A RESOLUTION AUTHORIZING A TEMPORARY SUSPENSION OF WATER AND SEWER
SERVICE FEES FOR 238 MILL AVENUE
WHEREAS, the owner of 238 Mill (Mary Giammari) contacted town staff in 2011 to discuss
problems they were experiencing with the sewer service line. The Town Board determined that
the line was a private service line despite the uncertain history and unusual alignment that
crosses public right of ways and other private property. Staff worked with the owners to identify
replacement options which are problematic due to the lack of a sewer main adjacent to the
property and the grade challenges associate with the area. The property owners have not
moved forward with replacement due to the expenses associated with the work (approximately
$20,000); and
WHEREAS, the Town Code provides failure to pay service fees may result in suspension of
service and new Plant Investment Fees would be required to reactivate the account. The
property owners have continued to pay service fees despite the lack of sewer and water service
due to the broken sewer service line.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE BOARD OF TRUSTEES OF THE
TOWN OF FRASER, COLORADO THAT:
Due to expense and design challenges associated with replacement of the sewer
service line, the Town Board hereby finds that the assessment of service fees places an
undue hardship on the property and authorizes suspension of water and sewer service
fees until such time as the service line is replaced or the property redeveloped. The
property may not be inhabited, even temporarily, during suspension of service fees. At
such time as service is reactivated, service fees shall be due beginning in that service
period and new Plant Investment Fees will not be assessed (unless the property is
redeveloped resulting in additional SFEs).
