Roll Call: Present: Channon, Hupp, Paddock, and Littrel. Halsey was absent. Also present: Jared Fluhr from MSA and Riverdale Fire Chief Floyd Bruns, and Steven Townsend. Agenda: Paddock asked to table “Industrial Property Tax Abatement Ordinance” under Unfinished Business until a later date. Channon moved to approve the agenda with said change for the January 15, 2013. Seconded by Littrel. Roll call vote: all ayes motion carried. Minutes: Paddock moved to approve the minutes from the meeting dated December 18, 2012, seconded by Littrel. Roll call vote: Channon – aye, Hupp – abstain, Paddock – aye, Littrel – aye motion carried. Warrants: Littrel moved to approve the warrants for January 15, 2013 as presented, seconded by Channon. Roll call vote: all ayes motion carried. Mayor Franklin was aware of this and stated that the driveways have now gone back down toward their normal elevation. Mr. Townsend was also concerned about the Industrial Tax Abatement Ordinance. He stated that a few years ago Iowa eliminated the Machinery and Equipment Tax and that adversely affected property taxes. Mr. Townsend has concerns that allowing tax abatement will not be in the best interest of the city. Mayor Franklin stated that the Industrial Tax Abatement is something that they are looking into and no decisions have been made at this time. UNFINISHED BUSINESS: Jared Fluhr from MSA had no updates on the Road Construction Project. Mayor Franklin reported that Attorney Eric Long had sent a letter to Hawkeye Paving denying most of Hawkeyes claims for additional payment and Hawkeye Paving’s Attorney had returned a letter stating reasons why Riverdale’s position is wrong. Among the items is dispute is the measurement for grading and top soil. Hawkeye would like another Engineering Firm to do measurements for the grading and top soil. Paddock reported that there will be an informational meeting at City Hall tomorrow January 16, 2013 at 7:00 p.m. The brochures for the fund raising for the MRT will be ready on Friday morning. There are still changes to be made on Chapter 105 Solid Waste Control Ordinance No. 2013-01. The changes will be made and this will be on the February 5, 2013 Agenda. Paddock moved to approve the 2nd Reading of Amendment to Chapter 65 of the Code of Ordinances. Seconded by Channon. Roll call vote: all ayes motion carried. The Ordinance pertains to: Elmhurst Lane. Vehicles traveling on Elmhurst Lane shall yield at Windsor Dr. Wisteria Lane. Vehicles traveling on Wisteria Lane shall yield at Kensington St. The Iowa Department of Natural Resources Administrative Consent Order was discussed. This administrative consent order is entered into between the Cities of Davenport, Bettendorf, Riverdale and Panorama Park and the Iowa Department of Natural Resources (DNR) for the purpose of establishing a schedule for necessary upgrades to the Davenport Water Pollution Control Plant and the wastewater collection systems of Davenport and Bettendorf to achieve compliance with applicable requirements and to eliminate the discharge of untreated wastewater from the collecting system into the Mississippi River. Mayor Franklin stated that it is a statement of facts and hard to dispute. The conclusion of law in the document is that we are not in compliance. Channon moved to approve the Iowa Department of Natural Resources Administrative Consent Order and to have Mayor Franklin sign the document at the appropriate time. Seconded by Paddock. Roll call vote: all ayes motion carried. Fire Chief Floyd Bruns presented the Fire Department Report for November 20 to December 18, 2012. Chief Bruns also presented the Riverdale Fire Department final report for 2012. There was a total of 3233 man hours for 2012. Mayor Franklin thanked the Riverdale Fire Department for all they do. Hupp moved to approve the monthly report and the 2012 yearend report, seconded by Littrel. Roll call vote: all ayes motion carried. Channon moved to set the date for the Riverdale Public Hearing for the 2013/2014 City Budget for February 26, 2013 at 7:00 p.m. Seconded by Hupp. Roll call vote: all ayes motion carried. COMMITTEE REPORTS Mayor Franklin stated that we will have a Budget meeting on February 23, 2013 at 7:00 p.m. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS Mayor Franklin thanked Ed Collins for his time served on the Planning and Zoning Board. Mr. Collins has resigned and Nancy Ulrich will finish out his term. Hupp stated that she had received a call from a resident that the school bus could not get down the road due to the way cars were parked on the street. After the last snow fall the snow was pushed to the curb and making the street narrower. When cars park directly across from each other the street becomes too narrow for the school bus and therefore would not be wide enough for a fire truck to pass either. The council asks that residents be aware and make sure you leave enough room for a school bus or fire truck to get through. Mayor Franklin will talk to our snow removal person and ask that he push the snow as close to the curb as possible. Mayor Franklin stated there was budget material in the packets for everyone to review before the budget meeting next week. There was correspondence in the packets from Russell Royce from the Iowa Department of Natural Resources (DNR). The report is the result of an evaluation of the Municipal Separated Storm Sewer System (MS4). The consensus of the evaluation was that we are in compliance, but there are things we can be doing better. Jared Fluhr will be putting together a better plan for the city to meet all MS4 requirements. Mayor Franklin stated the flag pole at Van Gundy Park has been repaired. Mayor Franklin has installed internet (Ethernet) wiring to the Mayor’s office now. Mayor Franklin thanked the Riverdale Fire Department for a great year. Hupp stated she will be attending a meeting at Western Illinois Campus on the future of biking events in the Quad Cities. Paddock moved to adjourn at 8:07 p.m. Seconded by Channon.
