Only one lane of Manor Drive will be open for the 4th of July. ADDITIONAL PARKING FOR RESIDENTS Scott Community College has graciously given permission for residents to park in Scott Community College Parking Lots during Roadway Reconstruction. Please do not park in the day care or baseball field lots. Parking in the Scott Community College Parking Lots is at your own risk. PUBLIC HEARING The Planning and Zoning Commission has finished their review of the subdivision Ordinance and the Planning and Zoning Ordinance. A Public hearing for the subdivision ordinance is set for September 11, 2012 at 6:30 p.m. A date for a public hearing for the Planning and Zoning Ordinance has not yet been established. For anyone wanting to review these ordinances, printed copies will be available at City Hall. Copies can also be obtained by E-mail upon request. The City is currently unable to post these ordinances to the web site because of web site maintenance activities by Bi-State Planning Commission. Roll Call: Present: Channon, Hupp, Paddock, Littrel and Halsey. Also present: Fire Chief Floyd Bruns, Attorney Eric Long, Jared Fluhr, Dale Hupp, Perri Smith, Steve Townsend, Richard Wells, Michael and Penni Steen, Steven Martens, Herb Atwood, Judith and Dennis Krell, Jack and Shirlene Hoots, Steven Townsend, Matt Griffith, Perri Smith, Jean Meer, and State Representative, Linda Miller. State Representative Linda Miller was in attendance and she would be able to speak without the time limit. Littrel moved to allow each person to speak for 4 minutes, seconded by Paddock. Roll call vote: all ayes motion carried. State Representative Linda Miller attended the meeting and gave city council an overview on what her role is as a State Representative. Ms. Miller stated that citizens can call her with needs and concerns. Ms. Miller also spoke about a new bill that makes it easier for small towns to go through procedures concerning open records. Ms. Miller stated she had met with residents from Haven’s Acres the previous evening to hear concerns about the recreation trail behind their homes. Ms. Miller will work with Riverdale on some grant opportunities that may help alleviate some of the problems at the recreation trail. Richard Wells had comments about his variance request and application for a 6 foot high fence which was denied by the Board Of Adjustment (BOA). Mr. Wells stated that the BOA suggested he ask the city to change the ordinance. There were several residents from Haven’s Acres in attendance to discuss their frustration with the recreation trail. There are hundreds of bikers and walkers in their neighborhood on the weekends. There are still problems with the bicyclists trespassing on private property. The Haven’s Acres residents again asked the council to consider the fence they have asked for. UNFINISHED BUSINESS: Jared Fluhr, from MSA, presented an update on the road reconstruction project. Hawkeye is finished with the paving on Fieldcrest Road and finishing at the intersection of Fieldcrest Road and Circle Drive. The paving on Manor Hill will begin this week. Hawkeye will keep one lane open as much as possible and flaggers will be used during the paving operations. A final walk through and punch list was done on Valley Drive. Mayor Franklin stated that the signage for the recreation trail has not arrived, but should be in by next week. Mayor Franklin stated that he had received a bid for two safety fences along the recreation trail. The first bid is for 235’ of fencing that would extend the fence that is in place east of the bridge across Duck Creek. The purpose is to keep people from falling down a steep embankment. The second bid was for 65’ of fence to wrap around the drainage sump at the end of Kensington. Paddock questioned the 6’ fence when the city ordinance states that it must be a 5’ fence. Mayor Franklin explained a 5’ fence was for Residential Zoning, the area we are discussing is zoned Industrial. Paddock moved to hire Lovewell Fencing to erect a 5’ fence around the sump area not to exceed $3,200.00. Seconded by Halsey. Roll call vote: Hupp – aye, Channon – aye, Paddock – aye, Littrel – nay, Halsey – aye. Motion carried. Paddock asked to wait until there was more clarity on height restriction before installing the 235’ fence extension. Halsey moved to table the 235’ section of fence, seconded by Littrel. Hupp asked why it was being tabled. Halsey stated because he thinks we need to do all the fencing that residents have asked for. Roll call vote: Hupp – nay, Channon – nay, Paddock – nay, Littrel – aye, Halsey – aye, motion failed. Paddock moved to extend the existing fence by 235’ whether it is 6’ or needs to be 5’, whichever is allowed by our city ordinances of a cost not to exceed $4880.00, seconded by Halsey. Roll call vote: Hupp – nay, Channon – nay, Paddock – aye, Littrel – aye, Halsey – aye. Motion carried. Paddock moved to purchase 3 traffic bollards for the end of Kensington Street to keep vehicles from entering the recreation trail. Two bollards will be made as on piece stationary units and the third will be made to fold down for emergency access. The fabricated posts will be furnished with one coat of safety yellow powder coat paint and a 3” wide x 18” long reflective tape and applied to both sides of the bollards. The bollards would be installed by setting them into 8” diameter x 42” deep concrete ground footings. The bid was received from Boyler’s Ornamental Iron for $1305.00 for the fabrication and installation. Hupp moved to purchase and install the traffic bollards from Boyler’s Ornamental Iron for $1305.00, seconded by Paddock. Roll call vote: Hupp – aye, Channon – aye, Paddock – aye, Halsey – nay. Motion carried. Littrel left at 8:00 p.m. before this vote was taken. Hupp presented a bid from Tri-City Blacktop to install blacktop from Kensington Street to the recreation trail in the amount of $4,775.00. This bid did not include the cost to remove curbing and install tactile warning pads. Hupp will get a new bid from Tri-City Blacktop. NEW BUSINESS: Mayor Franklin stated there is a discrepancy in the boundary lines between Bettendorf and Riverdale south of Haven’s Acres. The GIS maps and the Assessors maps do not agree. Hupp moved to hire MSA to determine where the correct boundary lines are. Seconded by Channon. Roll call vote: all ayes motion carried. Paula McIntosh presented the cost for the salt for our Salt Contract for the 2012/2013 season. The cost will be $64.30 per ton. Channon moved to accept the cost of the salt for 2012/2013, seconded by Paddock. Roll call vote: all ayes motion carried. COMMITTEE REPORTS Hupp stated that the mulch had been installed at Haven’s Acres Park and looks very nice. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS Halsey asked about the Bike ride on Father’s Day. He is afraid that is going to be a mess for those living in Haven’s Acres. Mayor Franklin stated that he had talked to Dean Mathias from the Quad City Bike Club about the bicyclists parking at the Alcoa lot. Mayor Franklin stated he had received a phone call from the Humane Society about picking up some caged cats at Volunteer Square Park. Franklin approved the request. Mayor Franklin asked council to review a possible bike ordinance that was in the packets. Halsey moved to adjourn at 8:55 p.m. Seconded by Channon. Roll call vote: all ayes motion carried. Mayor Franklin explained how the business of the city council meeting should proceed. The Public Communications to the Council occurs only at the time slotted. Mr. Wells suggested it would be beneficial to notify citizens so they would have an opportunity to review these Ordinances before the Public Hearing. Judith Krell asked if the Recreation Trail was a Multi-Use Trail or a Bike Trail. Mayor Franklin stated that the trail is a Multi-Use Trail and the trail’s uses are decided by City Council. Dallas Paustian stated concerns he has about the weeds at Boylers property. He would like the City Council to address the problem. Citizens addressed concerns about water inlets at Fieldcrest Road and Circle Drive not working properly, curb side pickup for yard waste, and will we be able to access Bicentennial Park by the 4th of July. Another concern was parking for guests on Manor Drive on the 4th of July. Jared Fluhr from MSA stated than one lane of Manor Drive should be paved by the 4th, but there really is no way to predict how far the project will be by the 4th of July. Marsha Voight-Zemo stated that Hawkeye Paving Corp. has been very accommodating during the project. UNFINISHED BUSINESS: Jared Fluhr presented an update on the road reconstruction. Hawkeye Paving has removed one lane of Manor Drive. Hawkeye should be ready to pave in the next week. All of the sanitary sewer repairs have been completed on Manor Drive. Hawkeye cannot make any promises about progress by the 4th of July. Jared Fluhr presented Change Order No. 4. There was more sub-grade work to do on Manor Drive, lateral repairs on Fieldcrest, and a change in pipe material The total amount of the Change Order is $8,517.50. Littrel moved to approve Change Order No. 4 in the amount of $8,517.50 seconded by Halsey. Roll call vote: all ayes motion carried. Jared Fluhr presented Pay Application No. 4 from Hawkeye Paving Corp. in the amount of $291,769.18. Paddock moved to pay Pay Application No. 4 in the amount of $291.769.18. Seconded by Hupp. Roll call vote: all ayes motion carried. Jared Fluhr presented options to City Council concerning Hawkeye Paving’s handling of grass seeding for the remainder of the project. The Iowa DOT deadline for seeding was May 31, 2012. Fall seeding is recommended to take place between August 10, 2012 and September 30, 2012. MSA recommended that, in accordance with the paving contract, temporary seeding be spread of bare areas and then wait until August to have the final seeding placed. There is no additional cost to this option. Littrel moved to approve MSA’s recommendations, seconded by Halsey. Roll call vote: all ayes motion carried. Hawkeye Paving is asking for $5,000.00 to import topsoil. The paving contract calls for Hawkeye to strip and salvage the top soil and to provide any additional top soil. Jared thought Hawkeye may have misread the contract. MSA does not recommend that the city purchase topsoil. Littrel moved to table the topsoil issue, seconded by Paddock. Roll call vote: all aye motion carried. Mayor Franklin presented an Amendment To Chapter 95 Of The Code Of Ordinances and the need to increase in the sewer rates to pay for equipment replacement, the elimination of infiltration of storm water in to the sanitary lines, and the proposed sanitary sewer plants equalization basin. Hupp asked if we could have someone better explain the Ordinance so everyone completely understands it. Mayor Franklin will talk to MSA. Hupp moved to table Amendment To Chapter 95 Of The Code Of Ordinances, seconded by Paddock. Roll call vote: all ayes motion carried. NEW BUSINESS: Mayor Franklin presented Resolution No. 2012-15. A Resolution Approving Payment Of Outstanding Invoices After The June 19, 2012 Council Meeting And Before July 1, 2012 (The End Of The Fiscal Year). Paddock moved to approve Resolution No. 2012-15 to pay budget items by June 30, 2012, seconded by Channon. Roll call vote: all ayes motion carried. Hupp asked that we clarify the purchase of 25 steel posts to mark the boundary between Riverdale and Bettendorf. This purchase was addressed in the April 3, 2012 minutes. Hupp thought that the purchase of the steel posts was not made clear in the minutes. Attorney Hunter stated that the line should be marked because of encroachment on property by Bettendorf home owners. It would be up to the City to limit any public access. Littrel moved to purchase 25 steel posts to mark the Riverdale/Bettendorf line. Seconded by Halsey. Roll call vote: all ayes motion carried. Littrel left at 8:20 p.m. Riverdale Ordinance Chapter 69 Parking Regulations was reviewed and discussed by Council. Halsey moved to table Revisions to Street “No Parking Zones” to July 3, 2012 agenda. Seconded by Channon. Roll call vote: all ayes motion carried. Ordinance 2012-1 An Ordinance Amending The Code Of Ordinances Of The City Of Riverdale, Iowa, By Adding A New Chapter, and 90-Multi-Use Recreational Trails was presented. This Ordinance was discussed and changes were made. An enforcement section needs to be added. Hupp moved to set the date for a Public Hearing concerning the Subdivision Ordinance for September 11, 2012 at 6:30 p.m. Seconded by Paddock. Roll call vote: all ayes motion carried. Hupp asked if we could have the documents available at City Hall for people to check out and review before the Public Hearing. The Zoning Ordinance will be held at a later date. The City is waiting for the completion of the Comprehensive Plan. Hupp moved to purchase mulch for the parks not to exceed $250.00, seconded by Halsey. Roll call vote: all ayes motion carried. Hupp stated there were some bushes at Volunteer Square Park that were destroyed by the hard frost we had in the spring. Hupp stated we need to put this item on hold until the fall. Discussions about building trash can enclosures at the parks to make it easier for Allied Waste to pick up the trash in the parks. Getting the trash cans emptied in the parks is not being done weekly. Hupp thought we should purchase large trash can liners and have City Maintenance, Larry Brown, empty the trash containers on Tuesdays. COMMITTEE REPORTS Channon stated that she is working on the Lawn Care Contract and would have it for the next meeting. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS Hupp stated that the carpet in the Community Room looks bad and needs to be cleaned. Halsey will speak with Boylers about cleaning up their property. Halsey thanked Mayor Franklin for eliminating bike ride issues on Father’s Day. Paula presented the information for the Iowa League of Cities Annual Conference and Exhibit that will be held September 26-28, 2012 in Sioux City, Iowa. Mayor Franklin stated that a flow meter will be installed in the interceptor sewer near Kensington and State Streets as part of the effort to solve storm water infiltration problem with the sanitary sewer system. The pink fire truck will be in Riverdale on August 15, 2012. Anyone who is a cancer survivor or a current cancer patient is invited sign the fire truck. This item will be on the next agenda. Paddock had a question about the letter received from the Smith’s. The letter stated that the recreation trail has not been built to Federal Regulations. Mayor Franklin explained Iowa Department of Transportation handled the Federal earmark for the trail and that all the plans and changes concerning the trail were approved by the Iowa Department Of Transportation and hence the trail meets Federal requirements.
