HomeMy Public PortalAbout08/16/77 CCM159 The Council of the City of Medina met in regular session on Tuesday August 16, 1977 at 7:35 P. M. Members present: Mayor, Wayne Neddermeyer, Council members: Arthur Theis, William Reiser, Nancy Laurent, Tom Crosby arrived at 8:10 P. M. Assistant Clerk Sylvia Rudolph, Planning and Zoning Administrator Jeanne Mabusth, Attorney Jeff Carson in Richard Schieffers absence. Nancy Laurent asked that the minutes of August 2, 1977 be corrected as follows: Item 2 to read - an operation which is allowed in that type zoning under a home occupation type business. Signs being used are in violation of the cities sign ordinance. Additions: Consider a 95 ft. State Right of Way, Time Limit Sept. 20th Council Meeting. Motion by Arthur Theis, seconded by Nancy Laurent to approve the minutes of Aug. 2nd. as corrected. Motion carried unanimously. 1. JOHN EISINGER Mr. Eisinger requested a permit to store and repair boats in a barn on his property. Council recommends Zoning Administrator to schedule a public hearing for the Sept. 13th Planning Commission meeting for a Special Use Permit allowing storage of boats in an R-A Zone on Medina Road. 2. STME BENEDICT - Front Yard Variance Motion by Nancy Laurent, seconded by Bill Reiser to grant Heil Enterprises a 20 ft. front yard variance on Lot 19 and 30 ft. of Lot 20, Independence Beach because of the elevation of the property. Motion carried unanimously. Motion by.Nancy Laurent, seconded by Arthur Theis to have Steve Benedict give the city a copy of the purchase agreement in exchange for deed which will enable Mr. Benedict to apply for a building permit. Motion carried unanimously. 3. JANE OGRAN LAND DIVISION Motion by Bill Reiser, seconded by Arthur Theis to approve the Ogram Land Division to develop three -five acre parcels and one 6.2 acre parcel. Motion carried unanimously. 4. ARNE JOHNSON Mr. Johnson asked information of Council to put a temporary mobile home on his building site, Lot 2 Block 1, Hunter Farms. He was advised that a mobile home will be allowed with a 3 month permit. 5. TOM STEVENS - HAMEL WELL Tom Stevens discussed the Hamel Well with Lyle Swanson, the problem with the well is not as serious as presented. Mention was made of increased Electric bill, Lyle Swanson will call Northern States Power to see if the meter is faulty or a clerical error was made. Paul Ogland will flush the hydrants on Wednesday and Tom Stevens will take the readings of the Hamel Well. Ron Duran requested permission from Council to test water main on Mill Street for water leak and also to dig up the street by the Hamel Bank if necessary. Tom Crosby said to do what was necessary to eleviate the problem. 6. MD. BEACH _ LAKE ACCESS AND EASEMENTS Motion by Tom Crosby and seconded by Arthur Theis that the Council adopt the policies approved by the Planning Commission to the memo from Zoning Administrator dated Aug. 16th, 1977 as follows: All members agreed the Lake access easements be retained by the City. 'bracts should remain as "Inconspicuous as they are today". The City must maintain if neighboring property owners do not. The City should repair a stairway (Orth-Nelson) leading to lake and install a single reiling to correct a hazardous condition. The Commission • recommends that street vacations be considered only when physical makeup of land could not support road or in a case where platting would improve property. Motion carried unanimously. IGO 7. AMEND ZONING CODE 26 (A) (1) Tom Crosby requested that the minutes read that the Council discussed the City enforcing and maintaing private covenants, including minimum floor area and concluded the city should not enforce private covenants. 8. MORATORIUM ON BUILDING OF DUPLEXES Motion by Tom Crosby, seconded by Arthur Theis that the Council adlpt a moratorium on the construction of 2 family dwellings in Medina pending clarification of language of zoning ordinance. Motion carried unanimously. 9. BURGESS BOND The Zoning Administrator is to contact Mr. J. W. Goebel, new owner of Burgess Estates, to appear at the Sept. 6th Council Meeting to sign a new performance contract. City Attorney to prepare contract. 10. CITY OF PLYMOUTH - HOLY NAME CHURCH SEWER AND WATER Motion by Tom Crosby to schedule a public hearing for Sept. 6, 1977 at 8 P. M. to discuss the Assessment process for Holy Name Church Sanitary Sewer and Water facilities. City Attorney will make sure requirements of Chapter 429 are complied with. Seconded by Nancy Laurent, Opposing Wayne Neddermeyer. Motion carried. ll NORTH - SOUTH ROAD e Council acknowledged receipt of letter from Tad Jude dated August 16, 1977 regarding North to South Road Connecting Hwy. #12 and #55. 12. BUDGET MEETING Motion by Arthur Theis, seconded by Tom Crosby to set the Budget Meeting for Tuesday August 30, 1977 at 7:30 P. M. Clerk to notify all council persons the day before. Motion carried unanimously. 13. PUTBLIC WORKS DEPT. Nancy Laurent and Ron Duran discussed the need to update the present road grader, the cost of rebuilding the engine would be approximately $5000.00 to $7000.00. Also discussed purchasing a 4-wheel drive pickup to be used for plowing snow, the present pickup is being used almost entirely by Paul Ogland. Ron Duran is to check how much it would cost to rebuild the transmission on the 1972 Tandem Truck. 14. REVENUE SHARING FUNDS Motion by Tom Crosby, seconded by Bill Reiser to agree to comply with rules for receipt of Revenue Sharing Funds. Entitlement Period #9 allocation for Medina will be $15,591.00 Motion carried unanimously. 15, BILLS Motion by Tom Crosby, seconded by Bill Reiser to pay bills. Payroll checks #4603-4610 in the amount of $2,688.25 Motion carried unanimously. 16. BUILDING INSPECTOR Ron Duran is to check into schooling for Building Inspecting for Paul Ogland. City Clerk is instructed to call Loren Kohnen to send resume of past experiences and salary expectations, and also to appear at the Sept. 6th Council Meeting. 17.
