Roll Call: Present: Channon, Hupp, Paddock, Halsey. Littrel arrived at 7:45 p.m. Also present Riverdale Fire Chief Floyd Bruns. Agenda: Channon moved to approve the agenda for September 3, 2013 as presented, seconded by Hupp. Roll call vote: all ayes motion carried. Minutes: Channon moved to approve the minutes from the Public Hearing dated 08/20/2013 seconded by Paddock. Roll call vote: Channon – aye, Hupp – abstain, Paddock – aye, Halsey – aye motion carried. Channon found 2 typographical errors to be corrected in the minutes dated 08/20/2013. Channon moved to approve the minutes from the meeting dated 08/20/2013 with said corrections seconded by Paddock. Paddock had spoken with Gena McCullough from Bi-State Regional Commission concerning the Transportation Alternative Program (TAP). This is a grant that Paddock submitted for funds for the MRT Phase II Trail. Ms. McCullough stated that Riverdale was the only city to apply for the TAP Grant in the State of Iowa. The committee will meet mid September and Riverdale will be notified as to whether or not we receive the grant funds. Mayor Franklin spoke with Decker Ploehn, Bettendorf City Administrator, concerning a small triangular piece of land, on the North side of State Street, at Weindruch Road, that is part of Riverdale. Bettendorf has offered to construct the trail across this small piece of property as they move forward with their recreation trail. Resolution No. 2013-15 A Resolution Authorizing The Hiring Of A City Maintenance Employee was read by Mayor Franklin. There was discussion of pay rate and two potential candidates qualified for the job. Paddock moved to table the hiring of a maintenance person for the city of Riverdale until the September 17, 2013 meeting, seconded by Channon. Roll call vote: all ayes motion carried. NEW BUSINESS: There were two proposals for repair or replacing the split rail fence at Bicentennial Park. Hupp moved to table the repair or replacement of the split rail fence until a later date, seconded by Paddock. Roll call vote: all ayes motion carried. Paddock moved to approve the 2nd reading of the Amendment To Ordinance 17.06 Compensation Of Salary For Each Council Member, seconded by Halsey. Roll call vote: all ayes motion carried. Channon moved to approve the 2nd reading of the Amendment To Ordinance 15.04 Compensation Of The Mayor, seconded by Halsey. Roll call vote: all ayes motion carried. Mayor Franklin read the Riverdale Fire Department Report for July 17, 2013 to August 20, 2013. Halsey moved to approve the Riverdale Fire Department Report for 07/17/13 to 08/20/13 seconded by Littrel. Roll call vote: all ayes motion carried. A proposal from Tri City Blacktop was presented for repairs on Bellingham Road for $410.00. Paddock moved to approve the proposal from Tri-City Blacktop for the amount stated, seconded by Channon. Roll call vote: all ayes motion carried. Mayor Franklin presented and read Resolution No. 2013-14. City Of Riverdale Bow And Arrow Deer And Coyote Hunting Rules And Regulations 2013-2014 Season. Moved by Littrel to approve Resolution 2013-14 as read seconded by Halsey. Roll call vote: all ayes motion carried. RESOLUTION 2013-14 CITY OF RIVERDALE BOW AND ARROW DEER AND COYOTE HUNTING RULES AND REGULATIONS 2013-2014 SEASON Bow and arrow deer and coyote hunting is allowed in the City of Riverdale during the period from September 14, 2013 through January 19, 2014, in areas of that City of Riverdale that are designated as a ‘Special Hunt Area’ by the Iowa DNR. Each hunter must comply with the Iowa DNR regulations covering bow hunting of deer and coyote as well as the City of Riverdale deer and coyote hunting rules and regulations outlined below. The hunter must: Successfully complete an Iowa DNR bow hunter education course and proficiency test or its equivalency approved by another State; Hunt on a parcel zoned agricultural or divided in a parcel of not less than three acre, obtain the express permission of the owner of the parcel, and follow the rules and guidelines of the property owner. Maintain a minimum distance of 100 yards from any residence, occupied building, church, city park, street and/or roadway, other municipal property, or school property (exclusive of Scott Community College property, where the hunter must maintain a minimum distance of 100 yards from the College’s buildings and parking lots); Hunt during the hours and days when such hunting is allowed by State or County law or regulation; Use proper field dressing techniques and not leave entrails; Possess all licenses or permits required by the State or County to hunt deer with a bow; Demonstrate compliance with these requirements to any police or DNR officer upon request; and Harvested deer will be checked in at Spruce Hills Dr. Bettendorf Fire Station AFTER 7:30 AM and BEFORE 9:00 PM. Through participation in the bow and arrow season, the hunter agrees that the property owner and/or the City of Riverdale are not liable for stolen deer stands or other equipment and items. The hunter agrees to hold harmless, indemnify and defend the property owner and/or the City of Riverdale in any action or claim resulting from participation in the bow and arrow season in the City of Riverdale. Any violation of the agreement may result in the revocation of permits and/or criminal charges under state and local law, as appropriate. These rules and regulations may be amended or modified by further resolution of the City of Riverdale at anytime. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Littrel stated that he is meeting with the maintenance person from Scott Community College (SCC) on Thursday to discuss the area near Valley Dr. that is owned by SCC and needs to be mowed. Paddock stated there will be a Traffic Engineering Assistance Program (TEAP) meeting on Tuesday September 10, 2013 at 11:00 in Council Chambers. Paddock and Littrel will attend this meeting. Mayor Franklin received an e-mail from Tony Perkins from Hawkeye Paving Corporation stating that Hawkeye Paving will be addressing the warranty work for the road construction project sometime during the remainder of the 2013 construction season.. Mayor Franklin stated that the State Auditors will conduct the Annual Examination for Riverdale in January 2014. Mayor Franklin stated that the hard drive in the city hall computer server failed and has been replaced. Mayor Franklin stated that “Slow Children At Play” and 25 MPH signs have been ordered from Iowa Prison Industries. Mayor Franklin stated that with the influx of new families there are more children skateboarding and playing in the streets. Mayor Franklin and the Council stated that it is a safety issue and wants drivers to take extra care, drive slower and watch out for the children. Littrel stated the sign he put on the slide at Bicentennial Park is missing. Littrel will get another sign and put it on the slide. Halsey moved to adjourn at 8:22 p.m. Seconded by Paddock. Roll Call: Present: Hupp, Paddock, Halsey and Littrel. Also present Riverdale Fire Chief Floyd Bruns. Agenda: Paddock moved to approve the agenda for September 17, 2013 as presented, seconded by Littrel. Roll call vote: all ayes motion carried. Minutes: Paddock made a correction in Unfinished Business. It was stated that Riverdale was the only city in Iowa to apply for the TAP Grant. It should have stated that Riverdale was the only city in the Bi-State Regional Commissions region (area) of Iowa to apply for the TAP Grant. Paddock moved to approve the minutes from the meeting dated 09/03/2013 with the corrections, seconded by Hupp. Roll call vote: all ayes motion carried. Warrants: Paddock’s payroll check was omitted off the Claims List. Hupp moved to amend the Claims List to include Paddock’s payroll check, seconded by Halsey. Roll call vote: all ayes motion carried. Paddock is waiting to hear from Mary Stahlhut from the Iowa Department of Transportation (IDOT) for permission to begin the engineering portion of the MRT Trail. Shive Hattery is working on easements that are needed for the trail. Paddock moved to approve Resolution No. 2013-15 A Resolution Authorizing The Hiring Of A City Maintenance Person, George Miller, seconded by Halsey. Roll call vote: all ayes motion carried. RESOLUTION NO. 2013-15 A RESOLUTION AUTHORIZING THE HIRING OF A CITY MAINTENANCE EMPLOYEE WHEREAS, the City Council of the City of Riverdale (“Riverdale”) has determined that it would be in the best interests of the city to hire an employee to monitor and attend to the city’s ongoing maintenance needs. NOW THEREFORE, BE IT RESOLVED, that George Miller be extended an offer of part-time employment as the City’s Maintenance Employee at a wage of $15.00 per hour plus the Federal mileage allowance whenever his personal vehicle is used for City business. This Resolution shall take immediate effect. PASSED, APPROVED AND ADOPTED THIS 17 September 2013. Bi-State Regional Commission has traffic counters that Riverdale can borrow for the traffic study on State St. and Fenno Road. This traffic count is part of the information required by the Traffic Engineering Assistance Program (TEAP) study to improve the safety of the intersection of Highway 67 and Fenno Road. Riverdale will be responsible for the traffic counters in case they are damaged or stolen. Hupp moved to borrow the traffic counters from Bi-State Regional Commission and to be responsible for them while they are in our possession seconded by Paddock. Roll call vote: all ayes motion carried. NEW BUSINESS: Reconsideration of the proposals for repair/replace the split rail fence at Bicentennial Park was discussed. Mayor Franklin stated he thought replacing the fence was more than a city maintenance worker could do and suggested that we hire one of the companies that provided bids. Halsey moved to hire Creative Deck & Fence to replace the split rail fence at Bicentennial Park in the amount of $2,900.00 seconded by Littrel. Roll call vote: all ayes motion carried. Paddock moved to approve the third reading of Amendment to Ordinance 17.06 Compensation of Salary For Each Council Member. Seconded by Littrel. Roll call vote: all ayes motion carried. AMENDMENT TO ORDINANCE 17.06 The City of Riverdale Ordinance Number 17.06 is revoked and replaced with following Ordinance Number 17.06 effective January 1, 2014: 17.06. Compensation. The salary of each Council member is $3,000 dollars per calendar year. AMENDMENT TO ORDINANCE 15.04 The City of Riverdale Ordinance Number 15.04 is revoked and replaced with following Ordinance Number 15.04 effective January 1, 2014: 15.04. Compensation. The salary of the Mayor is $10,000 dollars per calendar year. Discussion concerning the old Riverdale Command Car and the purchase of a truck for maintenance purposes. Mayor Franklin stated that even though the old Command Car is not reliable enough for the use by the Fire Department for emergency response, the vehicle is in good enough condition for use by the City’s Maintenance Person. At this time, funds are not available for purchasing a used pickup truck as a maintenance vehicle. City Clerk Paula McIntosh presented the Street Financial Report for year ending June 2013. Paddock moved to approve Resolution No. 2013-12 A Resolution Approving The City Street Financial Report July 1, 2012 to June 30, 2013 seconded by Littrel. Roll call vote: all ayes motion carried. RESOLUTION NO. 2013 - 12 A RESOLUTION APPROVING THE CITY STREET FINANCIAL REPORT JULY 1, 2012 TO JUNE 30, 2013. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RIVERDALE, IOWA That the City Street Financial Report for the year ending June 30, 2013 be approved and the City Clerk is directed to file the report in the appropriate manner. PASSED AND APPROVED on September 17, 2013. Mayor Franklin discussed Resolution No. 2013-16 A Resolution Authorizing The City Of Bettendorf To Install A Recreation Trail/Sidewalk On The North Side Of State Street, In Riverdale, From the Bettendorf/Riverdale City Line To Brenny’s Motorcycle Clinic. Mayor Franklin stated that we could not approve this resolution tonight because we need to hold a Public Hearing on the matter. Hupp moved to hold the Public Hearing for the installation of the Recreation Trail/Sidewalk, by Bettendorf, on the north side of State street on October 1, 2013 at 6:30 p.m. seconded by Paddock. Roll call vote: all ayes motion carried. Paddock was asked by Riverdale Fire Chief Floyd Bruns to submit a grant to the Riverboat Development Authority for the purchase of Automatic External Defibrillator’s (AED’s). The Fire Department would like to upgrade the two AED’s from model 500’s to model 1,000’s. Part of the grant proposal is to hold a related Community Event. Paddock suggested that the City provide AED training classes, open to the public, as the event. Paddock would like to install one of the existing AED’s in City Hall and possibly donate the other AED to Pleasant Valley High School or to Scott Community College. Halsey moved to approve the submittal of the grant to the Riverboat Development Authority to replace the two existing AED’s, to purchase two computer tables and to hold a community AED training event for anyone interested in learning how to use an AED. The two tablets are use as AED training aids. Seconded by Littrel. Roll call vote: all ayes motion carried. Hupp moved to approve the Alcohol Renewal for the Riverdale Pub, seconded by Paddock. Roll call vote: all ayes motion carried. Halsey moved to set the date for Riverdale Trick or Treat for October 31, 2013 from 5:00 p.m. until 7:00 p.m. seconded by Littrel. Roll call vote: all ayes motion carried. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Halsey stated that Austin Mason had begun the installation of the concrete bench that he has been making for Van Gundy Park. Austin is working towards his Eagle Scout Rank by doing this project. Halsey had received phone calls regarding burning at Allied Valve. The Riverdale Fire Department checked it out and all was okay. Mayor Franklin stated he had received a letter of resignation, effective January 1, 2014, from Don Fisher, the Chairman of the Board of Adjustments. Mr. Fisher has served on this Board for 10 years and has been an excellent Chair Person. Mayor Franklin thanked Mr. Fisher for all his years of service. Hupp stated that we should budget next year for an appreciation dinner for our citizen’s that serve on these boards, such as the Board of Adjustments, Planning and Zoning and Zoning Inspector. There was a general discussion about the Welch Farm being for sale and how that may impact the City. _______________________ __________________________ John J.
