OFFICIAL MINUTES Mayor Grindle opened the regular meeting of the Riverdale City Council at 7:00 p.m. on Tuesday, November 3, 2009 Roll Call: Present: Franklin, Channon, Hupp, Littrel, and Halsey, Also present: Attorney Angela Reier, Jim Beran, Dale Hupp, Christine Wren, Lars Wren, Charles Harrington, Teri Stickler, Harry Pelton, Kristin Crawford from MSA, Linda Gilman, Ann Shoultz, Sonya Paddock, and Attorney Mike Motto. Agenda: Franklin made a motion to approve the agenda as written for November 3, 2009, seconded by Littrel. Roll call vote: all ayes, motion carried. Minutes: It was moved by Channon to approve the minutes from the meeting dated 10/20/09 with said corrections, seconded by Littrel. Roll call vote: all ayes, motion carried. Littrel made a motion to approve the minutes from the meeting dated October 22, with correction, seconded by Halsey. Roll call vote: all ayes, motion carried. Ms. Paddock explained about her Support Group for Caregivers. She would like to have her group meet in the community room once a month over the lunch hour. She went on to explain how important it is for those that are caregivers for the elderly. Paula McIntosh apologized for omitting her from the agenda and assured Ms. Paddock that it would be on the November 17th agenda. Harry Pelton stated that he will be out of town when it is time to put up the holiday decorations, but Ralph Parry will see that they will all get put up. Mr. Pelton also stated that some of the decorations need to be replaced. UNFINISHED BUSINESS: A motion was made by Franklin at 7:16 p.m. to enter in to Closed Session Pursuant to Iowa Code Section 21.5(c) to Discuss Matters Presently in Litigation with Counsel, Including City of Riverdale v. Diercks, Picton, & Randol, Equity No. 110918, and the City of Riverdale v. Diercks, Equity No. 111996. Seconded by Littrel. Roll call vote: all ayes motion carried. Council entered in to open session at 7:51 p.m. Franklin made a motion to appeal Judge Tabors ruling, Equity No. 110918, seconded by Littrel. Roll call vote: all ayes, motion carried Kristin Crawford had nothing to report on the Storm Water Detention Pond, but stated there was a meeting with Dr. Coley from Scott Community College and the committee named by Riverdale and MSA on November 13th. Ms. Crawford presented drawings of the proposed Rain Garden on Fenno Road. She gave an overview of different ways to install the Rain Garden with bids from Aunt Rhodies with different options to consider. A motion was made by Hupp to approve the bid from Aunt Rhodies for $5,080.00 seconded by Halsey. Roll call vote: all ayes motion carried. Hupp made a motion to approve the purchase of material for new bows and new holiday decorations not to exceed $250.00, seconded by Halsey. Roll call vote: all ayes, motion carried. Hupp had estimates on installation of a new flag pole. Hupp asked Teri Stickler to speak. Ms. Stickler said: In honor of Wade H. Stickler, husband, Dad, and long time volunteer and resident of Riverdale and; In honor of Donald K. Iversen, neighbor, dear dear friend and long time volunteer and resident of Riverdale. My Mom, Vi Stickler and I Teresa Stickler would like to donate to the town (City) of Riverdale, a lighted flagpole and flag for Volunteer Square Park. This donation includes the cost of the pole, light fixture, flag, and freight. Hupp made a motion to purchase the new flag pole not to exceed $5,500.00, seconded by Halsey. Roll call vote: all ayes, motion carried. Thanks to Teri and Vi Stickler. Hupp reported on moving the tree at Haven’s Acres Park. Ms. Hupp had met with the man that was going to move the tree. He explained that it was a Tulip Tree and should not be moved until spring. Hupp made a motion to table moving the tree until spring, seconded by Halsey. Roll call vote: all ayes motion carried. There was discussion of cutting down a Cottonwood Tree in that same area. Hupp would like to get bids for the cost of removing this tree. NEW BUSINESS: Hupp made a motion to table Ordinance # 09-168 concerning Storm Water Detention Ponds, seconded by Franklin. Roll call vote: all ayes, motion carried. Attorney Reier stated that at the special meeting on October 22, 2009 the Application for Sewer Connection Permit was approved. Littrel made a motion that we accept the Sewer Connection Permit, seconded by Halsey. Roll call vote: all ayes, motion carried. The Riverdale Fire Department Report for September 15th through October 20th, 2009 was presented. Calls were: 4 EMS Calls, 1 Fire, 1 Car Accident, Training: Fuel Terminal Tour, Search and Rescue, Alcoa Tour, and CPR Recertification. The following note from Fire Chief Floyd Bruns wanted to make sure the Council thanked Bob Dominacki for rescuing Lisa Showalter from her home before the Fire Department got there. She was just inside the door, but unable to get out. Mr. Dominacki kicked the door open and was able to rescue her. Hupp thought we should honor Mr. Dominacki with a plaque. Franklin thought we should also put something in the kiosk at Volunteer Square Park. Littrel motioned to approve a plaque as well as a name plate at Volunteer Square Park, seconded by Franklin. Roll call vote: all ayes, motion carried. Hupp moved that Mayor Grindle write a letter of appreciation from Mayor and Council to the Riverdale, Bettendorf, and LeClaire Fire Departments, seconded by Halsey. Roll call vote: all ayes, motion carried. A bid was received from Gabrilson for a new furnace in the amount of $2,680.00. Franklin made a motion to purchase the furnace for Gabrilson for $2,680.00, seconded by Channon. Roll call vote: all ayes, motion carried. A motion was made by Franklin to set the Public Hearing Date as December 1, 2009 at 6:30 p.m. concerning the 2nd phase of the Belmont Road Reconstruction Project. Seconded by Littrel, roll call vote, all ayes, motion carried. Hupp made a motion to authorize the Mayor to enter into the 28E Agreement with Bettendorf concerning Snow Removal on Belmont Road for a period of two years and Riverdale will reimburse Bettendorf $1,700.00 annually for the snow removal. Seconded by Channon, roll call vote, all ayes, motion carried. COMMUNICATIONS FROM THE COUNCIL AND OTHER CITY OFFICIALS: Franklin mentioned the letter he received from the Board of Adjustments with concerns of updating ordinances concerning outbuildings. Mayor Grindle stated he has been in contact with the Board of Adjustments, Planning and Zoning, and Zoning Inspector. These committees will meet and the issue will be resolved. Franklin stated he had a complaint from a citizen saying that he/she was unaware of the November 3, 2009 election because it had not been mentioned in the minutes and or newsletter. Halsey apologized for his comments at the Community Meeting on October 20th, 2009. He stated that he might have offended some and heard that some citizens felt their ideas could not be heard because Mr. Halsey was commenting. Hupp wanted to thank everyone that voted for the tax referendum. Littrel wanted to thank all that voted. Channon thanks to all that voted and thanks to the Fire Department for all they do. Mayor Grindle thanks to the Fire Department for all their hard work at the fire at Haven’s Acres, thanks to Mr. Dominacki for saving Ms. Showalter. He should feel very proud and all the residents of Riverdale should feel very proud of him. Thanks to Teri Stickler for the donation of the Flag Pole in memory of her Father and Don Iversen. The Mayor, Council, and residents of Riverdale are very proud of Mr. Domanacki for his act of bravery. Mayor Grindle had spoken to Ms. Showalter’s daughter and she is recovering and also wanted to thank Mr. Domanacki. Jim Beran read a letter to the council addressing his concerns about Scott Community College extending their sewer line and connecting to the City sewer line. UNFINISHED BUSINESS: Hupp made a motion to allow Sonya Paddock to use the Community Room one time per month at no charge for a Caregiver’s Support Group. Seconded by Halsey. Roll call vote: all ayes, motion carried. Kristin Crawford from MSA attended the meeting to give an update on the Detention Pond owned by Scott Community College. There was a meeting on Friday, with Dale Hupp, Jack Franklin, Kirk Barkdoll, Paul Loete, Kristin Crawford, and Jeff Grindle in attendance. Ms. Crawford stated that the college does understand the problems with the detention pond and will work to direct the water elsewhere and therefore alleviate the current problems. Ms. Crawford will have a final report on the Detention Pond at the next meeting. A motion was made by Franklin to enter into a Closed Session at 7:17 p.m. Seconded by Littrel. Roll call vote: all ayes, motion carried. Open Session was resumed at 7:50 p.m. Attorney Reier noted that no decisions were made during the Closed Session. NEW BUSINESS: City Clerk Paula McIntosh presented the Annual Report for 2009. A motion was made by Hupp to approve the 2009 Annual Report, seconded by Channon. Roll call vote: all ayes, motion carried. COMMITTEE REPORTS: Littrel talked to Centennial Contractors about the catch basin work on Wisteria Dr. They stated the work would have to be done a little differently than stated on the Contract however the cost would remain the same. COMMUNICATIONS FROM THE COUNCIL AND OTHER OFFICIALS: Franklin reported on the Budget Workshop that he, Mayor Grindle, Cheryl Channon, and Linda Hupp had attended earlier in the day. He felt it was a good workshop and they had received good information on the upcoming budget preparations. Channon reported that John Channon had repaired the signs on Bellingham Road. Everyone thanked John and Cheryl for the work they do. All of John’s work is donated to the City. Hupp wanted to remind everyone that the Holiday Lights will be going up this Saturday November 21, 2009. It will begin at 9:00 a.m. and anyone wanting to help can stop by. Hupp also wanted to thank Teri Stickler and Judy Hiles for helping getting the material around the trees to protect them through the winter. Halsey reported that a vehicle had gone air born through his yard and sheared off the Railroad sign. He wondered if Riverdale or the railroad was responsible for fixing the sign. Littrel stated that he had Holiday Lights and he would be at City Hall Saturday morning to help put lights up. Mayor Grindle wanted to thank those that attended the Budget Workshop. He mentioned the letter that was sent to the Riverdale, LeClaire, and Bettendorf, Fire Departments thanking them for their service fighting the fire at Haven’s Acres on October 31, 2009. He wanted to encourage anyone that can help with lights on Saturday to please be at City Hall at 9:00 a.m. Mayor Grindle again thanked Robert Domanacki for saving the life of his neighbor on October 31, 2009.
