HomeMy Public PortalAboutSeptember 2012- RIVERDALE CITY COUNCIL MINUTES Mayor Franklin opened a regular session of the Riverdale City Council at 7:00 p.m. on September 4, 2012. Roll Call: Present: Hupp, Channon, Paddock, Littrel, and Halsey. Also present: Attorney Eric Long, Paul Loete from MSA, Fire Chief Floyd Bruns, Dale Hupp, Jeff Meyers and Harry Pelton. Agenda: Channon moved to approve the agenda for September 4, 2012 seconded by Hupp. Roll call vote: all ayes motion carried. Minutes: Littrel made a correction to the minutes dated August 21, 2012. In Unfinished Business 3rd bullet it was stated there would be a Public Hearing on October 4, 2012. The date is October 2, 2012 for the Public Hearing. Hupp moved to approve the minutes from the meeting dated 08/21/2012 with said corrections seconded by Halsey. Roll call vote: Hupp – aye, Channon – abstain, Paddock – aye, Littrel – abstain, Halsey – aye, motion carried. Channon moved to approve the minutes from the meeting dated August 11, 2012 seconded by Hupp. Roll call vote: all ayes motion carried. Warrants: Paula McIntosh asked to add Sam’s Club payment of $35.00 to the warrants list because it was omitted from the August 21, 2012 warrants. Halsey moved to approve the warrants list with the addition of Sam’s Club for $35.00, seconded by Paddock. Roll call vote: all ayes motion carried. Mr. Pelton stated that he has been affected the longest and would like to see the project complete. UNFINISHED BUSINESS: Paul Loete from MSA gave an update on the road reconstruction project. There is still some seeding to be done. MSA will be meeting with the Contractor to verify quantities. A final Pay Application and final Change Order will be presented at the first October city council meeting. Paul Loete explained the Master Services Agreement. This agreement would eliminate the need to attach a Statement of General Conditions to each task that the city hires MSA to do. The Master Services Agreement streamlines the process and we would use a task order instead. Task Orders would still come before the Council for approval. Channon moved to approve the Master Services Agreement with MSA seconded by Hupp. Roll call vote: all ayes motion carried. Paddock moved to approve the 2nd reading of Ordinance No. 2012-2 Amendment To Chapter 69 Of The Code Of Ordinances. Section 1. 69.08 and Section 2. 69.12. Seconded by Channon. Roll call vote: all ayes motion carried. Paddock moved to approve the 3rd reading of Ordinance 2012-1 An Ordinance Amending The Code Of Ordinances Of The City Of Riverdale, Iowa, By Adding A New Chapter, 90-Multi-Use Recreational Trails. Seconded by Channon. Roll call vote: all ayes motion carried. Paddock moved to approve the 1st reading of Ordinance 2012-3 Amendment To Chapter 95 Of The Code Of Ordinances 95.125 - Comprehensive Sewer Service Charge and 95.134 - Rates. Seconded by Channon. Roll call vote: all ayes motion carried. Paddock reported on the Committee For Beautification For The Multi-Use Trail. The first meeting will be held on September 14, 2012 at 1:00 p.m. in City Hall. Attorney Long does not recommend more than 2 council persons on the committee. Paddock and Hupp will serve on the committee and would like to have 3 more persons to also serve on this committee. Paddock is writing a grant for beautification of the recreation trail. Attorney Long presented Ordinance 2012-4 An Ordinance Amending The Code Of Ordinances Of The City Of Riverdale, Iowa, By Adding A New Chapter Regarding A Multi-Use Recreational Trail Advisory Committee. This Ordinance is for Council review and will be on the next agenda for the 1st Reading. NEW BUSINESS: Fire Chief Floyd Bruns presented the Riverdale Fire Department Report for July 17 to August 21, 2012. Halsey moved to approve the Riverdale Fire Department Report for the dates given, seconded by Channon. Roll call vote: all ayes motion carried. Channon moved to postpone the approval of the Street Financial Report until the September 18, 2012 meeting, seconded by Halsey. Roll call vote: all ayes motion carried. Mayor Franklin read a resignation letter from Maintenance Supervisor Larry Brown. Halsey moved to approve Mr. Brown’s resignation, seconded by Littrel. Roll call vote: all ayes motion carried. Mayor Franklin asked Council if they wanted to fill that position. It does save the city money. Halsey moved to authorize the Clerk to advertise the position, seconded by Hupp. Roll call vote: all ayes motion carried. Paddock reported on the Mississippi River Trail Phase II. Riverdale received a grant for 496,000.00 for this phase of the trail. It is an 80/20 Grant. Paddock had an updated cost projection from Townsend Engineering for the cost of Phase II as well as the Engineering costs. Paddock and Mayor Franklin will be meeting with the Iowa Department of Transportation on September 12, 2012. Paddock is looking into other Grant Opportunities to help offset the cost to Riverdale. There are still land appraisals that have to be done. Paddock moved to pay Nelson Appraisal for four appraisals not to exceed $3,500.00. Seconded by Hupp. Roll call vote: all ayes motion carried. COMMITTEE REPORTS Channon asked that the mowing contract be on the September 11 agenda and then published. COMMUNICATIONS FROM THE COUNCIL AND OTHER OFFICIALS Halsey stated that the “No Parking” signs on Kensington have helped the situation in Haven’s Acres. Halsey received phone calls from several commercial owners asking why the taxes have raised in Riverdale. Mayor Franklin explained that Riverdale has been in a deficit situation for many years. General Fund reserves have been spent down to the 25% of annual general budget as specified by Iowa’s department of management and Auditor’s office. Taxes were raised to balance the budget and because of the bond issue. Mayor Franklin stated that Charles Ricketts had passed away. Most people know Rick as “Uncle Sam” in the Fourth of July parade. Rick was also a volunteer fireman for many years and served on several city committees. ________________________ _______________________________ Jack Franklin, Mayor Attested by: Paula McIntosh City Clerk PUBLIC HEARING FOR THE AMENDED ZONING SUBDIVISION ORDINANCE & SPECIAL RIVERDALE CITY COUNCIL MINUTES SEPTEMBER 11, 2012 Mayor Franklin called the Public Hearing to order at 6:37 p.m. Mayor Franklin stated that the Public Hearing was to hear commentary on the Riverdale Amended Zoning Subdivision Ordinance. The Mayor noted those in attendance were Councilman Hupp, Channon, and Paddock, Attorney Eric Long, City Clerk Paula McIntosh, Judith Krell and Dorothy Jenkins. The Ordinance has been available at the City Office for anybody for review by the public. The Subdivision Ordinance was last modified by the Riverdale Planning and Zoning Committee and MSA in May of 2012 and is now presented for public hearing and then to Council for approval. Mayor Franklin asked if any written comments were received. There were none. Mayor Franklin asked for comments from the public. There Dorothy Jenkins asked if this was for new housing and not existing housing. Mayor Franklin stated that the ordinance is for new subdivisions and the revised ordinance includes the Statewide Urban Design And Specifications (SUDAS) standard. Hupp asked for clarification in several areas of the ordinance. Channon moved to close the Public Hearing at 6:55 p.m. seconded by Hupp. Roll call vote: all ayes motion carried. Mayor Franklin opened a Special Session of the Riverdale City Council at 7:00 p.m. Roll Call: Present: Hupp, Channon, and Paddock. Littrel and Halsey were absent. Also present: Attorney Eric Long, Dorothy Jenkins and Judith Krell. Agenda: Changes made to the agenda were to remove the 1st item under New Business – 1st Reading Of The Amendment To The Zoning Ordinance For The City Of Riverdale. The 3rd item was changed to Approval Of The Publication For The Mowing Contract. And Public Communications To The Council was added. Paddock moved to approve the agenda with said changes, seconded by Channon. Roll call vote: all ayes motion carried. COMMUNICATIONS TO THE COUNCIL Judith Krell thanked Mayor Franklin for taking care of the problem with the railroad crossing on Kensington. The residents in Haven’s Acres had received a note stating the crossing was being repaired the next day and would be closed for a short time. UNFINISHED BUSINESS: Paddock moved to approve the 2nd reading To The Sanitary Sewer Ordinance Including Increase In Sewer Rates. Seconded by Channon. Roll call vote: all ayes motion carried. Hupp moved to approve the 2012 Street Financial Report seconded by Paddock. Roll call vote: all ayes motion carried. Channon moved to approve Resolution No. 2012-31 A Resolution Approving The City Street Financial Report July 1, 2011 To June 30, 2012. Seconded by Hupp. Roll call vote: all ayes motion carried. NEW BUSINESS: Paddock moved to approve the 1st Reading Of The Amendment To The Subdivision Ordinance For The City Of Riverdale. Seconded by Channon. Roll call vote: all ayes motion carried. Hupp moved to approve the publication of a request for bids for the Riverdale Mowing Contract. Seconded by Paddock. Roll call vote: all ayes motion carried. Paddock moved to approve the attendance of Councilmen, Mayor or City Clerk to the Citizen’s Planner Workshop presented by Bi-State at the cost of $20.00 per person. Seconded by Hupp. Roll call vote: all ayes motion carried. COMMITTEE REPORTS Hupp asked Mayor Franklin if he would call Allied Waste and have them pick up the garbage in the parks. This is an ongoing problem and Allied Waste needs to pick up the garbage in our parks per the contract agreement. Paddock mentioned the Recreation Trail Beautification Grant she is working on is due October 1, 2012. Channon moved to adjourn at 7:25 p.m. Seconded by Paddock. Also present: Attorney Eric Long, Jared Fluhr from MSA, Harry Pelton, Jack Hoots, Judith Krell, Marsha Voight-Zemo, and Michael Meloy. Agenda: Mayor Franklin noted that the 3rd bullet in Unfinished Business, Amendment Of Parking Ordinance “No Parking Zones” 3rd Reading should be removed from agenda. The 3rd reading had been completed at the last meeting. Halsey moved to approve the September 18, 2012 agenda with said change, seconded by Channon. Roll call vote: all ayes motion carried. Minutes: Hupp moved to approve the minutes from the meeting dated September 4, 2012, seconded by Channon. Roll call vote: all ayes motion carried. The minutes from the meeting dated September 11, 2012 will be on the next agenda. Halsey did not attend the September 11, 2012 meeting so there was no quorum to approve the 9/11/12 minutes. Mr. Meloy asked that the Council withhold payment to Hawkeye Paving for substandard work done on the driveway at 249 Manor Drive, the home of Marsha and Michelle Voigt-Zemo. Mr. Meloy stated he had sent a letter to Mayor Franklin and Attorney Steve Hunter detailing the problems with the driveway as well as pictures depicting the substandard work. Mr. Meloy asked that the council move to withhold payment to Hawkeye Paving until the matter is resolved. Jared Fluhr from MSA stated that this matter is still under discussion with Hawkeye Paving and the city has not paid Hawkeye for the driveways at this time. Harry Pelton stated there are several things that need to be addressed near his home with the road construction project. The down spouts at his home have not been replaced correctly, the property pin has not been replaced, the straw silt screen “sock” has just been thrown on the hill and is killing the grass and he is still driving through mud to get to his driveway. Mr. Pelton is very tired of the mess and would like to see things finished soon. Marsha Voigt-Zemo asked when she could expect a resolution on the matter of her driveway. Mayor Franklin stated he could not give her a date. UNFINISHED BUSINESS: Jared Fluhr from MSA gave the update on the road construction project. All that is left to complete is the punch list items. Quantities have to be verified. After all is resolved the retainage will be paid. Jared presented the Hawkeye Paving Pay Application No. 7 in the amount of $31,968.45. There were no disputed items on the pay application. Jared stated there was no Change Order 8 at this time; it will be presented at the next meeting. Hupp moved to pay Hawkeye Paving for Pay Application No. 7 in the amount of $31,968.45, seconded by Halsey. Roll call vote: all ayes motion carried. Seconded by Hupp. Roll call vote: all ayes motion carried. Mayor Franklin asked Lovewell Fencing for a bid on fence repair near the recreation trail. The fence around the sump near Kensington has been cut. Part of the fence panel facing the trail and the fence panel facing Kensington appears to have been cut and part of the fence panels are missing. This will be on the agenda when we receive the bid from Lovewell Fencing. Hupp reported on the status for submitting a grant for beautification of the Recreation Trail near Haven’s Acres. Paddock is finalizing the Grant Application. Channon moved to proceed with the Grant Application as long as we meet all the qualifications for the Grant. Seconded by Halsey.
