Fluhr, Engineer On-Site Contact: Billy Evans, Superintendent Office: 563.445.3501 Cell: 563.529.0284 Cell: 563.543.8202 Email Address: jfluhr@msa-ps.com RIVERDALE ROADWAY RECONSTRUCTION PROJECT The intent of this letter is to update you on the progress of the construction on Manor Drive, Circle Drive, Fieldcrest Road, Windsor Drive, Elmhurst Lane, & Valley Drive. Project Schedule Hawkeye Paving has finished one travel lane of Circle Drive, Elmhurst Lane, and Windsor Drive. The driveways are also poured along these streets on the paved side. As these roads are meeting the required strength to open up to traffic, they have begun removing the pavement on the adjacent side. The road subdrain will be placed followed by subgrade compaction and placement of the subbase. These roads will then be paved in the upcoming weeks, starting with Circle Drive. Saw cutting of the pavement will also be taking place throughout the entire paving process. I remind you that it may be necessary for Hawking Paving to be saw cutting past the normal working day, and into the late evening. We apologize in advance for the noise caused by saw cutting of the concrete, but this work is crucial to the quality of the pavement. After the concrete is poured for the roadways and driveways, traffic on the new concrete will not be allowed for a period of approximately 5-7 days (unless notified otherwise) to allow the concrete to cure properly. I ask that residents take a look at their driveways when the contractor forms them up, and if anyone has any concerns with the way it looks, please call me immediately. Manor Drive is currently being prepped for paving, and is planned to be paved late next week (tentative - April 26th). Currently there is temporary rock along Manor hill to accommodate two lanes of traffic. While the one side of Manor hill is being paved, flaggers will be used to control traffic. When Hawkeye begins removing the other half of Manor hill, there will only be one lane of traffic, with temporary passing points where needed. Hawkeye paved the majority of Valley Drive, including the 3 foot asphalt shoulder, gutter pan, and driveways along the roadway. This section of roadway will remain closed until approximately the end of April. The intersection of Fenno and Valley will start being poured this week, and will be done in 3 phases to accommodate local traffic. Hawkeye Paving has also been removing and replacing the storm sewer along Fieldcrest Road simultaneously. They will be placing the storm inlets at the intersection of Fieldcrest Road and Circle Drive this week. The storm sewer work along Fieldcrest Road will take approximately 3 more weeks. Driveway Access & Work Within The right-of-Way Reminder: Residents will not be able to access their driveways while construction is taking place on their side of the street. It is recommended that residents and neighbors work together, and share driveways with neighbors across the street from each other. If sharing a driveway is not possible or feasible for some residents, there will be parking available on the other streets, a temporary parking area at the end of Windsor Dr., and at Volunteer Square and Bicentennial Parks. Hawkeye’s subcontractor will take care of all the final grading and seeding from the back of curb to the right-of-way. This work will take place as directed by Hawkeye Paving. Traffic Control Hawkeye Paving is responsible for all traffic control measures. During the roadway reconstruction, one lane of traffic will always remain open. Circle Drive is currently ONE WAY. Valley Drive is completely closed and proper road closure and detour signs are in place. MSA has made contact with the City of Bettendorf regarding the striping of Valley Drive. The striping of Valley will not take place until July. Please be aware that there will not be striping when Valley Drive is open, and proper signs will be in place. With only one lane of traffic open in construction areas, we ask that all residents please be patient, courteous and alternate at one lane restrictions this spring as we work together for the successful completion of this project. Manor Drive hill should be fully open for the 4th of July. Utility Coordination & Relocations The gas company is in the process of switching over to the new services and main, and nearing completion of their utility work in conjunction with the street project. Jared Fluhr (MSA) is the construction engineer and will be on-site. Jeremiah Luoma, with MSA, will also be an on-site inspector. If any questions or concerns arise during construction, please feel free to contact myself or Billy Evans using our contact information listed on the front page. Roll Call: Present: Channon, Hupp, Paddock, Littrel and Halsey. Also present: Attorney Eric Long, Attorney Steve Hunter, Jared Fluhr from MSA, Richard Wells, Dale Hupp, Jean Meer, Perri and Athena Smith, Herb Atwood, Matt Griffith, Teri Stickler, Vi Stickler, Dallas Paustian, and Harry Pelton. Agenda: Mayor Franklin noted changes that were made to the agenda on April 2, 2012 at 1:40 p.m. Paddock moved to approve the agenda with the changes. They would like a fence between their homes and the Recreation Trail and a gate on Kensington. The residents have concerns of safety issues regarding the path. Richard Wells asked about the Storm Water Utility that was on the agenda. Mayor Franklin stated that was to alleviate the cost of water runoff that the city is currently responsible for. Mr. Wells asked why the city was going to do sewer billing. Mayor Franklin stated it was because Iowa American Water was not going to do the sewer billing for the city anymore. Teri Stickler asked about the wire woven fence that city was going to put up on the newly purchased land. Ms. Stickler stated that she hoped the fencing was not going to be put behind the homes in Riverdale. Harry Pelton stated that he understood the city had purchased land with the intent to extend Fieldcrest Road. Mr. Pelton stated to expect a petition if you are going to open up Fieldcrest Road. UNFINISHED BUSINESS: Jared Fluhr from MSA gave an update on the Road Reconstruction Project, Scott Community College Detention Pond Outlet, and the Comprehensive Plan. There was discussion of generator maintenance for the city’s generator. Mayor Franklin recommended to not enter into an agreement and to just call them on an “as needed” basis. Halsey moved to table the Fire Department Awards Fund until a later date. Seconded by Littrel. Roll call vote: all ayes motion carried. Hupp presented a quote from Heiar Fencing for 1645 ft. of 5 ft. wire woven fencing including wood and steel posts for $10,547.50 for the Riverdale/Welch boundary. Also quotes from Heiar for fencing the Riverdale/Bettendorf boundary as well as the Riverdale/Riverdale boundary. Included was pricing for 25 steel posts on the Bettendorf boundary for $500.00. Hupp moved to hire Heiar Fencing to install 1645 ft. of 5 ft. wire woven fence on the Riverdale/Welch boundary and 25 steel posts at the Bettendorf/Riverdale boundary not to exceed $11,500.00. Paddock asked to amend the motion and have MSA determine the correct boundary line between Bettendorf and Riverdale. Hupp agreed to amend the motion. Seconded by Halsey. Roll call vote: Channon – aye, Hupp – aye, Paddock – no, Littrel – aye, Halsey – aye motion carried. Hupp moved to hire MSA to locate the pins and find the stakes between the Bettendorf/ Riverdale boundary not to exceed $500.00. Seconded by Littrel. Roll call vote: all ayes, motion carried. The disposition of the Fire Department’s 2002 Ford Expedition was discussed. Mayor Franklin stated that he thought we should keep the vehicle for the city maintenance vehicle. This will be discussed at a later date because the Riverdale Fire Department is using the 2002 Ford Expedition during the Road Reconstruction Project. Paddock moved to approve A Proclamation Of The Mayor And City Council Of The City Of Riverdale, Iowa, Proclaiming Wednesday, August 15, 2012 As The City Of Riverdale Wear Pink Day. Seconded by Littrel. Roll call vote: all ayes motion carried. NEW BUSINESS: Halsey discussed the ongoing problems at the Recreation Trail near the homes in Haven’s Acres. A gate is need at Kensington, signage in the area and a fence between the trail and the resident’s homes. The Recreation Trail is not officially open at this time and Mr. Halsey stated we should put up signs stating that the trail is not open. Mayor Franklin stated that we can’t put a fence up until the contractors are finished. Mayor Franklin had a price quote from Lovewell Fencing for 1400 ft of fencing. However 1800 ft of fencing is needed as well as a 14 ft gate. Hupp, Halsey and Franklin will get more pricing for 1800 foot of fencing and gate. Attorney Hunter advised Riverdale to call Steve Grimes from Bettendorf Parks and Recreation and make sure he secures the site since the trail is not open at this time. We will look into signage from Iowa Prison Industries. Jared Fluhr from MSA presented Change Order No. 2 for tree removal along Fieldcrest Road, 3 trees on Circle Drive and 2 trees on Manor Drive for $5,000.00. This price also includes removal of several bushes. Littrel moved to approve Change Order No. 2 not to exceed $5,000.00 for tree and bush removal, seconded by Halsey. Roll call vote: all ayes motion carried. Fire Chief Floyd Bruns presented the Riverdale Fire Department report for January 17, 2012 through March 20, 2012. Halsey moved to approve for the dates presented, seconded by Paddock. Roll call vote: all ayes motion carried. Halsey moved to table the salt purchase for the 2012/2013 season until a later date, seconded by Littrel. Roll call vote: all ayes motion carried. There was discussion of liabilities and actions concerning installation of a storm sewer pipe into Scott Community College’s Detention Pond. This pipe was not in the original construction bid. Mayor Franklin stated that Scott Community College (SCC) should connect their pond to our pipe. In heavy rains their pond overflows and then floods resident’s homes. Attorney Hunter explained that it is SCC’s responsibility to fix their problem. Attorney Hunter has sent letters to SCC’s Attorneys and there has been no response. We have no legal right to enter the property to extend the pipe. Dale Hupp stated that Riverdale has met all the requirements of past mediation and now it is time for the college to meet their responsibilities. Attorney Hunter will draft another letter to the college stating that Riverdale is having another meeting in 10 days to discuss other options. Discussion of extending Kensington Road to the Multi Use Trail. It needs to be hard surfaced to allow fire trucks through there in case of an emergency. A gravel surface will be sufficient for the fire trucks. Halsey moved to have Attorney Eric Long review and make recommendations on how to proceed with the Codification. Seconded by Littrel. Roll call vote: all ayes motion carried. Paddock moved to purchase a new water heater for city hall not to exceed $3,000.00 seconded by Halsey. Roll call vote: all ayes motion carried. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS Hupp asked if we had the yard waste situation figured out. Mayor Franklin stated that yard waste will be temporarily suspended for those affected by the road reconstruction. A dumpster has been placed at Bicentennial Park for yard waste only. There will be no curb side yard waste for those affected until the end of the road project. Paddock stated that we will get the public computer fixed in the city office. Agenda: Mayor Franklin asked to remove the first item under New Business. Halsey moved to approve the agenda as modified, seconded by Littrel. Roll call vote: all ayes, motion carried. Minutes: Paddock made a correction to the minutes dated April 3, 2012. Under Unfinished Business Paddock’s amendment was to only include fence on the Welch property and look at the other property separately. In Communications From the Council Paddock stated that we would “look into getting the public computer fixed”. Channon made a correction under Public Communications to the Council. The minutes read “that city” it should have said “the city”. Paddock moved to approve the minutes from the meeting dated April 3, 2012 as amended, seconded by Channon. Roll call vote: all ayes motion carried. Warrants: Mayor Franklin asked to remove the payment to Hawkeye Paving until later in the meeting after discussion. Franklin $553.02 Total $2,301.41 PUBLIC COMMUNICATIONS TO THE COUNCIL: Nicole Schueller from Allied Waste attended the meeting to present Riverdale with a plaque in appreciation for the recycling the city does. Riverdale recycled 53 tons last year. Ms. Schueller stated that is extremely good for a city the size of Riverdale. Steven Townsend stated that there were cracks in the new concrete in front of his home on Circle Drive. Mr. Townsend also stated that the back fill there are putting in his yard are very large pieces of different kinds of debris. Mr. Townsend is concerned that the grass will not grow with this kind of debris for fill. Paul Loete from MSA addressed Mr. Townsend’s concerns. Mr. Loete stated that MSA will be assessing the cracked areas during the construction and they will be repaired. Mr. Loete will check with Hawkeye Paving on what they are using for backfill and make sure it meets all requirements. George Seaberg presented council with a petition stating citizens of Riverdale are opposed to any extension of Fieldcrest Road. Mr. Seaberg asked for the city to write a resolution stating that the city would not extend Fieldcrest Road. Mayor Franklin stated that the city has purchased approximately 6 acres that they may want to sell off if the property is not used as part of the solution to Scott Community College’s drainage problem. The city has not yet made those decisions and there are no plans for the land at this time. Mr. Seaberg asked that the record show that he is against an extension of Fieldcrest Road as well as the people that signed the petition. Mayor Franklin reiterated that there are no plans at this time for homes in that area or to extend Fieldcrest. Teri Stickler stated that she thought that area would be an excellent buffer zone and green space area between Riverdale, Bettendorf, and the Deer brook area. Harry Pelton stated it would be very costly for sewers, streets, and other utilities for just 6 homes. Dean Mathias from the Quad City Bike Club spoke to the council about the Father’s Day Bike Ride that will begin at the Duck Creek Bridge ride to Buffalo and back to the Duck Creek Bridge. Mr. Mathias was asking for Riverdale residents to be a part of this Father’s Day ride. Mayor Franklin spoke about the problems Riverdale is experiencing with inconsiderate bikers in the Haven’s Acres area. Mayor Franklin stated the ride needs to originate on Bellingham near Alcoa. Mayor Franklin stated parking would be a problem and Mr. Mathias may want to ask if they could use the Alcoa parking lot. UNFINISHED BUSINESS: Jared Fluhr from MSA presented the project update for the road reconstruction. Mr. Fluhr presented Change Order No. 3. Cutting of additional holes in concrete storm manhole to tie existing pipes into the new manhole. Deduct in the contractors contract for re-staking efforts that the city had to provide for damaged hubs and stakes. This deduct will be used to pay MSA for the re-staking in the form of a contract amendment between MSA and the City of Riverdale in the amount of -$1,000.00. Littrel moved to approve Change Order No. 3 for a deduction of $1,000.00, seconded by Halsey. Roll call vote: all ayes motion carried. Paul Loete explained the pay applications. Hawkeye Paving submits the pay applications to MSA. MSA approves the pay application, holds a 5% retainage fee and then submits the pay application to the city for approval. Littrel moved to approve Hawkeye Paving payment in the amount of $253,196.75 seconded by Halsey. Roll call vote: all ayes motion carried. The purchase of a fence and gate between the recreation trail and resident’s homes in Haven’s Acres was discussed. If the fence would be installed on the property line of the homeowners the Riverdale Ordinance would have to be changed to accommodate a 6’ fence or apply for a variance to allow for a 6’ fence. Some council members feel that erecting a fence for homeowners is setting precedence. There are concerns about liability issues if there is no fence. Hupp stated that she had spoken with Kathy Wine from River Action and Ms. Wine suggested signage to direct the bicyclists in the right direction. Halsey moved to approve to hire Lovewell Fencing to install a 6’ chain link fence and gate in the amount of $25,075.00 seconded by Littrel. Roll call vote: Hupp – no, Channon – no, Paddock – no, Littrel – aye, Halsey – aye. Motion failed. Mayor Franklin met with the Chancellor of Scott Community College (SCC), Attorney Schiltz representing SCC, Paul Loete from MSA and Attorney Steven Hunter representing Riverdale. The Chancellor is new and asked for the history on the storm water issues. Mr. Loete thought the meeting went well and thought there would be more discussion with SCC. A date will be set for a future meeting with the college. Channon moved to continue the installation of the storm water pipe on Fieldcrest to new planned manhole on the north side of Manor Drive and to connect to the existing SCC 18” diameter pipe to the new manhole. Seconded by Halsey. Roll call vote: all ayes motion carried. Attorney Eric Long presented a letter that would be sent out to fire department members that are a part of the Riverdale Fire Awards Plan. Attorney Long reviewed the current Fire Awards Plan and explained the terms that must be met to terminate the plan. Attorney Long recommended that the city hire an objective party to review the plan and do the calculations of the award each Riverdale Fireman would receive. Littrel moved to send the termination of the Riverdale Awards Fund letter to past and present members of the Riverdale Fire Department, seconded by Halsey. Roll call vote: Hupp – abstain, Channon – abstain, Paddock – abstain, Littrel – aye, Halsey – aye. Motion carried. Franklin noted that 3 council members have a conflict of interest concerning the Awards Fund and therefore abstained. Under Iowa Law the remaining 2 council members may decide the issue. The salt order was placed last week because of a deadline placing the order. 100 tons of salt were purchased. Riverdale has more than 100 tons left over from the current year, in storage. NEW BUSINESS: Paul Loete from MSA presented the MSA Construction Related Services Contract Amendment. Mr. Loete explained that the staking and surveying costs should have been time and material and mistakenly got put in the rest of the contract. Mr. Loete would like to charge the rest of the surveying as time and material. Hupp moved to modify the MSA contract for staking and surveying not to exceed $13,000.00, seconded by Paddock. Roll call vote: all ayes motion carried. Channon moved to set the date for the Public Hearing concerning the Amended Riverdale City Budget for May 15, 2012 at 6:30 p.m. seconded by Hupp. Roll call vote: all ayes motion carried. Hupp moved to purchase the Data Technologies Interface Module for Utility Billing for $1,100.00 seconded by Channon. Roll call vote: all ayes motion carried. An Amendment to Ordinance 95.135 was presented. This Ordinance states a rate change for sewer usage from $0 .70 per unit to $1.35 per unit. Hupp moved to approve the first reading of Ordinance 95-135, seconded by Channon. Roll call vote: all ayes motion carried COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS Hupp wants to get a bid from Cribbs Lawn Service for an estimate on cutting the property recently purchased with a bush hog. This area becomes overgrown in a short time. Paula McIntosh had talked to Pat Mohr about spreading the mulch at Haven’s Acres Park. Mr. Mohr stated that he would find a time to get it done. Mayor Franklin stated that the water heater in city hall had been replaced. Mayor Franklin also wanted the council to know that the city server is within 16% per cent of being full. We need to think about replacing the server. The server is an old PC and needs to be replaced. Hupp wanted to thank MSA for all that they do. Mayor Franklin stated that he thinks Jared Fluhr and Jeremiah Luoma do a terrific job. Mr. Fluhr fields all the calls for the city and answers all the questions and complaints from the residents concerning the road reconstruction.
