Roll Call: Present: Channon, Littrel, Hupp, Halsey Absent: Franklin Others in attendance were Attorney Angela Reier, Mary Hanson, Mary Frances Blevins, Bill Gould, Ann Shoultz, Terri Stickler, Richard Wells, Floyd Bruns, Judy Hiles, Charles Harrington, and Tully Heath from Ament. Agenda: Littrel asked to New Business Item Duck Creek Water near Havens Acres Park to the beginning of new business so Tully Heath from Ament didn’t have to stay for the entire meeting. Channon wanted to make a correction. It was stated that garbage at Havens Acres had not been picked up and it should have read yard waste had not been picked up. There were 12 committee members present. The budget for the event was discussed. The idea is to have all activities take place at Bicentennial Park because Volunteer Park will just be completed and all the landscaping and grass will be new. There was discussion of the Grand Marshall for the parade as well as kid’s games and activities that are being planned. Sub Committees were organized. The next meeting for the 4th of July Committee will be May 14th at 7:00 p.m. at City Hall. UNFINISHED BUSINESS: Tully Heath from Ament gave an update on the progress at Volunteer Square Park. He stated that things are going well and on schedule. Mr. Heath reviewed with council the Engineer’s (Ament) Opinion of Anticipated Construction Cost for the Fenno Road and Fenno Drive project. The plans submitted showed the proposed areas of scarification, proposed resurfacing, and adjustment of manholes and fixtures to grade. Mr. Heath intends to add alternates for things that may need to be done or changed during the project. He will have a better idea what those alternates might be at the next meeting. The curbs and gutters are in good shape and so can be used for reference and not need a survey. A motion was made by Huff to approve the agreement with Ament, seconded by Halsey. Roll call vote: all ayes, motion carried. A motion was made by Huff to set a date for a Public Hearing concerning the Fenno Road and Fenno Drive project for May 19, 2009 at 7:00 p.m. Seconded by Littrel. Roll call vote: all ayes, motion carried. NEW BUSINESS: City Clerk Paula McIntosh read Resolution 2009-10. Resolution 2009-10 A Resolution Setting A Date For A Public Hearing To Amend the Riverdale 2008/2009 Annual Budget. BE IT RESOLVED by the City Council of the City of Riverdale, Iowa as follows: That a public hearing be set for May 19, 2009 at 6:30 p.m. at Riverdale City Hall, 110 Manor Drive, Riverdale, Iowa, to consider the following: To amend the current fiscal year 2008/2009 Annual Budget, as provided in the attached Exhibit A. PASSED AND APPOVED THIS May 5, 2009 by the following vote: Channon made a motion to accept resolution 2009-10 as read, seconded by Halsey. Roll call vote: all ayes, motion carried. There was discussion of the erosion problems in the Duck Creek Waterway at Havens Acres Park. Tully Heath from Ament looked the area over before the council meeting. Mayor Grindle had spoken with the Corps of Engineers to see if they had some suggestions on how to alleviate the problem. Halsey asked if the Corps of Engineers would help any way. Mayor Grindle responded no, but they would make sure it was done properly. Tully suggested that he may ask contractors to dump broken up concrete in that area to stop the erosion. Tully will also check with the DNR to see if they would be willing to help in any way. The DNR stated that they would work with Ament to solve the problem. Ament will try and find out why that area is eroding. Halsey asked about a type of “netting” than can be used. Tully stated that the netting was very expensive. Littrel asked if it was built up in that area would it make it worse downstream. Tully stated that it would not. Hupp had information concerning some water problems in the area behind some homes on Manor Drive. There are holes in the easement area because of either tiles or pipe being broke, misaligned, or plugged. Ms. Hupp had some estimates from Environmental Management Services. They recommended that the line be jetted to clean out the debris and then put a TV camera in the line (Peterson Plumbing) to find out what the problem is. Estimated cost for that would be $1,080.00. Peterson Plumbing said if there was a broken or misaligned tile depending on the depth the repair would be $1,500.00 to $2,000.00 per broken tile. There was discussion as to whether this was a City problem or the homeowner’s problem. It was stated that this was a drain tile put there by the homeowners and not a storm sewer put in by the City. Hupp mentioned that this pipe was on the map. The question as to how it got on the map if it is nothing more than a drain tile was discussed. Hupp asked if the City would be responsible if someone were to get hurt in this easement area because of the holes. Is it just a utility easement? Hupp asked if we could just have Mahler repair the tile for now. Attorney Reier suggested we table it until the next council meeting and we can find out more information about what kind of pipe and who is responsible for the repair. A motion was made by Hupp to table the issue until the May 19, 2009 meeting, seconded by Halsey. Roll call vote: all ayes, motion carried. The March 30, 2009 Financial Report was presented. Hupp made a motion to approve, seconded by Littrel. Roll call vote: all ayes, motion carried. Fire Chief Floyd Bruns gave the Riverdale Fire Department Report for March 17, 2009 through April 20, 2009. Hupp made a motion to approve, seconded by Channon. Roll call vote: all ayes, motion carried. A motion was made by Channon to send the letter of intent for the Urban Deer Management Hunt for the 2009/2010 season. Seconded by Halsey. Roll call vote: all ayes, motion carried. Channon stated that the gate at Bicentennial Park needs repairs. She thought it needed and eye and some hooks. She said a portable welder would come in to make the repairs. Hupp made a motion to have the gate repairs done not to exceed $90.00. seconded by Halsey. Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: Hupp had some information from Mid American Energy about purchasing trees if you are a Mid American Energy customer. The trees could be bought for $25.00 each and they are good sized trees. She thought this would be a good idea for a start of trees for Volunteer Square Park. All the information will be put in the newsletter. Halsey mentioned that they need to baby secured type swings at the Havens Acres Park. Halsey mentioned that the railroad crossings need repair. Attorney Reier will call the DOT and see what can be done. COMMUNICATIONS FROM THE COUNCIL AND OTHER OFFICIAL: Attorney Reier stated that we had received the order on the Budget Protest. It was found that Riverdale proved all the expenses they showed for the budget year 09/10 was necessary including the increase in the Fire Department Fund. However the State felt that Riverdale has too much money in the General Fund and should spend that down instead of raising property taxes. That was the order of the State Appeals Board. Riverdale does have the right to appeal that decision. Halsey asked if the money for Belmont Road was coming out of the General Fund. It comes out of the Capital Improvement Fund. With many large costly projects coming up it won’t take long to spend down the General Fund or the Capital Improvement Fund. Halsey stated when our funds get spent down and we have no reserve we then will have no choice than to pay much higher taxes. Mostly likely at the rate the Bettendorf pays. Mary Hanson said that the State has the philosophy to bond for big projects. Riverdale’s philosophy has always been to save money and pay for our projects and not have to bond. Riverdale has always provided services for residents at no charge. Things like garbage and recycling pickup. Also events like the 4th of July Celebration and the Egg Hunt. Once the General Fund is spent down there will no longer be free services and Celebrations. When more road repairs become necessary or other big projects Riverdale will have to borrow money and pay interest. The decision to appeal will be on the May 19, 2009 agenda. Judy Hiles asked if the merry-go-round at Bicentennial Park needed bark around it. Halsey asked if the porta-pottie was at the park yet. Dunk Tank and Bungee Jump already ordered for this year and half of the cost is already paid. Discussed using Bicentennial Park for all events this year as the Volunteer Part will just be completed and landscaping and grass will be new. If Bicentennial is only used it will allow the new grass and plants in Volunteer Park to become well established. Jim Beran questioned whether power was adequate for this event. This will be discussed with Floyd Bruns. Decided not to have a band this year. The 4th is on a weekend and lots of families will be here for their own gatherings and the cost for 1-½ hours of live music is becoming a little pricey. Grand Marshall for the parade was discussed. Names suggested were Delores Burris or Stan Hill. Shirlene will contact Delores to see if she is interested before other residents are contacted. Need to be thinking of alternates for the position. Decided to go again with pony rides and the balloon man. Will contact them to see if they are available. Fire Department will be approached to see what they will participate in – i.e., afternoon water spray for the children, parade, assist with medical issues for the 5K run, etc. Sub Committees were organized: Parade – Jim Beran 5K run – Eric Syverud He also volunteered to get the golf carts for the day and order necessary barricades. Bob Picchiotti asked whether the race could be made larger and use some of the money that would have been used for the band used for advertising for the race. This will be up to Eric. Children Games – Bonnie Grindle Violet Grindle will order children’s prizes and glow sticks. Basketball Throw - Robert Picchiotti Ice Cream Social – Linda Hupp Children’s Tractor Pull – Paula McIntosh has stated that her husband has run this event at other locations and has volunteered to have it at the 4th of July. Committee felt this was a great addition to children’s games. Popcorn and Soda – Ann Shoultz and Teri Stickler Organize – Judy Hiles and Sonya Paddock Clean up – Everyone Glow sticks will be handed out to all children during the evening. They enjoy having them plus it makes them more visible in the dark. Rosie Parry will be responsible for a schedule of volunteers for the dunk tank, bungee jump. It was decided that signage is needed that these games will not operate unless an adult is present to supervise. Need some form of signage to block off the event until it is operational. Children can decorate their own bikes – decorations will not be provided by the city. This worked last year and there were a bigger variety of decorations shown. No helium balloons will be provided by the city this year. Packets of information for various events will be given to each chairperson before the next meeting. We need to be thinking of how to set up the park and who to have to be judges for the parade. Dick Hanson volunteered to inventory items at City Hall left over from last year’s event. OFFICIAL MINUTES Mayor Grindle opened the Public Hearing concerning the 08/09 Amended Budget at 6:30 p.m. on May 19, 2009. Franklin, Channon, Hupp, Littrel, and Halsey present. City Clerk Paula McIntosh explained that the amendment consisted of amending the General Fund by $63,000.00. This was due to attorney fees and Tort Liability. After hearing no public comments Franklin made a motion to close the Public Hearing with the Amendment of the 08/09 Budget at 6:40 p.m. Seconded by Channon. Roll call vote: all ayes, motion carried. Mayor Grindle opened the Public Hearing concerning the Proposed Plans, Specifications, and Costs for Fenno Hill Public Improvement Project. Franklin, Channon, Hupp, Littrel, and Halsey present. Chad Macke from Ament prepared a cost estimate for the Fenno Road Project. He stated that 4 companies have picked up packets. The bid opening will be May 26, 2009 at 4:00 p.m. Littrel wanted to make sure that emergency vehicles would be able to access that area during the construction. Mr. Macke said they would. Mr. Macke said that some areas will be done at full depth because the sub base is not good. There will be a new rock base and basically a new road in those areas. Franklin made a motion to close the Public Hearing at 7:08 p.m.concerning the Fenno Road Reconstruction. Seconded by Channon. Roll call vote: all ayes, motion carried. The statement was made by Hupp. Hupp made a correction in Committee Reports. It was written about possibly purchasing some trees from Mid American Energy for Volunteer Square Park. It was supposed to be for Bicentennial Park. After the corrections Channon made a motion to approve the minutes with said corrections, seconded by Littrel. Roll call vote: Franklin – abstain, Channon – aye, Hupp – aye, Littrel – aye, Halsey – aye. Motion carried. Warrants: Hupp asked Attorney Reier about some of the attorney charges. This committee met on May 14, 2009 and next meeting will be June 4th at 7:00 p.m. at City Hall. The Neely’s have been selected to be the Grand Marshall’s of the parade. There have been a few changes. The 5K run will begin at 9:00 a.m. parade line up will be at 12:30 with parade at 1:00 p.m. There will be a band in the evening. The children’s games will be all afternoon with the children’s water fights from 3:30 until 5:00 p.m. Judy stated that the sub committees were doing great. Some alternate areas for parking and handicapped parking were discussed. Halsey asked if everything was going to be at Bicentennial Park. The band will be playing in the gazebo at Volunteer Square Park, but everything else will be at Bicentennial Park. Dale Hupp wanted to address the problems of the water that is going into the retention pond at Scott Community College. Mayor Grindle said he would get a meeting together with Dr. Coley from Scott Community College and the College Engineers. Susan Littrel saw that park swings was on the agenda under new business and thought we should also have a handicapped swing as well as the infant swings. UNFINISHED BUSINESS: Chad Macke from Ament gave an update on the Volunteer Square Park Project. He said things were going slow. They have run into a lot of water with all the rain and waiting for things to dry up so they can bring in the big equipment and fill dirt. The gazebo is finished and the work is still thought to be complete by the 3rd week of June. Mr. Macke stated that the bid opening for the Fenno Road Project will be at 4:00 p.m. on May 26, 2009. There are 4 companies that have turned in bids. They are Valley Construction from Rock Island, Tri-City Blacktop from Bettendorf, General Asphalt from Moline, and Bob’s Blacktop from Cordova. A motion was made by Littrel to table any decisions until the bids are opened. Seconded by Franklin, roll call vote: all ayes, motion carried. Attorney Reier addressed the water problems affecting homeowners on Manor Dr. Attorney Reier said this has not been an easy issue to deal with. She did find and express agreement from Alcoa to install storm water tiles, but was not able to find an agreement for the properties affected. It doesn’t mean one doesn’t exist; she has not been able to locate it at this time. Jim Beran has also spent a lot of time researching the problem. Mr. Beran feels the problem is that the line is plugged somewhere. Until further research we will not know if the problem is the responsibility of the homeowners or the city. Mayor Grindle asked Mr. Beran if he was the one to add these lines to the city maps. Mr. Beran stated he was. Franklin asked if there was anything in Mr. Beran’s abstract to show the easement. There is not. Mayor Grindle stated we are looking for a resolution to this problem. Channon made a motion to table the Duck Creek Waterway issue until Tully Heath from Ament could attend the council meeting. Seconded by Franklin, roll call vote: all ayes, motion carried. NEW BUSINESS: A motion was made by Hupp to approve the 08/09 Budget Amendment, seconded by Littrel. Roll call vote: all ayes, motion carried. There was discussion of new swings and bi-pod for Bicentennial Park and Havens Acre’s Park. Hupp made a motion to purchase 1 Bi-Pod, 2 handicapped swings, and 2 bucket seats not to exceed $1,400.00. Seconded by Littrel. Roll call vote: all ayes, motion carried. A motion was made by Hupp to place a porta-pottie at Havens Acre’s Park, seconded by Halsey. Roll call vote: all ayes, motion carried. Halsey reported that he would purchase the paint for the merry-go-rounds and other painting that needed to be done at the parks. Halsey will get everything sprayed and will just need volunteers to help with the rest of the painting. Hupp said the wood fences around the garbage cans need to be stained. Some volunteers will meet at 9:00 a.m. on June 6, 2009. All volunteers are welcome. Attorney Reier looked into the Appeal Process in case Riverdale wanted to appeal the State’s decision on our Budget Protest Hearing. She felt that we would be fighting an uphill battle. Franklin stated that we could ask for another panel of reviewers. Franklin made a motion that the City not appeal the State’s decision, seconded by Channon. Roll call vote: all ayes, motion carried. Franklin thought we should publish the Finding of Fact, the Basis For The Decision, and The Order in our monthly newsletter. Franklin made a motion to publish that part, seconded by Halsey. Roll call vote: all ayes, motion carried. COMMUNICATIONS FROM THE COUNCIL AND OTHERS: Franklin asked that all the council members be thinking about what Capital Projects need to be done. He asked that they make a list and give it to him Halsey stated that the grass at Scott Community College needs to be mowed. It has gotten very tall and looks terrible. Mayor Grindle will look into it. Halsey asked if we have heard anything about repairing the railroad crossings. Paula has been in contact with them and they will see about doing some repairs. Mayor Grindle said that we had been approved by Scott Community College for the Fireworks. He is looking forward to the 4th of July and thanked the 4th of July Committee for all their hard work. Grindle, Mayor Attested by Paula McIntosh, City Clerk April 21, 2009 4th of July Committee Meeting Minutes May 14, 2009 at 7:00 PM City Hall Committee Members Present: Rosie Parry Linda Hupp Bonnie Grindle Jim Beran Ann Shoultz Teri Stickler Judy Hiles Everyone is encouraged to keep all receipts for everything they purchase in regard to the holiday celebration and turn in to Judy Hiles if possible, or to City Clerk. A map of the location of the day’s activities was passed out to committee members as well as an inventory list of supplies from past celebrations. Committee Reports: Parade – Jim Beran Shirlene Hoots has found our Grand Marshals for the parade, Bev and Bud Neely. Thank you Shirlene. The banner that was used last year to keep the children in a group and prevent them from riding ahead into other parts of the parade is not to be found. We will look into obtaining another as it was felt that this really did its job in keeping the children safe. We will try to locate two people who will walk with it during the parade. It was suggested that the line up for the parade begin at 12:30 with the parade starting at 1:00 PM. The children will be encouraged to decorate their bikes at home as decorations will not be provided by the city. Sonya Paddock suggested in a conversation with another member of the committee that floats be made by neighborhoods. She stated that she would contact Jim in regard to this. The parade will start at Windsor Drive. Jim will find judges for the parade and will select appropriate prizes. Anyone else who would like to be in the parade is encouraged to participate. A note will be placed in the newsletter to contact Jim. 5K Run – Eric Syverud Not present at the meeting. Will be contacting him to see when the run is to start and if help is needed. Children’s Games – Bonnie Grindle Violet is ordering prizes for the games. They are to be ordered thru City Clerk. Everyone agreed that the map for placement of activities in Bicentennial Park looked okay. We will plan as it is laid out. Rosie Parry would like the Bungee Jump and the Dunk Tank to begin earlier. It was decided that those two games would begin at 1:30 PM with other children’s games to start at 2:00 PM. The Balloon Man has been contracted to begin at 3 until 5:00 PM. The Pony Rides will start and end at those times also. A time for the tractor pull is yet to be established. Basketball Throw – Bob Picchiotti Not present at the meeting. Will be contacting him to see when it is to begin and end and if help is needed. Ice Cream Social – Linda Hupp The Shelter will be used for this event. It was decided that it will be from 3:00 PM until 4:30 PM or until the ice cream has run out. A tent and tables and chairs have been ordered from K&K, which will be delivered at 3 PM on Friday. Ice cream has been ordered at Whitey’s for $127.00 with an additional $80 more or less for supplies. Donations for the Ice Cream Social will be requested from the community such as cookies, cupcakes, brownies or fruit pies, no cream pies are requested because of lack of refrigeration. This will be placed in the newsletter. Children’s Tractor Pull – Judy Hiles Paula, and Mac McIntosh and their son have volunteered to run the game. Joe Kosinski has volunteered to help. There will be four classes that will try to pull the 40-foot course. They are children in the following weight bracket: 0 - 30 lbs. 31 - 40 lbs. 41 - 50 lbs. 51 - 60 lbs. The competition will take approximately 1-½ hours to complete. Trophies will be provided for 1st place in all the classes with rosette ribbons for the 2nd, 3rd, and 4th place winners. A time for the event still needs to be scheduled. Popcorn and Soda – Ann Shoultz and Teri Stickler This will be located at the shelter. Helpers still need to be found. The soda and popcorn machine and supplies need to be stored in someone’s garage, as it will be delivered the day before the event. Jim Beran is looking into obtaining a cart to load all the items and take them to the shelter the morning of the 4th. Rosie Parry has volunteered to store them the evening of the 3rd. Water Spray- Fire Department This will be done at the old basketball court. The Fire Department needs to be contacted to firm up the time. Band – Judy Hiles We are still looking for a band. We have two that are checking with their members to see if they are available for that date. This should be firmed up by next week. They will play from 6:45 until 9:00PM with a 15 minute break after one hour. Approximate cost is $600. The Gazebo in Volunteer Park will be used for this event. Joan Struve had left a message that her son would be willing to do Karaoke with his band. Since we are already pursuing a band, we might try this another year. Judy will contact Joan and let her know and thank her for offering. Other Items discussed: Linda Hupp asked if some of the celebration money could be used to purchase some fan banners to decorate the gazebo and the shelter for the 4th. She has checked at Regalia and found some that are 6’ to 8’ wide and 3’ long at $27 each. Others that are not quite as nice are 5’ by 3’ at $15 each and have imprinted fan folds in them. She feels that 3 for the gazebo and 2 for the shelter would be good. It was felt that she should pursue this. She also felt that another tent should be ordered for shade for individuals during the day since we were having the events in Bicentennial Park and the shade is more limited than at the other park. This was agreeable since we usually order two tents for the day. Judy will be doing this. The porta potty has been delivered but isn’t placed in the correct location. Linda will check and see if this can’t be fixed when they do the monthly cleaning. The rain date for the fireworks is July 5th. A suggestion was made that name tags be worn by committee members with a note placed in the 4th of July flyer that if you have questions, please ask a committee member. Judy will make these. Floyd Bruns was contacted and has said that we have the correct power for the items that will need electricity for the event. The Fire Department also will provide first aide assistance for the 5K run. We need to contact him again to see when they will be filling the dunk tank. Also if they have the trashcans that we usually use and will they are placing them around the area. Per the City Clerk, they order their own candy to throw to the children during the parade. Each committee is responsible to select and purchase prizes for their own events. Just keep the receipts and turn them into Judy for reimbursement. We will try to print an event schedule in both the May and June Riverdale Newsletter. Clean up is to be done by the committee after the events. We will finish the next day what cannot be done that evening. A note needs to be placed in the next newsletter that no parking is requested on Manor Drive or Windsor Drive until after the parade. We need to check and see if Alcoa is okay with us using their parking lot at the Learning Center and Scott Community College will allow us to use their parking lot as well. We will try to set up handicap parking in the gravel drive of Windsor Drive. Rosie will check on this. It was suggested that we have music playing at Bicentennial Park during the afternoon. Violet has a tape. Judy has a player. Jim asked if we wanted to do a “what’s it” or guess items in a jar again. It was agreed that this would be fun. Teri is concerned about foot traffic flow at the park with only one entrance. This will be checked into. The next meeting will be June 4th at 7:00 PM at City Hall.
