MEDINA CITY COUNCIL MEETING MINUTES OF AUGUST 15, 1995
The City Council of Medina, Minnesota met in regular session on August 15, 1995 at
7:30 p.m. in the City Hall Council Chambers. Mayor Anne Theis presided.
Members Present: James Johnson, Philip Zietlow, and Mayor Theis.
Members Absent: John Ferris and Ann Thies.
Also Present: Police Chief Rick Rabenort, Public Works Director Jim Dillman, City
Engineer Shawn Gustafson, Zoning Administrator Loren Kohnen, City Attorney Ron
Batty, and Clerk -Treasurer Jeff Karlson.
1. Adoption of the Agenda

4. Public Hearing -- EAW for the Hennepin County Public Works Facility
Mayor Theis opened the public hearing at 7:38 p.m. to hear comments on the
Environmental Assessment Worksheet (EAW) for the proposed Hennepin County
Public Works Facility.
Shawn Gustafson said the 30 day comment period for the EAW had not expired and
any comments a this public hearing would be added to the comments already received
by Hennepin Co nty. Gustafson pointed out that the EAW included the physical and

Hennepin County Public Works Director Vern Genzlinger pointed out that the state
legislature had mandated the installation of an 800 megahertz radio emergency
communication system in the county which included 14 radio towers on different sites
throughout Hennepin County.
Anne Theis said there was no concrete information on the tower itself. She said the
City should obtain more information on the 400 foot tower by the time the council
discusses the PUD at their next meeting on September 5, 1995.
Johnson asked Gustafson if the county had responded to the comments and
recommendations he set forth in his July 3, 1995 letter.
Gustafson said his comments in the letter were more generic than specific. He said
before the council adopted its findings of fact after the 30 day comment period, the
county should have responded to his specific comments in regards to engineering
matters.

5. Thomas & Vickey Debrowski -- Final Plat Approval
MOVED BY JOHNSON, SECONDED BY MAYOR THEIS, TO AUTHORIZE STAFF TO
PREPARE A RESOLUTION GRANTING FINAL PLAT APPROVAL TO THOMAS AND
VICKEY DEBROWSKI FOR A LOT COMBINATION. MOTION PASSED
UNANIMOUSLY.
6. Straight Line Auto Body -- Release of Security Deposit
Shawn Gustafson said Bonestroo reviewed the work completed by Straight Line Auto
Body at 740 Tower Drive. Gustafson said all the work had been completed and he
recommended that the council authorize a complete release of the security deposit. He
said prior to releasing the deposit, the developer should submit a letter from the
contractor stating that the driveway, parking lot, sewer and water lines were
constructed in accordance with city standards.
MOVED BY ZIETLOW, SECONDED BY MAYOR THEIS, TO RELEASE THE
SECURITY DEPOSIT TO STRAIGHT LINE AUTO BODY AFTER THE CITY HAS
RECEIVED A LETTER FROM THEIR CONTRACTOR STATING THAT THE
IMPROVEMENTS WERE CONSTRUCTED IN ACCORDANCE WITH CITY
STANDARDS. MOTION PASSED UNANIMOUSLY.
7. Foxberry Farms -- Lundgren Trail
Jim Dillman said one of the conditions of the PUD for Foxberry Farms was the
dedication of trail easements to the City adjacent to the County Road 116 right-of-way.
Dillman said Lundgren Bros. Construction was ready to grade the trail. He asked the

Council to authorize a $3,000 expenditure from the Park Fund to cover the trail with
gravel base. Dillman said this would ensure that the trail was established before more
development occurred.
MOVED BY JOHNSON, SECONDED BY ZIETLOW, TO APPROVE A $3,000
EXPENDITURE FROM THE PARK FUND TO COVER THE COST OF A GRAVEL
BASE FOR A TRAIL LOCATED IN THE FOXBERRY FARMS ADDITION. MOTION
PASSED UNANIMOUSLY.
8. Reduction of Hunting Fees
Mayor Theis said the City had been getting complaints from people that the hunting fee
charged by the City was too high. The current fee was $5 for Medina residents and
$15 for non-residents.
Rick Rabenort said most of the discharge permits were issued to non-residents. He
said the number of permits issued each year averaged out to around 400.
MOVED BY THEIS, SECONDED BY ZIETLOW, TO REDUCE THE HUNTING TO $3
FOR MEDINA RESIDENTS AND $10 FOR NON-RESIDENTS. MOTION PASSED
UNANIMOUSLY.
9. Randy Mayer -- Conditional Use Permit and Final Plat Approval
Shawn Gustafson said he had an opportunity to review the revised plat for Mayer
Mobile and found the plat to be acceptable. Gustafson said the City received a letter
from the Minnesota Department of Transportation with the following comments:
• A Mn/DOT drainage permit would be required for the proposed development.
• Because Mayer Mobile's driveway to TH 55 was in close proximity to three other
private driveways and to County Road 116, Mn/DOT preferred to see the four
private entrances be consolidated at a single access point.
• Any use of or work within Mn/DOT right-of-way would require an approved permit.
Gustafson said he still had not received all the information he needed such as soil
borings.
Mayor Theis asked if consolidating the four private driveways was feasible.
Randy Mayer said no, a private access should be provided instead of a shared
driveway because there was a median which already controlled traffic.
John Paulson, project manager for Randy Mayer, said he had met with Ruth Ann
Sobnosky, a transportation planner for Mn/DOT. Paulson said her main concern was
crossover traffic. Paulson said Mayer's driveway was right in, right out only.

Paulson said runoff calculations were provided to MnDOT and met the approval of the
Elm Creek Watershed District.
Jim Johnson asked who had oversight over contaminated soil.
Mayer said he is always looking for contamination and if some is found, he must report
it to the Minnesota Pollution Control Agency within 24 hours.
Ron Batty said he was concerned about the adequacy of the two resolutions being
considered. Batty said he had included the conditions established by the Planning
Commission, but Gustafson's concerns had not been added. Batty recommended that
the Council approve a conditional use permit for Mayer with the following conditions
added to the resolution:
(1) Any plans which are revised after the date of this resolution must be submitted to
the city for review by the staff.
(2) Soil boring and pavement design information must be submitted to the city for
approval by the city engineer.
(3) The drainage plan must be revised to show the outlet control structure as a
free -flow skimmer.
(4) The applicant must execute a development agreement with the city and post
security in the amount of $139,743 to ensure completion of the site improvements.

95-34, "RESOLUTION GRANTING CONDITIONAL USE PERMIT TO RANDALL
MAYER," SUBJECT TO THE CHANGES ABOVE; AND TO AUTHORIZE THE MAYOR
AND CLERK -TREASURER TO SIGN THE AMENDED RESOLUTION.

10. Discussion of M & P Utilities Driveway Access
Phil Zietlow said he received a complaint that M & P Utilities trucks were using a field
road for access onto Highway 55 without a driveway permit from the state.
Loren Kohnen said he could ask M & P to come in and apply for a conditional use
permit; however, the company would have to build a nine ton standard road to meet the
requirements.
Zietlow said his main concern was safety.

Kohnen suggested that he ask M & P to meet with him to discuss M & P's plans for the
future as far as their property was concerned.
11. Update on the MCWD Long Lake Cleanup Project
Phil Zietlow said he and Steve McComas of Bonestroo would be meeting with Thomas
LaBounty of the Minnehaha Creek Watershed District to propose an inexpensive
solution to remove phosphorus. Zietlow said he would be proposing that this
inexpensive solution be done on a three year trial basis.
