HomeMy Public PortalAboutOrd. 1363ORDINANCE NO. 1353 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING CHAPTER 25, THE OFFICIAL ZONING ORDINANCE BY ADDING SECTION 25.32.1.5 COMMUNITY DEVELOPMENT PLANS. The City Council of the City of Lynwood does hereby find, resolve and determine as follows: Section 1. Chapter 25, Section 25-32 of the Lynwood Municipal Code is hereby amended bw adding Section 25-32.1.5 to the Lynwood Zoning Ordinance. The proposed amendment shall read as follows: 25-32.1.5 Commercial Development Plans Intent. These regulations are designed to ..permit the flexibility that will encourage more creative design, placement of buildings, improvement of vehicular circulation, off-street parking facilities utilization of the site as characterized by special or unusual features of geography, topography, size, shape and to mitigate all potentially incompatible activities. Principle uses are therefore, restricted to uses which conform to the character of the district. criteria for approval. i. No commercial, industrial or residential construction in the City's Redevelopment Area, shall occur until the development proposal has been reviewed by the Project Review Board for conceptual approval and by the City's Planning Commission for conditional use aermit processing. The Protect Review Board shall also review proposals from a land use perspective and may deny a proposal in order to insure the protection o! the character and area o! each district. 2. Th• Project Review Board shall resvlew the development proposal as it relates to architectural design, materials used for construction as wall as commercial and manufacturing development themes. 3. A conditional use permit for the development proposal must be approved by the City Planning Commission. 4. The development proposal must b® in conformance with the General Plan and Zoning Coda. 5. The development proposal must be adequate in size and shape to accommodate fences, walls, parking, loading areas, landscaping, open spaces and other facilities necessary to make the proposal compatible with the abutting land uses. The development proposal must not have adverse or detrimental effects on the surrounding or abutting properties. Should the proposed development show an impact on existing public facilities, ie. water, sewer, sidewalks, streets, flood control lines and gutters, etc., the applicant shall be required to deposit with or pay the city the amount necessary to provide the required public facilities to serve the development. 8. Procedure for submittal and completeness of the application shall be consistent with Section 25-25 of the City's Zoning Ordinance. Section 2. SEVERABILITY. It any section, subsection subdivision, clause, phrase, or portion o! this ordinance, or the application thereof, to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or it's application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective oP the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions, or the application thereo! to any person or place, be declared invalid or unconstitutional. DATED this 7th day of August 19 91 ~`' ¢~ ity er City of Lynwood RESOLUTION NO. 2387 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF LYNWOOD RECOMMENDING THAT THE CITY COUNCIL NOT ADOPT THE PROPOSED ORDINANCE AMENDMENT FOR COMMERCIAL DEVELOPMENT PLANS. WHEREAS, the Planning Commission of the City of Lynwood, did, pursuant to law, conduct a public hearing on a proposed amendment to the Lynwood Zoning Ordinance with respect to the above subject; and WHEREAS, the Planning Commission of the City of Lynwood considered all pertinent testimony offered at the public hearing; and WHEREAS, the Community Development Director has faund no substantial environmental impact that will result from the proposed ordinance amendment and a Nogative Declaration has been Piled in the Community Development Department and is on file. at the office of the City Clerk, Section 1. The Planning Commission hereby finds and determines as follows: A. The proposed ordinance amendment will not be consistent with the objectives and development policies of the City of Lynwood. B. The proposed ordinance amendment puts additional strain on staff. C. That the City Council and City Planning Commission should discuss the matter at the proposed retreat with the City Council. Section 2. The Planning Commission of the City of Lynwood,' based upon the aforementioned findings and determinations, hereby recommends that the City Cou.^.cil .^.ot adopt t::e gropose3 amendment.
