversight does occur we know it will be corrected and business will move forward. These signatures will be presented to the Council on March 20, 2007 at their regular meeting. Rosie stated she is sorry that the Mayor and Council are going through this. And asked if the city is destroyed, then what will happen? Ralph Parry stated he was on fire department for 17 years with Floyd Bruns. Mr. Parry said this is a fantastic town to live in and raise kids. Larry Shoultz stated he has been coming to Riverdale since 1974. Mr. Shoultz said in his experience if you have an issue with the city you need to bring it down to a meeting instead of using some back door issues that are being used to serve infractions against the City, and tying up the city’s time. People need to come down and explain why they are requesting inventory for the Fire Department, tax ID numbers and when the city credit card was established. Mr. Shoultz said he is proud to be a part of this city. Tony Zemo stated he values Ralph and Rosie Parry’s opinion, but Mayor Wren is wrong and Mr. Zemo stated he told Mayor Wren she was wrong. Mr. Zemo said he is leaving Riverdale after 40 years and he leaves very sad. Mr. Zemo stated he hopes when the audit report comes out things would be made clear. He concluded by saying I do not want to hurt anybody’s feelings, I just want to do what is right. Dale Hupp stated he would like to see as much information as possible put into the minutes and told the public to make sure to read the minutes. Mr. Hupp asked how many documents have been asked for since the lawsuit and how is the clerk getting regular city business done. The clerk told Mr. Hupp about a thousand documents have been requested to review or copy since November 2006. The clerk also stated she has stayed late or comes in on days off to finish her work. Franklin stated a part time clerk is needed just for the time it takes to search and retrieve documents. Mayor Wren stated an ad has been published for an assistant city clerk. Franklin made the clarification that legal fees for the lawsuit were paid for by insurance. Beran asked for an overview of why the city was taken to court. Mayor Wren stated at this point and time we are waiting for the state audit report. Mayor Wren said she spoke with the state auditors office today and the report, which was expected the end of March, has been postponed. Mayor Wren stated when the final report is received from the state auditor’s office the city will have a public community wide meeting with all the communications the city has had. Mayor Wren said the city has always been financially responsible and we function with a lot of volunteers. Without our volunteers the city would not have the Christmas decorations put up, the calendar, 4th of July celebration or the Easter egg hunt. Volunteers are a plus for how the city operates. A resident asked Steve Hunter (City Attorney) if the state auditor’s office can accept documents from residents. Steve Hunter stated the open records law is very broad and it gives the public the right to publish a record once they have it because it is a public record. Mr. Hunter also stated the State Auditor has the discretion to do what they would like with the audit and they can take documents from a resident. Mayor Wren stated the state auditors came to City Hall and had access to everything in the city and the auditor has looked at everything they wanted to see. Byron Kime asked who are “they” and do we have a public record of who is asking for copy request. Franklin stated the city was audited by Eide Bailly. (Later this statement was clarified by Steve Hunter that Eide Bailly had not done an audit for the City but a review of records.) George Seaburg asked if there is a cut off date or can the auditor keep getting information? Steve Hunter stated they are auditing a specific period of time but if the auditor feels they need source records they will come back. Rosie Parry asked if the state has ever audited the city before. Mayor Wren said no. The law does not require a city of Riverdale’s size to have an audit. The city has always had a private audit done, but it is not required by law. Steve Hunter clarified that the City of Riverdale does not have an audit done, but a review of financial records. A resident asked if they can appeal to state legislator. Mayor Wren answered yes you can. Pat Mohr asked when the audit is concluded does it come to a conclusion. Mayor Wren answered yes. Gene Gsell stated that communication has been lacking. Mr. Gsell said he read in the minutes a letter was read regarding flags, and at the next meeting a motion was made not to have public letters published in the minutes. Mr. Gsell stated the minutes have been short on information and need to be more detailed. Mr. Gsell stated communication is very important, and if the city has made a mistake own up to it. Mr. Gsell said in his opinion the city wasn’t being open and what will the city do to prevent this in the future. Mayor Wren stated the minutes are required to record motions and actions by the council and to record historical information. A resident asked how much the Mayor and Council are legally allowed to say. Mayor Wren stated we have felt we were required not to respond until the audit is completed. Steve Hunter stated that the decision of the court regarding the lawsuit is an open record. Stickler stated when all of this started to happen it was new to everybody. You could count on two hands the number of request for records in the history of Riverdale. When request for records first started, we didn’t know what to do about the security of records and we didn’t know what you could give out. The city has one part time City Clerk and a part time Mayor and Council, then you have 2500 copies requested and I believe everybody was trying to do the right thing. The court felt it was not done in a timely manner, and the City is still trying to do the right thing. Stickler stated what I have done has always been in the city’s best interest. If you want to find things wrong, I’m sure you can, but it is a nice place to live. George Seaburg stated: so we are waiting on the audit. Mr. Seaburg asked the residents to get in touch with Hartsuch a representative to get some action and get the audit done. Harry Pelton stated that what we have is harassment and the City can’t say anything until the audit report is finished. But these citizens can go to media. Steve Hunter explained that the citizens have the right to express their rights and the governmental body acts as a neutral party. Pat Mohr stated that you can say anything you want and go to the paper. Susan Littrel stated she did two things after reading the article in the paper. Mrs. Littrel called Mayor Wren and then she called Hartsuch. Mrs. Littrel stated the residents need to get on the phone, email and write letters. Mrs. Littrel stated she has voted in every election and was at the meeting when the fire dept was attacked. Mrs. Littrel said these people are the minority we are the majority. Dale Hupp stated that the Mayor and Council are not lawyers and don’t know all the laws. Mr. Hupp said when someone is scrutinizing everything that is being done that the city should have legal council at every meeting until the city gets through this. Mr. Hupp stated we need to get this stopped. Jim Beran referred to a USA Today online report. Steve Hunter told Mr. Beran he could make the article available, but not to compound issues. Mr. Hunter stated this is a neutral forum at a council meeting. Bonita Grindle stated as a citizen we can get mad at what is in the paper, but the council cannot elaborate about what is in the paper. Mrs. Grindle said council cannot state their opinion. Pat Mohr asked why the council hasn’t sat down with Tammie and Allen. Mr. Mohr said why can’t you just sit down and find out what is going on. Mayor Wren stated that there was a settlement conference before the lawsuit, so they did try before. Gene Gsell stated that there was prior vindictiveness by some people, and in hind sight the city should have sat down and talked. Mayor Wren stated there was a triggering event. Steve Hunter again asked the public to read the court’s opinion. A resident asked how long the court opinion is. Mayor Wren stated about 20 pages. Mayor Wren will look into putting it on the city’s website. Cheryl Channon stated it was sad to see the city come to this, and was sorry the Fire Department has to go through this. Linda Hupp asked if the audit is identified by a number or how do you address it. Mayor Wren said by the City of Riverdale. Steve Sinner explained the aerial apparatus is used on one and two story buildings. Stickler stated not many cities our size have buildings like Alcoa, SCC college and high school like we do. Susan Littrel thanked Floyd Bruns and volunteer fire department for saving their home. Mrs. Littrel said they went above and beyond what other fire departments do. Pat Mohr gave a petition to Mayor Wren. The petition stated: We the undersigned Citizens of the City of Riverdale, Iowa, DO NOT want a gazebo constructed at Tower Park. If the City of Riverdale must spend money, we the undersigned residents would rather have a picnic shelter along with permanent bathrooms with running water at Bicentennial Park. This would allow our children, grandchildren, and guests on special events to play and celebrate in one area rather than having to cross a dangerous intersection. This would benefit all citizens rather than a select few. We further recommend that some of the undersigned citizens be placed on a new park committee to decide this matter. Jim Beran stated it has come to his attention that the Tower committee requires an agenda and minutes. Mr. Beran stated the committee was put together to look into the land and a plan to present to the council. Mr. Beran said when the committee has given notice of a public meeting nobody showed up and ‘I’m not sure if this committee needs a formal agenda’. OLD BUSINESS: A motion was made by Ulrich and seconded by Grindle to accept a bid from Raynor for the amount of $669.54 to repair the Fire Dept garage door. Roll call vote: Franklin-yes, Ulrich-yes, Stickler-yes, Halsey-yes, Grindle-yes. All ayes, motion carried. A suitable use for the old fire truck will be discussed at the next council meeting. The council discussed a redacting fee. This issue requires more information and will be discussed at the next council meeting. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Franklin reported that he attended a meeting regarding Belmont Road. An oversight committee is being formed with the Mayor, Council person and a resident that lives on Belmont. John Channon and an alternate will help fill this position. Stickler reported that the Tower Park committee canceled last tentative meeting. Stickler said the committee saw Bicentennial Park as an active park and Tower Park could be used more as a relaxing park. Stickler said the primary use of Tower Park would be used at 4th of July. Stickler stated the committee has worked very hard. Stickler also thanked everyone for coming to the meeting. Halsey stated he appreciated the turn out to the meeting and announced he was not going to resign. Grindle stated it was good to see the city support Fire Department and Council. Mayor Wren stated that words could not express her appreciation for the support at this meeting. Mayor Wren updated the public about projects the city will be doing in the near future. Mayor Wren spoke about Belmont Road, Water Tower Park, and the recreational trail. Mayor Wren emphasized that the SCC road project is not part of the city’s infrastructure. BELMONT ROAD RECONSTRUCTION PROJECT The first public informational open house is scheduled for Tuesday, March 27 from 6:00-8:00 pm in the Library at Pleasant Valley High School. The purpose of the Open House is to discuss and answer resident’s questions regarding the planned reconstruction of Belmont road from Pleasant Valley High School to Valley Drive. The project is being funded and administered jointly by the Cities of Bettendorf and Riverdale. Due to the large number of fallen tree branches from the ice storm, the City of Riverdale has arranged a tree branch pick up on Saturday, March 24th. Please have the branches in lengths of 3ft. or less and at the curb by 7:00 am. Normal yard waste pick up will begin April 2nd.
