AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA, AMENDING CHAPTER 28 "SIGNS" OF THE
CODE OF THE VILLAGE OF KEY BISCAYNE BY
AMENDING SECTION 28-11 TO PROVIDE FOR AN
EXTENDED PERIOD OF TIME IN WHICH TO CONFORM
WITH THE PROVISIONS OF CHAPTER 28; PROVIDING
FOR SEVERABILITY, INCLUSION IN THE CODE AND AN
EFFECTIVE DATE.
WHEREAS, residents and business owners in the Village have
requested that Council conduct further studies relative to Section
28-11 of the Village Code pertaining to the removal of signs in the
Village; and
WHEREAS, in order to provide for such studies, the Village
Council finds that it would be in the best interests of the Village
to extend the period of time for removal of signs which do not
conform with the provisions of Chapter 28 of the Code of the
Village of Key Biscayne.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE
OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. That Section 28-11(a) of the Code of the Village
of Key Biscayne is amended to read as follows:1
Sec. 28-11. Legal Nonconforming Signs.
(a) Amortization of 1993 Sign Code Nonconformities.
Any Sign that lawfully existed at the time this chapter
[Ordinance No. 93-4] became effective may be continued,
although it does not conform to all the provisions

hereof, provided that no structural alterations are made
thereto and that all such nonconforming signs shall be
completely removed from the premises or made to conform
by MayDecember 31, 1996. If the owner of a Sign can
document the facts that (1) the Sign was installed or
renovated after January 1, 1990, (2) the Sign is in sound
condition, and (3) the cost of such sign or renovation
exceeded $3,000.00, then the Council may extend the
amortization period up to May 1, 1998.
Section 2. Severability. The provisions of this Ordinance
are declared to be severable and if any section, sentence, clause
or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the
validity of the remaining sections, sentences, clauses, and phrases
of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding
the invalidity of any part.
Section 3. Inclusion in the Code. It is the intention of the
Village Council, and it is hereby ordained that the provisions of
this Ordinance shall become and made a part of the Code of Key
Biscayne, Florida; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that
the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 4. Effective Date. This Ordinance shall be effective
upon adoption on second reading.
