All stood for the Pledge of Allegiance. Roll Call: Present: Hupp, Seaberg, Littrel, Halsey and Channon. Also present Riverdale Fire Chief Floyd Bruns and Riverdale Maintenance Supervisor George Miller. Agenda: Channon moved to approve the agenda for July 7, 2015 seconded by Halsey. All ayes motion carried. Minutes June 16, 2015: Halsey moved to approve the minutes for June 16, 2015 seconded by Hupp. Roll call vote: all ayes motion carried. There are delays in these areas due to utility coordination. It was determined that most of the areas were owned by Century Link and some owned by the railroad. Mayor Paddock also stated there was a written update in the packets from Shive Hattery on the MRT Phase II. Pay Application No. 4 from Valley Construction was presented in the amount of $143,739.88. Channon moved to approve Pay Application No. 4 seconded by Seaberg. All ayes motion carried. NEW BUSINESS: Mayor Paddock explained if the MRT Phase II were to cross in front of Brenny’s Motorcycle Clinic at their old location it would eliminate most of the parking area. Mayor Paddock suggested eliminating that portion of the Trail to not infringe on the parking area. Mayor Paddock had spoken with the Department of Transportation (DOT) and they are in agreement with leaving the parking area as is. Halsey moved to not cross Brenny’s original parking area with the MRT Phase II seconded by Seaberg. All ayes motion carried. Channon moved to approve Resolution No. 2015-12 A Resolution Authorizing The Transfer Of Funds For The Fiscal Year 2014-2015. Seconded by Halsey. All ayes motion carried. Resolution # 2015 - 12 A Resolution Authorizing The Transfer Of Funds For The Fiscal Year 2014-2015 Whereas, the City of Riverdale has operational transfers that are budgeted to be made; and Whereas, the City Council of the City of Riverdale, Iowa, wishes to make the needed transfers; and Whereas, the City Clerk/Treasurer has submitted the following list of transfers needed. Section 1. That the City Clerk is hereby authorized to transfer $23.13 from the 2011 Capital Projects Fund to the Capital Reserve Fund and to move $10,000.00 from the Sewer Fund to the Capital Project Sewer Fund. Effective June 30, 2015. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City Riverdale, Iowa, that the City Clerk/Treasurer is directed to make these recommended transfers. BE IT FURTHER RESOLVED, that the Mayor and City Clerk/Treasurer are hereby authorized and directed to execute said resolution. PASSED, APPROVED AND ADOPTED THIS 7 of July, 2015, by the following vote: Hupp moved to set a Public Hearing Date for the 2015 Code Of Ordinances To Be Codified at 7:00 p.m. on August 4, 2015 seconded by Littrel. All ayes motion carried. Seaberg moved to set a Public Hearing Date for the Zoning and Sub-Division Ordinance changes at 7:00 p.m. on August 4, 2015. Seconded by Hupp all ayes motion carried. Littrel moved to approve Resolution No. 2015-13 A Resolution Direction The Clerk To Publish Notice Of Hearing On The Adoption Of The Proposed “Code Of Ordinances Of The City Of Riverdale, Iowa.” Seconded by Hupp. All ayes motion carried. RESOLUTION NO. _2015-13_____ RESOLUTION DIRECTING THE CLERK TO PUBLISH NOTICE OF HEARING ON THE ADOPTION OF THE PROPOSED “CODE OF ORDINANCES OF THE CITY OF RIVERDALE, IOWA” WHEREAS, the City Council has caused to be prepared and filed with the City Clerk copies of the proposed “CODE OF ORDINANCES OF THE CITY OF RIVERDALE, IOWA,” and, WHEREAS, an official copy of the proposed “CODE OF ORDINANCES OF THE CITY OF RIVERDALE, IOWA,” is now on file for public inspection in the office of the City Clerk of Riverdale, Iowa, NOW THEREFORE BE IT RESOLVED that a public hearing thereon will be held in the Council chambers on the 4th day of August, 2015 at 7 o'clock p.m., at which time and place the Council will consider arguments for or against the adoption of the proposed “CODE OF ORDINANCES OF THE CITY OF RIVERDALE, IOWA,” or amendments thereto. BE IT FURTHER RESOLVED that the Clerk be authorized and directed to cause to be published notice of such hearing one time not less than four (4) days nor more than twenty (20) days prior to the date herein established for hearing as by law provided. Passed and approved this 7th day of July, 2015 by the following vote: Hupp moved to approve the Agreement with the Humane Society of Scott County for a 3 year Agreement unless the Humane Society will only approve the 1 year Agreement. If that is the case the 1 year Agreement is approved. Seconded by Seaberg. All ayes motion carried. Littrel approved the purchase of a 2nd bulletin board just like the first one that was purchased to place at the east end of the city hall building to be ADA Compliant for notices posted. Seconded by Halsey. All ayes motion carried. Hupp moved to approve Mayor, Council, or other city staff to attend the Iowa League of Cities Annual Conference to be held in Cedar Rapids September 23-25, 2015. Seconded by Littre. All ayes motion carried. COMMITTEE REPORT: Channon has completed all the changes to the Snow Removal Contract. Hupp mentioned the Kiosks are up to date with Firemen and Veteran’s names. Notify Hupp if there are any other persons that should be included in the Kiosks. Seaberg has called Skyline Tree Service to follow up on a date for the tree removal near the Pelton residence. Mayor Paddock reported that Skyline called and it has been too wet for them to get trucks in that area. Mayor Paddock stated Scharlott Blevins will schedule a final meeting date for the July 4, 2015 event. Mayor Paddock thanked all who helped for the 4th of July event. Littrel stated he will call D&S to get a time scheduled for them to clean our streets. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Littrel thanked everyone that came out to the 4th of July celebration. Seaberg liked the way the Veteran’s were represented in the 4th of July parade. All agreed the music played by Montage for the 4th of July was great. Mayor Paddock stated Bettendorf was doing Storm Sewer work on Belmont Road in Riverdale and forgot to notify Riverdale that work was being done. Bettendorf is paying for all the work being done. The work is due to the State of Iowa inspecting work on the Belmont Road project from 2012 and requiring changes. Channon moved to adjourn at 7:40 p.m. seconded by Seaberg. All stood for the Pledge of Allegiance. Roll Call: Present: Hupp, Seaberg, Littrel, and Channon. Littrel arrived at 7:02 p.m. Also present: Steven Townsend, Riverdale Maintenance George Miller, Tom Sunderbruch, Carol Earnhardt, Diane Holst, and Brinson Kinzer from the Board of Supervisors and Dee Bruemmer, Scott County Administrator. Agenda: Channon moved to approve the Agenda for July 21, 2015 seconded by Seaberg. All ayes motion carried. Presentations: The Scott County Board of Supervisors attended the meeting to give council an update on what is happening in the County. Tom Sunderbruch, Chair of the Board introduced the Board Members, and Dee Bruemmer, Scott County Administrator. Mr. Sunderbruch passed out a leaflet explaining Scott County Services, Scott County Budget, and the goals set for Scott County. Ms. Bruemmer spoke of a program through Bi-State in which the goals are to meet with the big and small communities to recognize each communities IT needs, create a Capital Plan for each community and to create a cost effective way for each community to purchase what is needed in their IT departments. Public Communications To The Council: Steven Townsend stated there are some low spots on the MRT Phase II that need to be addressed. Mayor Paddock stated the Engineers are aware of these areas and will be addressed. Mayor Paddock expressed how pleased she is with MSA, their professionalism and the quality of work they do for Riverdale. Minutes July 7, 2015: Mayor Paddock noted in the Claims List from July 7, 2015 EMC Insurance was listed and the reference stated it was for “Parks Mowing” the reference should have stated “Insurance”. Mayor Paddock noted the Claim for Valley Construction in the amount of $143,739.88 had not been paid. Mayor Paddock received a call from Patrick Lynch from Shive Hattery the day following the meeting. Patrick needed to review that pay application before it was paid. That check has since been voided and the corrected amount is on the agenda for approval including the most recent pay application. Seaberg moved to approve the minutes from July 7, 2015 with said corrections, seconded by Littrel. All ayes motion carried. Warrants: Channon moved to approve the Warrants for July 21, 2015 including Pay Estimate No. 4 to Valley Construction in the amount of $202,475.93 seconded by Halsey. Hupp moved to pay $1,000.00 towards the MRT Phase II loan until paid off. Seconded by Halsey. All ayes motion carried. Century Link and the Canadian Pacific Railroad have been the cause for delay in the project. Change Order #2 from Valley Construction was presented in the amount of $4,385.00. This includes removing two existing concrete traffic signal hand holes that are in conflict with the trail at Manor Dr., furnish and install two new hand holes outside the limits of the trail in this area. Reroute the existing underground traffic signal conduit and wire to the new hand holes; reterminate the traffic cables at the traffic signal poles. Channon moved to approve Change Order #2 seconded by Seaberg. All ayes motion carried. Mayor Paddock presented an update on the Nuisance Abatement at 1010 Valley Dr. with US Bank. Cribbs Landscaping was hired to abate the nuisance. Littrel stated it took two 8 hours days to mow because it was so overgrown. The property was full of thistle and other nuisance plants. NEW BUSINESS: Mayor Paddock presented an amendment to the Agreement with MSA for the Sanitary Sewer Mapping. MSA will require an additional $2,850.00 which includes 20 additional private utility locations and other sanitary and storm sewer mapping that is already in progress. As Riverdale looks forward to land developement along the State St. corridor it will be beneficial to have this area mapped. Seaberg moved to approve the amended contract with MSA for $2,850.00 seconded by Littrel. All ayes motion carried. Mayor Paddock met with Ray Weiser from Scott County GIS to discuss updating E911 addresses and changing Scott Community College part of Belmont Rd. to College Rd. A meeting will be scheduled with Pleasant Valley and Scott Community College at a later date. Channon moved to table Set Date For Public Hearing For The Riverdale 2015/2016 City Budget until the August 4, 2015 meeting. Seconded by Halsey. All ayes motion carried. Channon moved to table Purchase Of A Replacement Tablet until the August 4, 2015 meeting. Seconded by Halsey. All ayes motion carried. A Snow Removal Contract with JKM Concrete for Season 2015 through May of 2016 was presented. Littrel moved to approve the contract with JKM Concrete seconded by Channon. All ayes motion carried. There were changes and revisions discussed regarding Riverdale Community Room Facility Use Agreement. An increase in Room Rate and Deposit is being considered to cover carpet cleaning and wear and tear on the facility. Mayor Paddock will make all the changes and updates and will be presented at the August 4, 2015 council meeting. Hupp and Halsey are going to consider options for flooring in the Community Room and present these ideas at the August 4, 2015 meeting. Hupp moved to table Community Room Carpet and Room Rental Rates and Resolution #2015-14 A Resolution Revising The Policy For The Use Of The Community Room In City Hall to the August 4, 2015 meeting. Seconded by Littrel. All ayes motion carried. Channon moved to approve the Riverdale Fire Department Report for May 19, to June 16, 2015 seconded by Seaberg. All ayes motion carried. COMMITTEE REPORT: Channon received a phone call from a resident stating an elderly gentleman was going door to door offering to paint house numbers on curbs. Mayor Paddock stated there was a person going door to door asking to clean windows. Halsey stated there were people soliciting to blacktop driveways. If you feel you are in danger call 911. Littrel stated D&S will be in Riverdale on Monday or Tuesday to clean Riverdale streets and clean storm drains. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Mayor Paddock state the Humane Society of Scott County agreed to a three year contract with Riverdale. Mayor Franklin explained how the business of the city council meeting should proceed. The Public Communications to the Council occurs only at the time slotted. The Mayor or Council may recognize someone to speak during the course of the meeting. Roll Call: Present: Channon, Hupp, Paddock, and Littrel. Halsey was absent. Issues with traffic control, the large drop off from Windsor to Manor, top soil, trees that have roots exposed, and Mrs. Veit’s driveway. Mr. Paddock stated there are some trees near his home that need attention. Mrs. Veit was also concerned about the fireworks since it has been so hot and so dry. Mayor Franklin stated that Fire Chief Floyd Bruns has been setting off fireworks for 35 years and felt confident that the Riverdale Fire Department and Chief Bruns will have everything under control for our Fireworks Display. Herb Atwood had pictures of weeds at the recreation trail and asked if Council could address that problem. Hupp stated that she had met with Cribb’s Landscaping to give the city a bid of mowing and maintaining the area of the recreation trail. UNFINISHED BUSINESS: Jared Fluhr presented an update on the road reconstruction. A progress meeting will be held on Thursday, July 12, 2012 at 11:00 a.m. Paving on the west side of Manor Drive should be complete this week. Hawkeye notified MSA stating their concerns of meeting the substantial completion date. Hawkeye will most likely ask for an extension of the substantial completion date through a change order at the next council meeting on July 17, 2012. Jared will address the problems with signage. Mayor Franklin discussed the Amendment to Chapter 95 of the Code of Ordinances. It is a simplified version of what we had and part of Davenport and Bettendorf’s Ordinance incorporated into this one. Attorney Long explained that Chapter 95 is the Wastewater Ordinance. Riverdale is amending several sections of that Ordinance. Rates are set by a number of calculations. Some of the changes in the Ordinance are due to Riverdale doing the billing instead of Iowa American Water Company. Mayor Franklin asked that everyone review this Amendment to Chapter 95 to better understand it. Chapter 69 - Parking Regulations Ordinance was again reviewed and discussed. Changes to Section 69.08 were discussed. Mayor Franklin will type those changes in red and these items will be discussed at the next meeting. Review of changes made to Ordinance _______. An Ordinance Amending The Code Of Ordinances Of The City Of Riverdale, Iowa, By Adding A New Chapter, 90-Multi-Use Recreation Trails. This Ordinance will be on the next agenda for the first reading. Littrel left at 8:20 p.m. NEW BUSINESS: Contracts for Small Engineering Projects with MSA were moved to the 1st bullet. MSA would like to set up a General Engineering project with the City so small engineering projects and tasks could be managed more efficiently. For general tasks/projects less than $3,000.00 MSA would work up an estimate, get council’s verbal or an e-mail approval and complete the work without setting up separate individual projects. All the work under the general engineering project would be governed by the terms and conditions that the City Attorney has reviewed and approved. This would reduce the administrative costs for MSA and well as the City. Attorney Eric Long will review the contract and then bring it before the Council for vote. This would not require that the City only use MSA for small projects. Mayor Franklin read the Riverdale Fire Department Report for April 17 to June 19, 2012. Channon moved to approve for those dates, seconded by Hupp. Roll call vote: all ayes motion carried. Mayor Franklin reported that our web site is not currently functional. Bi-State has moved the site to a new hosting company and we can’t upload to the site at this time. The reason the web site does not work properly is because Bi-State does not have the work done. Mayor Franklin appointed Dale Hupp as 1st Assistant Fire Chief, Michael Kleinsmith as 2nd Assistant Fire Chief and Phillips Bowers as Fire Department Administrative Officer (President). Hupp moved to approve these appointments made by Mayor Franklin, seconded by Channon. Roll call vote: all ayes motion carried. Mayor Franklin appointed Sonya Paddock to Parks and to Research which is a new need for the City. Channon moved to approve this appointment, seconded by Hupp. Roll call vote: all ayes motion carried. Mayor Franklin stated the Riverdale City Council would go into Closed Session, Iowa Code Section 21.5 (1) (c): To Discuss Strategy With Counsel In Matters That Are Presently In Litigation Where Its Disclosure Would Be Likely To Prejudice Or Disadvantage The Position Of The Governmental Body In That Litigation. Moved by Channon to go into Closed Session at 9:05 p.m., seconded by Paddock. Roll call vote: all ayes motion carried. Open Meeting was reopened at 9:35 p.m. Mayor Franklin stated that no decisions were made during the Closed Session; discussion, but no action. COMMITTEE REPORTS Channon stated that she is working on the Lawn Care Contract. Hupp has spoken with Cribbs Landscaping about mowing at the Recreation Trail.
