Roll Call: Present: Franklin, Ulrich, Stickler, Grindle and Halsey Absent: None Also present: Jack & Shirlene Hoots, Jim Beran, John Robinson, Floyd Bruns, Donna Hunt, Angela Reier (attorney), Bonita Grindle, Ann Shoultz, Marilyn Seibel, Archie Smith, Mike Steen, Althena and Perry Smith, Linda and Dale Hupp, Harry Pelton, Jim Mahler arrived at 7:34 Agenda: A motion to approve the agenda with Public Communications moved to follow Warrants was made by Ulrich and seconded by Franklin. Mike Steen stated the two stop signs on Kensington have been an issue for a long time. Mr. Steen told the council he feels getting on to State Street is a bigger safety problem than the stop signs on Kensington. Mr. Steen told the council he thinks the stop signs are unfounded and uncalled for. Althena Smith stated she is not in favor of the stop signs. OLD BUSINESS: A motion was made by Stickler and seconded by Ulrich to table the issue of the old fire truck until a future meeting. Roll call vote: all ayes, motion carried Mayor Wren informed the council that 25 of the 35 stop sign surveys were returned to City Hall. The council reviewed the comments from the returned surveys. Angela Reier (City Attorney) informed the council that because the City of Riverdale has already installed the stop signs on Kensington Street and Sycamore, the City could be held liable if they are now removed. The council discussed actions to take that would minimize liability. After lengthy discussion, a motion was made by Halsey and seconded by Stickler to have the stop signs removed from Kensington and Sycamore Lane after the installation of a fence next to Haven’s Acres Park, and new informational sign(s) are installed, and to also review and amend any necessary Ordinances. Roll call vote: all ayes, motion carried A motion was made by Franklin and seconded by Halsey to allow Ament to commence the bidding process for a contractor for the sewer repair project on Bellingham Road. Roll call vote: all ayes, motion carried. Franklin would like an additional estimate for cutting and repairing Bellingham Road to be discussed at the next council meeting, and would like to make sure the contractor is aware that traffic needs to be maintained on Bellingham throughout the project. Mayor Wren informed the council that the City Clerk has received a request for the names of the individuals interested in the Assistant City Clerk position. Mayor Wren read Resolution #2007-04 a resolution determining that applications and names of applicants for Assistant City Clerk will be discouraged if available for general public examination. Angela Reier (City Attorney) informed the Council that the Council may declare the personally identifiable information regarding job applicants as confidential, unless otherwise elected by the applicant, if the City Council believes that the applicants would be discouraged from seeking the position if their application is open to the public. Ms. Reier also stated that because the applicants were not given the choice on the City’s application to check whether or not they consented to the public disclosure of their job application, the City cannot definitively state that their applications and names are confidential and recommends Riverdale proceed immediately by filing an action in Scott County for a declaratory judgment. This will allow a judge to decide definitively whether or not the names and applications are confidential under Iowa open records law. After some discussion a motion was made by Stickler and seconded by Franklin to pass Resolution # 2007-04 which states: Resolution determining that applications and names of applicants for Assistant City Clerk will be discouraged if available for general public examination. Whereas, the City Council has accepted applications for the position of Assistant City Clerk for the City of Riverdale, Iowa; and Whereas, the City Council has been advised and does believe that applicants will be discouraged from the pursuing the position of Assistant City Clerk if their applications are made public on account of potential conflicts with present employer or otherwise; and Whereas, the City Council is advised and does believe that, pursuant to Iowa Code Section 22.7 the Council may find that otherwise qualified applicants would be discouraged from pursuing the position of Assistant City Clerk if their applications were available for general public examination. NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF RIVERDALE, IOWA, that it hereby determined that otherwise qualified applicants for the position of Assistant City Clerk for the City of Riverdale will be discouraged from pursuing the position of Assistant City Clerk if their application is available for general public examination. BE IT FURTHER RESOLVED that the applications and any documents created from the applications which contain the names or other personally identifiable information regarding the applicants for Assistant City Clerk be treated as “confidential” under Iowa Code Section 22.7, unless public disclosure is authorized by the applicant or a subsequent determination that it is not confidential under Iowa Code Section 22.7. Roll call vote: Franklin-yes, Ulrich-yes, Stickler-yes, Grindle-yes, Halsey-yes, all ayes, motion carried. A motion was made by Franklin and seconded by Halsey to ask Angela Reier (City Attorney) to go before the court and ask the judge about confidentiality and to file a declaratory judgment for the open records request. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Ulrich to replace a flowering pear tree on Manor Drive entrance, three flowering crab and one red bud tree at Bicentennial Park and a load of mulch and trees to be professionally installed for a cost not to exceed $1,500.00. Roll call vote: all ayes, motion carried. A motion was made by Grindle and seconded by Halsey to accept the bid from Tri City Blacktop, Inc. for the amount of $6,215.00 to remove and replace six areas of the Fire Station concrete lot. Roll call vote: all ayes, motion carried. The council discussed a future project for drain tile along the Fire Station concrete lot. The council discussed picnic tables for the parks and City Hall. A motion was made by Ulrich and seconded by Grindle to table this issue until the next council meeting to gather more information. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Ulrich to table the issue of a bus shelter until the next council meeting. Roll call vote: all ayes, motion carried. NEW BUSINESS: A motion was made by Grindle and seconded by Franklin to approve the bid from Tri City Blacktop, Inc. for the amount of $825.00 to reset a manhole repair on Fenno Drive. Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: Grindle informed the council that he has spoken with Deputy Ruckoldt about illegal parking on Kensington. Deputy Ruckoldt will increase patrol around that area. Grindle reported trouble with getting yard waste picked up. The City Clerk will put rules for yard waste in the May newsletter. Franklin reported to the council about a Belmont Road Project meeting that he attended. Franklin told the council that John Channon and Jeff Struve are also representative for this project. Franklin informed the council that the issue of a sidewalk is being discussed along Belmont Road, Franklin feels this should be on the Bettendorf side since the City of Riverdale could not keep it clean. Franklin told the council that there has not been any engineering done, but they have done some survey work and traffic counts. Ulrich would like Scott Carlson to come to a future council meeting to discuss the continual work on the removal of unwanted vegetation. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Grindle reported Acme Sign will work on the flag pole at Kensington. Grindle and Halsey repaired the community room door. Floyd Bruns informed the council that operation prom will be held at PV high school on May 2nd. There will be a simulated car crash and some explosions and helicopter landings in case the city would get a call. A representative from RK Dixon will be at the May 15th council meeting to discuss their document management system proposal. A motion was made by Grindle and seconded by Halsey to give the council support for the Proclamation for Iowa School Board Recognition Week 2007 the week of May 13-19. Roll call vote: all ayes, motion carried. Mayor Wren informed the council she has contacted Bettendorf about the pot holes on Valley Drive that are need of repair. Ordinance No. 07-168 states Section 1. Appointment. The Mayor may appoint, subject to Council approval, an Assistant City Clerk to serve at the discretion of the Mayor. Section 2. Compensation. If appointed, the Assistant City Clerk is paid such compensation as specified by resolution of the Council. Section 3. Duties of the Assistant City Clerk. The duties of the Assistant City Clerk are as follows: Learn and implement the processes and policies of the City of Riverdale. Assist the City Clerk in management of documents and management of City business. Be present during vacation periods of the City Clerk. Assist the City Clerk in the performance of the duties of the City Clerk. Perform such other duties as designated by the Mayor and/or City Clerk from time to time. A motion was made by Stickler and seconded by Ulrich to accept the first reading of Ordinance No. 07-168. Roll call vote: all ayes. The second reading of Ordinance No. 07-168 will be at the June 5, 2007 council meeting. Mary Frances Blevins was introduced to the council by Mayor Wren. After some discussion a motion was made by Ulrich and seconded by Franklin to accept Mary Frances Blevins application for the position of Assistant City Clerk. Roll call vote: all ayes, motion carried. After some discussion a motion was made by Franklin and seconded by Ulrich to accept Resolution No. 2007-05 which states: A resolution establishing salary for the position of Assistant City Clerk. Be it resolved by the Council of the City of Riverdale, Iowa: That the amount of salary to be paid to the city employee holding the position of Assistant City Clerk is fourteen dollars per hour and is effective May 16, 2007. Roll call vote: Franklin-yes, Ulrich-yes, Stickler-yes, Grindle-yes, all ayes, motion carried. Because Dr. Nancy Kothenbeutel from EICCD was unable to attend the council meeting, a motion was made by Ulrich and seconded by Franklin to table the appearance of Dr. Kothenbeutel. Roll call vote: all ayes, motion carried. Mayor Wren stated a public hearing would be established for the public to have an opportunity to discuss the disposition of the old fire truck. Representatives from the company RK Dixon gave a presentation of a document management system that they have proposed for the City of Riverdale. A motion was made by Ulrich and seconded by Franklin to table the road repair portion of the sewer repair project on Bellingham Road until further information has been received. Roll call vote: all ayes, motion carried. After some discussion a motion was made by Franklin and seconded by Ulrich to request that Angela Reier (City Attorney) research redaction, retrieval and supervision fees for records requests and design a clear policy for the City of Riverdale. Roll call vote: all ayes, motion carried. Mayor Wren stated the picnic tables from Scott Community College were no longer available. A motion was made by Ulrich and seconded by Franklin to purchase two handicap accessible picnic tables in beige (one for Haven’s Acres Park and one for Bicentennial Park) and three regular picnic tables in beige (one for City Hall, one for end of the bike path and one for Bicentennial Park) not to exceed $3,500.00 plus shipping. Roll call vote: all ayes, motion carried. A motion was made by Stickler and seconded by Grindle to table the issue of a bus shelter until the first council meeting in July. Roll call vote: all ayes, motion carried. NEW BUSINESS: The purchase of two barricades was discussed by the council. Chief Bruns stated the City has two barricades and he would try and locate them. A motion was made by Franklin and seconded by Stickler to table the issue of the barricades until it is determined if the City has some. Roll call vote: all ayes, motion carried. A motion was made by Ulrich and seconded by Stickler to accept the fee increase from Bi-State Regional Commission for the total amount of $1028 for 2008. Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: The April Financial report was discussed. A motion to approve the April 2007 Financial report was made by Franklin and seconded by Ulrich. Roll call vote: all ayes, motion carried. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Grindle reported the flag pole has been fixed at bike path. Stickler reported the City should be receiving new trees for Bicentennial Park and the entrance on Manor and the trees will be planted at the end of June. Ulrich will contact Creative Deck and Fence for a quote on the section of fence needed at Haven’s Acres Park. Grindle told the council that Steve Wilson would like to bid on the new fence at Haven’s Acres Park. Stickler reported some damage to a fence at Bicentennial Park. Franklin asked for comments from the council regarding the document management system proposed from RK Dixon. Mayor Wren stated that once the council hears proposals from the second company if would be easier to judge. Mayor Wren informed the council that Ament will conduct a Public Information Meeting on Wednesday, May 23, 2007 from 5:00-7:00 p.m. in the Belmont Building Student Life Center, Room 2300 on the Scott Community Campus regarding the SCC development projects. The City Clerk informed the council that candidate packets are now available at City Hall. PUBLIC communications: Marie Randol asked about the amount of the quote from RK Dixon. Candidate packets are available in the clerk’s office for the upcoming November election. Up for re-election will be the Mayor’s seat (2-year term) and 3 council seats (4-year terms). The first day nomination papers can be filed with the city clerk is Monday, August 27th. The last day to file nomination papers is Thursday, September 20th; please have papers to city clerk by 3:00 p.m. Yard waste will be picked up weekly from the first week in April thru the last week in November. Yard waste includes, grass clippings, leaves, tree branches and shrubs. Yard waste must be placed in Kraft paper bags or loose in garbage cans. Brush and branches three (3) inches in diameter or less must be cut into lengths not greater than four (4) feet and bundled and tied. No single unit can weigh more than fifty (50) pounds.
