Yard waste is defined as grass, leaves, flowers, stalks, stems, tree trimmings, branches, and tree trunks that come from a Riverdale residence. Anything less than 2 feet in length and less than 2 inches in diameter needs to be in paper bags or containers and must not weigh more than 35 lbs. Larger tree trimmings shall be laid neatl y in tied Bundles with a max. weight of 35lbs. Contractor shall be obligated to collect no more than what can reasonably be expected from a single home per week from each Residential Unit. The City recently applied for a $1000 “TREES PLEASE” grant from MidAmerican Energy. A check was awarded to the City on March 9th. Earlier in the year the City had to take out several pine trees at City Hall due to disease. Riverdale will be replacing the evergreen trees that were removed with a variety of shade producing and evergreen varieties. Trees improve the air quality, block winds, and help with storm water run-off. THANK YOU MIDAMERICAN ENERGY! The City of Riverdale Fire Department was recently given an upgraded ISO Protection Classification Program rating of 03. This is the same rating Bettendorf and Davenport received. The Hearing Pursuant To Iowa Code Section 372.15 On Removal Of Appointee And Possible Action By Council. Michael J. Meloy spoke representing Paula McIntosh. Others speaking in her behalf were JoAnn Hogenson of Bettendorf; Jack Franklin, Batavia, Illinois; Bill Bishel, Port Byron, Illinois; Jeffrey Grindle, Riverdale; Teri Stickler, Riverdale. Michael Meloy presented Council with five exhibits and explanations. Paula McIntosh read a statement. There being no further speakers, 3 Mayor Paddock closed the hearing and stated there are 2 Resolutions presented to the council, Resolution No. 2017 -12 to confirm written order for removal and Resolution No. 2017-12 to revoke a written order for removal. Dean Halsey spoke. Motion by Hupp, seconded by Seaberg, to approve Resolution No. 2017 -12 Confirming A Written Order For Removal of Paula McIntosh as Clerk/Treasurer. The following Resolution No. 2017-12 was read by Hupp in its entirety. RESOLUTION NO. 2017-12 RESOLUTION CONFIRMING A WRITTEN ORDER FOR REMOVAL OF PAULA MCINTOSH AS CLERK/TREASURER WHEREAS, the Riverdale City Council moved to remove Paula McIntosh as Clerk/ Treasurer on February 6, 2017; WHEREAS, pursuant to Iowa Code §372.15, an order of removal was signed by the Mayor Pro Tem; WHEREAS, the written order for removal was mailed by certified mail to Paula McIntosh; WHEREAS, this written order outlines the reasons for the decision to remove Ms. McIntosh from her role as Clerk/Treasurer; WHEREAS, the decision to remove was based upon inattention to detail, lack of effective communication, and cooperation with City Offi cials as learned in the recent audit conducted by the Iowa State Auditor coupled with the prior Final Warning dated September 28, 2016; WHEREAS, pursuant to Iowa Code §372.15 Ms. McIntosh was provided an opportunity to request a hearing before the City Council within thirty (30) days of the written order; and WHEREAS, the attorney for Ms. McIntosh requested such a hearing; WHEREAS, a public hearing was held on March 7, 2017 wherein Ms. McIntosh had the opportunity to present evidence or reasons regardin g her removal; WHEREAS, after the hearing the City Council of the City of Riverdale believes it to be in the best interest of the City to confirm the written Order for Removal of Ms. McIntosh as Clerk/Treasurer. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Riverdale, Iowa that the written Order for Removal of Paula McIntosh as Clerk/Treasurer is hereby confirmed. BE IT FURTHER RESOLVED by the City Council that City staff is hereby directed to give public notice of the opening of the position of Clerk/Treasurer and to solicit applications from those interested. Also present: George Miller-Maintenance, Chris Cooper-MSA, Seth Woods-Woods Construction, Pat & Don Fisher, Karen Metcalf, Ken Hughes, Steve Townsend, James & Carol Tucker, Randy Pribyl, Julie Naab, T. Dalton, Mark Griswold, and JoAnn Welch, Mayor Paddock read the rezoning proposal on the Rezoning Of The Following Described “R-1” Parcels 842333002, 842349002, 842351001 & 842601006AD Known As “The 94.85 +/- Acres Of The Welch Farm” Located At 4742 State Street In The City Of Riverdale, Iowa From “R-1” To “R-1A”. The Mayor asked if any written comments have been received. Recorder Blevins stated written comments protesting the ch ange in zoning from “R-1” to “R-1A” were received from Steven R. Townsend, Julie A. Naab, Harry M. Pelton, Carol J. Tucker, Kayla and Billy A. Briesch. Mayor Paddock asked if there are any comments from attendees. The following comments from attendees are as follows: 1) Julie Naab: I am not apposed to the project but concerned about the lack of notification to the public and that things are being rushed through and do not want extra costs. 2) Mark Griswold: There is another option – Bettendorf annexation. I want this rezoning to happen. 3) Steve To wnsend: was concerned about the process not being followed correctly. He read the current zoning ordinance and stated the certified letter did not include the notation-have the right to protest. The public notice was not published until March 16. I am not against the subdivision or the “R-1A” but do not know what is going on. Mayor Paddock said required publishing was published March 6. 4) Don Fisher: I have no objections to the development but have deep concerns on the access road and that it not be next to my property. 5) Randy Pribyl: I am relieved that it was residential and relieved that it was such nice homes and it will help the tax base with al l these homes, Welches found a real good buyer and looks great to the city. 7) Ken Hughes was conce rned about the access road issue. 8) Carol Tucker said they have lived here because it was a small and a sweet city until a year ago and think it has gone down the tube s now. Three ayes, one abstention, motion carried. PRESENTATIONS: Justin with Simmering Cory, Inc., via speaker phone relayed information on a process of updating the current City Urban Renew al Plan. Justin briefly described the scope of work of Simmering Cory, Inc. which is to update the current Urban Renewal Plan and draft a new plan. Mayor Paddock asked Chris Cooper of MSA for an Engineering Update on the issue of access development to the Welch property. He stated there are three alternatives to the access road explaining each and Seth Woods added the cost for each. Hupp asked if MSA could review the development agreement to avoid later issues. PUBLIC COMMUNICATIONS TO THE COUNCIL: Steve Townsend mentioned the deputy sheriff has been patrolling the city. George Miller stated he requested more patrolling due to items found in the park. Carol Tucker thanked the Council for all the hard work they do. 5 UNFINISHED BUSINESS: 1. Motion by Hupp, seconded by Seaberg to request MSA to draft a proposal for a traffic study and proposal to install an access road on the Welch property next to the farm house . Motion by Littrel, seconded by Seaberg to authorize Mayor Paddock to meet with the insurance agent to review the policy due April 1 and renew the insurance premium. The Mayor mentioned the letter from the ISO regarding the rating UPGRADE from Class 4 to Class 3 of the Riverdale Fire Department which may allow lower insurance rates for both the city and residents. We have not received the written report yet. COMMUNICATIONS FROM COUNCIL AND OTHER OFFICIALS: Mayor Paddock reported the Spring Clean-Up is scheduled for April 29th and the Egg Hunt is scheduled for April 15th. Mayor Paddock thanked Rhonda Hill for notifying the city of the availability of emergency blankets being donated by Calvary Church of Moline that received too many and wanted to donate to other entities that could use them. The city received 9 boxes. There was a n eed to have Per Mar in to look at system. Mayor Paddock received information on the “Crime Victims Rights Week”. – April 4, 2017, for anyone’s interest. Meeting adjourned at 8:49 p.m. MINUTES RIVERDALE CITY COUNCIL SPECIAL MEETING Tuesday, March 28, 2017 Mayor Paddock opened a special session of the Riverdale City Council at 6:38 p.m. on Tuesday, March 28, 2017. ROLL CALL: Present: Linda Hupp, Doug Littrel, Dean Halsey, George Seaberg. Absent: Cheryl Channon. Attendees: Tim Long, Nick Wagner- MSA, Seth Woods - Woods Construction, JoAnn Welch, Teri Stickler, Steve Townsend, Don Fisher, Ann Shoultz, Dale Hupp, Mark Griswold, Jeffrey Grindle. Mayor Paddock explained the reason for the meeting is to review and discuss the Proposed Entrance to the Welch Farm Development. Seth Woods of Woods Construction reviewed the encountered issues at present. After discussion, motion by Halsey, seconded by Littrel to use the Manor Drive entrance. ROLL CALL: Hupp – no, Seaberg – no, Halsey – aye, Littrel – aye. Two ayes, two nays, motion failed. Motion by Seaberg to use the Manor Drive entrance as a temporary entrance during construction and develop another entrance af ter construction using TIF. After discussion, Seaberg withdrew the motion. Motion by Halsey, seconded by Seaberg to table the Entrance to Welch Farm Development issue till the next regular Council Mee ting on April 4, 2017. All ayes, motion carried. Motion by Littrel, seconded by Halsey to hire MSA to submit a preliminary application on the State Street entrance with the IDOT for $500. All ayes, motion carried. Mayor Paddock presented to the Council a preliminary first draft Development Agreement with the Developer and ask ed the Council to review it this week. Mayor Paddock reported attending the Joint Sewer meeting. The 28 -E Agreement is prepared and ready to present to the Attorney for review.
