HomeMy Public PortalAbout1996-04 Amending Chapter 6 Buildings and Building Regulations by enacting Building Permit FeesORDINANCE NO. 96-4 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA AMENDING CHAPTER 6, "BUILDINGS AND BUILDING REGULATIONS," OF THE VILLAGE CODE BY ENACTING SECTION 6-3 "BUILDING PERMIT FEES" TO PROVIDE FOR FEE SCHEDULE FOR BUILDING PERMIT FEES; AMENDING CHAPTER 30 "ZONING" BY AMENDING ARTICLE I "IN GENERAL" BY ENACTING SECTION 30-1 "ZONING AND PLANNING APPLICATION FEES," TO PROVIDE FEE SCHEDULE FOR ZONING AND PLANNING APPLICATIONS; PROVIDING FOR SAVINGS CLAUSE, SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. WHEREAS, the Village is authorized by state law to provide for fees for the issuance of building permits and for the consideration and processing of applications for zoning and planning approvals, including re -zonings, variances, appeals of administrative interpretations and other building, zoning and planning regulatory services provided by the Village; and WHEREAS, pursuant to Sec. 8.04 of the Village Charter, the Building and Zoning fee schedules provided by Metropolitan Dade County have previously been utilized by the Village for the purpose of determining the applicable fees for building permits and zoning applications; and WHEREAS, the Village Council finds that it is necessary to implement a mechanism to enable the Village to establish and adjust, from time to time, the applicable building permit and zoning and planning application fees; and WHEREAS, the Village Council finds that this ordinance shall accomplish such purposes. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS': Section 1. That the Village Code is hereby amended by amending Chapter 6 "Buildings and Building Regulations" by adopting and enacting Section 6-3 "Building Permit Fees" to read as follows: Sootion 6-3 _.:. Savings Clause. The building permit and zoning and planning application fees provided by this ordinance shall replace the building permit and zoning and planning application fees previously provided by administrative order of Metropolitan Dade County for building, zoning and planning services, as made 1 Hi.hl ed::text has been added to existing language; struck through text has been deleted from existing language. 2 applicable by Village Charter Section 8.04, except that such County -provided building, zoning and planning application fee schedule shall continue to apply to building permits which have been granted and zoning or planning applications which have been filed prior to the effective date of this ordinance other than for building, zoning or planning services which are provided after the effective date of this ordinance. Section 4. Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. Section 5. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the Code of Key Biscayne, Florida; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 6. Effective Date. This Ordinance shall be effective upon adoption on second reading.
