CITY COUNCIL WORK SESSION, OCTOBER 22, 2018
CALL TO ORDER
In the absence of Mayor Carrie Tergin, President Pro Tempore Ken Hussey called the
October 22, 2018 City Council Work Session to order at 6:00 P.M.
ROLL CALL
The f ollowing Council Members were present for the roll call:
Present: Fitzwater, Graham, Hensley, Hussey, Kemna, Mihalevich, Prather,
Schreiber, and W ard
Absent: Wiseman
A quorum was declared present.
DISCUSS THE CITY CHARTER COMMITTEE’S PROPOSED CHANGES
Ryan Moehlman, City Counselor, informed the Councilmembers that packets had been
distributed and made available for the public, containing the following documents:
- Staff Report Regarding Charter Review Committee Recommendations
- Memorandum Regarding the Charter Review Advisory Committee
Recommendations to Parks Provisions
- Recommendations of Charter Review Committee (10.15.18)
- Charter Review Committee, October 22nd Work Session, Comments from Tom
Sadowski (Charter Review Committee Member)
Mayor Tergin arrived at the meeting at 5:34 P.M.
Councilmembers thanked the Charter Review Committee for their time and hard work
in reviewing the City Charter. The following members of the Charter Review Committee
attended the work session and were available for questions and comments:
- Mark Kaiser
- John Hequembourg
- Carolyn McDowell
Mr. Moehlman presented the following recommendations, allowing for questions and
comments from Councilmembers, Staff, and Charter Review Committee members.
General Changes Affecting Several Charter Provisions
A. Gender Neutralization throughout the Charter

B. Eliminate References to Dates that are No Longer Effective
C. Change the Date on Which Candidates’ Election Qualifications are Measured
D. Capitalize “City” throughout the document when referring to the City of Jefferson
itself.
Specific Changes to Charter
A. ARTICLE III – THE COUNCIL
1. Eliminate Lifetime Term Limits
2. Remove the Requirement that the city clerk reside within City limits, and
give the Council the authority to enact geographical residency
requirements, or none at all, by ordinance . After some discussion, the
following motion was made.
i. MOTION #1: Councilman Mihalevich motioned to direct staff to
draft consistent, geographical residency requirement language for
the city clerk, city administrator, and city counselor positions.
Councilman Fitzwater seconded the motion. The motion passed
unanimously.
3. Relating to Legislative Procedures, amend to clarify and modify rules
relating to bill sponsors and the informal calendar.
i. There was some discussion regarding the Council reviewing rules
and procedures yearly. There was also discussion about removing
the procedures and rules from the Charter (Article III, Section
3.11(e)) and placing them in the City Code.
B. ARTICLE IV – MAYOR
1. Replace lifetime term limits for the Mayor with a limit on serving more than
two consecutive terms.
2. Section 4.1(c) specifying that the Mayor may not hold other City office or
employment with the City.
3. Section 4.1(d) new subsection relating to removal of the Mayor
4. Section 4.4 add new subsection 11, providing the Mayor authority to
remove members of committees, boards, or commission for misconduct
or neglect of duty with the consent of Council.

C. ARTICLE V – CITY ADMINISTRATOR
1. Section 5.1(c) to clarify that the City Administrator’s entire compensation,
not just salary, must be approved by the mayor and majority of the
Council or a two-thirds majority of the Council.
2. Section 5.2 technical changes.
3. After some discussion, and to help eliminate confusion, a suggestion was
made to change to the City Counselor title to City Attorney.
i. MOTION #2: Councilman Fitzwater motioned to draft language that
would change the title, City Counselor to City Attorney.
Councilman Graham seconded the motion. The motion passed
unanimously.
D. ARTICLE VI – ADMINSTRATIVE ORGANIZATOIN AND PERSONNEL
SYSTEM
1. Section 6.6 proposed to change the off ice of City Prosecutor from an
elected office to an appointed office, utilizing and independent selection
committee.
i. MOTION #3: Councilman Hussy motioned to draft language that
would keep the City Prosecutor as an elected position, and add a
removal clause similar to the Mayor’s removal clause in Article IV.
The Council decided to hold off reviewing Article XII – General Provisions, Article XII –
Transitional Provisions, and Parks Provisions until another meeting, at a date and time
to be determined.
PUBLIC COMMENT
There were no public comments at this time.
ADJOURNMENT
A motion to adjourn was made by Councilman Graham, seconded by Councilman
Hussey, and approved unanimously at 7:05 P.M.
