The Railroad Crossing on Kensington Street in Haven's
Acres will be repaired sometime in May. We hope to
have confirmed dates soon. The 1st day of repairs the
crossing will be CLOSED from 8:00 am to 2:00 pm.
The 2nd day the crossing will be CLOSED 8:00 am to
1:00 pm. You will HAVE to park your cars on the East
side of the tracks if you need to go anywhere during this
repair work.

SEWER BILLING
By now you have noticed that Riverdale is doing the Sewer Billing. I hope everyone will be patient as we go through this transition. I thought I should explain the penalty process
if your bill is delinquent. All Sewer charges are due within 30 days and if not paid within 30 days a $1.00 charge will be added. If the charge is still unpaid after 90 days an additional
$2.00 penalty will be added. This is in accordance to Ordinance 2012-03 Amendment to Chapter 95 of the Code of Ordinances. Any questions please call City Hall.
RIVERDALE SPECIAL MEETING CITY COUNCIL MINUTES
FEBRUARY 26, 2013
Mayor Franklin opened a special session of the Riverdale City Council at 6:30 p.m. on February 26, 2013.
Roll Call:
Present: Channon, Hupp, Paddock, Halsey and Littrel. There were no guests present for the special meeting.
Agenda:
Hupp moved to approve the agenda for February 26, 2013 seconded by Channon. Roll call vote: all ayes motion carried.
NEW BUSINESS:
Hupp moved to approve the Federal Recreational Grant for submittal, seconded by Paddock. Roll call vote: all ayes motion carried. Mayor Franklin noted there may be some minor narrative
changes made.
Channon moved to approve MRT Committee members and Mayor and Council members to attend the Henry Farnam Dinner at the cost of $375.00 for a table of 10. Seconded by Hupp. Roll call vote:
all ayes motion carried.
Paddock moved to approve the Grade Crossing Repair Agreement for the railroad crossing on Kensington St. Seconded by Channon. Roll call vote: all ayes motion carried.
Channon moved to adjourn at 6:42 p.m. seconded by Halsey. Roll call vote: all ayes motion carried.

RIVERDALE 2013/2014 BUDGET PUBLIC HEARING MINUTES
FEBRUARY 26, 2013
Mayor Franklin opened the 2013-2014 Public Budget Hearing at 7:00 p.m. on February 26, 2013.
Roll Call:
Present: City council members Channon, Hupp, Paddock, Halsey and Littrel, Mayor Franklin, City Clerk McIntosh and one representative of the public Jim Beran
Mr. Beran had questions and comments concerning the FY2013 re-estimated revenue, FY2014 expenditures, FY2014 tax rate and the $0.675 / $1000 capital projects levy. Mayor Franklin said
he understood what Mr. Beran had to say and that Mr. Beran wanted to keep the taxes low or to reduce taxes, by reducing expenditures or by eliminating the $0.675 / $1000 capital projects
levy. Mayor Franklin explained that taxes did not go up this year and that the council has worked very hard to keep taxes at the current rate. Channon explained that part of Riverdale
taxes pay for garbage, recycling, and yard waste pickup and city lawn care and that these item as well as other items continue to rise in cost. Mayor Franklin explained that Riverdale
has operated at a deficit for the last 6 to 8 years and that taxes should have been raised as the Machinery and Equipment tax was eliminated.
Channon moved to close the Public Hearing at 8:00 p.m. seconded by Halsey.

MARCH 5, 2013
Mayor Franklin opened a regular session of the Riverdale City Council at 7:00 p.m. on March 5, 2013.
Roll Call:
Present: Channon, Hupp, and Paddock, Littrel and Halsey were absent Also present: Jared Fluhr from MSA and Riverdale Fire Chief Floyd Bruns.

Channon moved to approve the agenda for March 5, 2013 seconded by Hupp. Roll call vote: all ayes motion carried.
Minutes:
Channon made a correction to the minutes dated 02/19/13. In the warrants list it should have stated John Channon – Dishwasher Parts, not Dishwasher Repair. Hupp moved to approve the
minutes from the meeting dated 02/19/13 as amended seconded by Channon. Roll call vote: all ayes motion carried. Hupp moved to approve the minutes from the Special Meeting dated 02/26/13

PUBLIC COMMUNICATIONS TO THE COUNCIL:
Nicole Schueller, from Allied Waste, did not attend the meeting due to the weather.
UNFINISHED BUSINESS:
Jared Fluhr from MSA attended the meeting for an update on the Road Reconstruction Project. Jared stated that Attorney Eric Long has written a letter to Hawkeye Paving’s Attorney and
received a letter from Hawkeye Paving’s Attorney concerning the road project. Jared sent a letter to Riverdale in response to the letters from both Attorneys. Paula will make copies
of the letters as well as the attachments for the council to review. Jared stated there are many misconstrued facts from Hawkeye. Hawkeye has asked for mediation and Riverdale is moving
forward with mediation selection.

Of The City Of Riverdale, Iowa, By Deleting Section 5 (Open Burning Restricted) In Its Entirety And Replacing With Section 5 (Open Burning Restricted). Seconded by Paddock. Roll call

ORDINANCE NO. 2013-01
AN ORDINANCE AMENDING, CHAPTER 105 (SOLID WASTE CONTROL), SECTION 5 (OPEN BURNING RESTRICTED) OF THE CODE OF ORDINANCES OF THE CITY OF RIVERDALE, IOWA, BY DELETING SECTION 5 (OPEN BURNING
RESTRICTED) IN ITS ENTIRETY AND REPLACING WITH NEW SECTION 5 (OPEN BURNING RESTRICTED)
BE IT ENACTED by the City Council of the City of Riverdale, Iowa, as follows:
SECTION 1. Chapter 105 (Solid Waste Control), Section 5 (Open Burning Restricted) is deleted in its entirety and replaced by the following:
105.5 OPEN BURNING RESTRICTED. No person shall allow, cause or permit open burning of combustible materials where the products of combustion are emitted into the open air without passing
through a chimney or stack, except that open burning is permitted in the following circumstances: (IAC, 567-23.2 [45 5B] and 567-100.2)
1. Disaster Rubbish. The open burning of rubbish, including landscape waste, for the duration of the community disaster period in cases where an officially declared emergency condition
exists, provided that the burning of any structures or demolished structures is conducted in accordance with 40 CFR Section 61.145. (IAC, 567-23.2[3a])
2. Flare Stacks. The open burning or flaring of waste gases, provided such open burning or flaring is conducted in compliance with applicable rules of the State Department of Natural
Resources. (IAC, 567-23.2[3c])
3. Landscape Waste. The disposal by open burning of landscape waste originating on the premises shall be subject to the following restrictions:
A. Location Restricted. No person shall burn landscape waste unless the location is at least twenty (20) feet from a property line, any structure, including wooden fences and utility
poles, or within a public utility easement. Burn barrels are prohibited.
B. Time Restricted. No person shall burn yard waste before dawn or after sunset. Open fires of landscape waste shall be fully extinguished at sunset.
C. Attendance Required at Open Fires. A competent adult shall constantly attend all open fires of landscape waste until such fire is fully extinguished. This person shall have a garden
hose connected to the water supply, or other fire extinguishing equipment readily available for use.
D. Fire Chief Authority. The Fire Chief may prohibit all burning under this subsection when atmospheric conditions or local circumstances make such fires hazardous.
E. Igniting Materials. Flammable or combustible liquids, accelerants, or rubber tires shall not be used to ignite any fire.
F. Clearing, Grubbing and Construction Operations. The burning of landscape waste produced in clearing, grubbing and construction operations shall not be permitted. (IAC, 567-23.2[3d])
4. Recreational Fires. Open fires for cooking, heating, recreation and ceremonies, provided they comply with the limits for emission of visible air contaminants established by the
State Department of Natural Resources. (IAC, 567-23.2[3e])
5. The use of burn barrels shall not be permitted.
6. The burning of rubber tires is not permitted.
7. Training Fires. Fires set for the purpose of conducting bona fide training of public or industrial employees in fire fighting methods, provided that the training fires are conducted
in compliance with rules established by the State Department of Natural Resources. (IAC, 567-23.2[3gJ)
8. Controlled Burning of a Demolished Building. The controlled burning of a demolished building by the City, subject to approval of the Fire Chief, provided that the controlled
burning is conducted in accordance with rules and limitations established by the State Department of Natural Resources. (IAC, 567-23.2[3j])
9. Variance. Any person wishing to conduct open burning of materials not permitted herein may make application for a variance to the Director of the State Department of Natural Resources.

SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance
as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

Hupp asked if Riverdale was interested in joining the Quad Cities Convention and Visitors Bureau at the cost of $175.00 per year. Mayor Franklin stated that we were a part of that in
the past and was not sure it was much benefit to the city. Hupp explained that now we are building recreation trails and thought it was a good way to network and build relationships
with other communities. Hupp moved to pay $175.00 for the partnership fee to the Quad City Convention Center, seconded by Paddock. Roll call vote: all ayes motion carried.
Mayor Franklin asked council if they wanted to hire a person for the maintenance position or wait until a later date. Hupp moved to hire James Halsey of Country Living as a private contractor
as needed for maintenance work. Seconded by Paddock. Roll call vote: all ayes motion carried.
NEW BUSINESS:
Channon moved to approve Resolution No. 2013-05 A Resolution Approving The Certification of The 2013-2014 Annual City Budget For The Fiscal Year Ending June 30, 2014. Seconded by Paddock.

Be it resolved by the Council of the City of Riverdale, Iowa:
The 2013-2014 City Budget be approved and the City Clerk is directed to file all pertinent forms and information to the County Auditor and the Department of Management in the State of
Iowa.
Pass and approved this 5th day of March, 2013.
Fire Chief Floyd Bruns presented the Riverdale Fire Department Report for January 15, 2013 to February 19, 2013. Hupp moved to approve the Report for the dates given, seconded by Channon.

COMMITTEE REPORTS
Paddock reported that due to circumstances that she and other council and MRT Committee members were not going to attend the Henry Farnam dinner. Mayor Franklin and his wife will be
attending.
COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS
Channon reported that she had received a call concerning a railroad spike that was standing up and bent in the crossing on Kensington St. Channon did call the railroad and they said
they would take care of it immediately.

PUBLIC COMMUNICATIONS TO THE COUNCIL:
Nicole Schueller from Allied Waste attended the meeting to present Riverdale with a recognition plaque for recycling. Riverdale recycled 53 tons last year and 54 tons this year. Nicole
thanked the city for allowing Allied Waste to be their garbage and recycling haulers.
UNFINISHED BUSINESS:
Hupp gave an update on the MRT Phase II. There was a meeting on March 15, 2013 to review the proposals from MSA Engineering and Shive Hattery Engineering for the MRT Phase II. The committee
will now fill out a ranking form and turn it in to the Iowa Department Of Transportation (IDOT).

Hupp moved to approve Resolution No. 2013-6 A Resolution Delegating Authority To The Mayor To Mediate And Arbitrate With Hawkeye Paving Corporation Regarding Disputed Project Costs.

A Resolution Delegating Authority To The Mayor To Mediate and Arbitrate With Hawkeye Paving Corporation Regarding Disputed Project Costs
Whereas, the City of Riverdale and Hawkeye Paving Corporation entered into an agreement for the paving of certain roadways;
Whereas, the City of Riverdale and Hawkeye Paving Corporation dispute the quality, quantity and cost of certain work performed by Hawkeye Paving Corporation;
Whereas, the agreement between the City of Riverdale and Hawkeye Paving Corporation requires both parties to participate in dispute resolution including mediation and, if necessary,
to arbitration to settle any contractual disputed costs
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF RIVERDALE, IOWA, that the Mayor and the City Attorney are authorized to represent the City of Riverdale in mediation, for
the purpose of settling Contractual disputes.

Mayor Franklin presented revisions to the Bi State Agreement made by Bi-State. Hupp moved to approve the revisions seconded by Channon. Roll call vote: all ayes motion carried.
Paula was contacted by Allied Waste asking Riverdale to change their Spring Clean-Up date which was originally scheduled for May 4, 2013. Hupp moved to reschedule the Riverdale Spring
Clean-Up date to April 27, 2013 with an alternate date of May 18, 2013 if April 27, 2013 was not available. Seconded by Channon. Roll call vote: all ayes
COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS
Mayor Franklin is looking into our salt situation. North American Salt will no longer be using Rock Island as their depot for salt storage. Riverdale will need to find storage for our
surplus of salt.
