HomeMy Public PortalAbout20150427 - Conservation Commission - Meeting Minutes Hopkinton Conservation Commission 27 April 2015 Page 1 of 3 27 April 2015 Called to Order: 7:30 PM Town Hall, Rooms 215/216 Adjourned: 9:30 PM Members Present: Jeffrey Barnes, Jim Ciriello, Ed Harrow, Craig Nation, Melissa Recos, Kerry Reed, Marcus Waldron, Don MacAdam: Conservation Administrator, Robert Ingram, Conservation Scientist, Anna Rogers: Inspections Administrative Assistant Members Absent: none 7:30 PM Commission Business  The Commission reviewed the following document which had a signature page signed at the 13 April 2015 meeting: - MassDOT, Off Wood Street (U2 15 0) – Order of Conditions (188-1573)  The Commission determined to issue comments in response to the request from the Planning Board for Major Project Site Plan, 77 West Main Street, 0 Lumber Street.  A discussion was held regarding an exemption request from Perkins, Desrochers, 213 Hayden Rowe for the installation of a driveway within the buffer zone. The Commission determined the activity qualified as an exempt activity. Mr. Craig Nation recused himself and left the meeting room at this time. 7:45 PM Nation, Lot 2 Penny Meadow Lane DEP File No. 188-1571 Nation, Lot 3 Penny Meadow Lane DEP File No. 188-1570 Nation, Lot 4 Penny Meadow Lane (215 Ash St) DEP File No. 188-1569 Notices of Intent – continuation Scott Goddard, Goddard Consulting; Attorney Matthew Watsky; Ron & Chris Nation, applicants/owners Mr. Goddard provided an overview of the site plans dated 08 April 2015. A discussion was held regarding proposed site conditions on Lot 2, including no proposed work within the 50 foot buffer zone except for the removal of existing refuse and old tires. A discussion was held regarding the need for the installation of permanent immovable barriers. A discussion was held regarding the need for stormwater best management practices. A discussion was held regarding the potential use of pervious pavement and any potential future maintenance issues. Hopkinton Conservation Commission 27 April 2015 Page 2 of 3 The Commission noted the site has significant wildlife features and concerns with the cumulative impact of the projects under the Bylaw. The Commission noted they believe the proposed stormwater management for the roadway improvements is sufficient but stormwater management of the impervious areas for the work associated with the construction of the single family homes has not been completely demonstrated. A discussion was held regarding the responsibility for the ongoing maintenance of the infiltration trenches. Attorney Michael O’Neil, McGregor & Legere, noted the projects would lead to a loss of function to the buffer zone areas behind the proposed houses, the proposed buffer zone restoration area is not properly detailed, an adequate alternatives analysis has not been submitted, and a sufficient analysis of the stream, specifically the northern portion, has not been performed. Mr. John McAuliffe, 8 Cedar Mill Road, asked about how ongoing maintenance requirements were enforced. A discussion was held regarding ongoing conditions subject to the issuance of any Certificate of Compliance. A discussion was held about any possible impact reductions from seeking relief from the Board of Appeals for front setbacks. The hearings were continued to 11 May 2015. Mr. Craig Nation returned to the Commission at this time. 8:45 PM 194-196 South Street LLC, 194-196 South Street DEP File No. 188-1578 Notice of Intent – continuation David Marquedant, J.D. Marquedant & Associates; Greg Read, applicant/owner; Attorney Doug Resnick A discussion was held regarding the BETA Group memo dated 27 April 2015. The hearing was continued to 11 May 2015. 8:50 PM Commission Business – continuation  A violation discussion was held with Mr. Michael Connearney, applicant/owner and Mr. Scott Goddard, Goddard Consulting, regarding 0 Hayden Rowe (188-1561). Mr. Goddard noted he has been onsite monitoring the project. It was noted that a stockpile of soil was installed beyond the limit of work and adequate erosion and sedimentation controls (ESC) were not in place. The Commission determined that the applicant would remove the stockpile and install adequate ESC. Mr. Goddard noted he would send a report when the work was completed.  A discussion was held with Ms. Lisa DiRienzo regarding the project change request for 189 Saddle Hill Road (RDA 2012-14) for a proposed addition. Mr. Nation made a motion to determine the project change to be insignificant. The motion was seconded by Mr. Waldron and it passed unanimously.  A discussion was held with Ms. Patty Holland, 207 West Main Street, regarding the exemption request to install a fence. The Commission determined the activity qualified as an exempt activity. Hopkinton Conservation Commission 27 April 2015 Page 3 of 3  Discuss status of. A discussion was held regarding trees that were cut down on two Open Space Preservation Commission parcels, U24 10 0, U24 10, without authorization and a small portion of brush cutting that occurred within the Commission’s jurisdiction.  The Commission determined to issue comments in response to the request from the Planning Board for Special Permit Application, Marathon Solar, Off East Main Street.  A discussion was held about the voting procedure for a Conservation Commission (CC) representative serving on Open Space Preservation Commission. A discussion was held about when a CC vote was taken, the representative is responsible for conveying that vote, but they can also offer their own opinion as an individual and not just as the CC representative.  A follow-up to the previous violation discussion for Curatola, 215 Hayden Rowe (188-1522) was held regarding inadequate erosion and sedimentation controls for dewatering activity. It was noted that a haybale corral has been installed as required.  A discussion was held regarding 85 West Main Street (188-1563) and proper dewatering on site.
