The undersigned are neighbors residing on the adjacent lands adjoining the 275 AC park land and have over the previous year enjoyed the permission granted by Ina Dahl to cut and remove dead wood from these lands . We have the necessary four-wheel drive trucks and equipment to cut and remove the wood without damage to the environment. The wood gathered is not to be offered for sale, but is used for home heating. We understand similar permission has previously been granted to others on the park land in the vicinity. If any questions arise or if additional information is needed to grant this request, please do not hesitate to give us a call at 415-493-2211 . Grench, General Manager SUBJECT: Proposed State Legislation Introduction: On January 26, 1977 1 reported to you on the meeting I a-F-d recently attended of the general managers of the four regional park districts in California. I mentioned that proposed State legislation was a topic of discussion. Listed below are some of the legislative items which are being followed. Others will arise during the legislative term. The MRPD Legal Counsel has been given responsibility for legislative matters in the past, and he and I have worked together on them. Proposed Legislation: 1) Proposition 2 of November 1976 - The four districts are fur- nishing each other with information on how the allocation of funds from the recent parks bond act is being handled around the State. An equitable distribution to regional and local programs is sought. The County Supervisors Association of California is supporting a 33 to 50% allocation to regional parks. 2) SB 174 - Guidelines for Roberti Bill grants for parks and recreation are being reviewed by the legislature. There has been some threat to regional parks proposals, as opposed to local proposals. This matter is being followed up on through legislators. 3) SB 174 - Second year appropriation for the Roberti Bill is sought. 4) Secretaries - East Bay Regional Park District may seek a change in the Public Resources Code to clarify the duties of the Board member secretary and the staff member secretary. 5) Misdemeanors - EBRPD wishes to change ordinance or regulation violations from misdemeanors to infractions (see Public Re- sources Code, Section 5560) 6) Protective Zoning - EBRPD is considering seeking legislation which would give zoning powers to regional park districts in, say, a 1000 foot band around regional wilderness areas for site protection. M-77-15 Page Two 7) Exchange of Property - Marin County Open Space District is proposing legislation which would allow an exchange of pro- perty to allow acquisition of in-holdings while giving up non-vital land of equal value. Public hearing and extra- ordinary Board vote requirements would be built in. 8) Election Law - Monterey Peninsula Regional Park District is proposing that the Uniform District Election Law be referred to in the Public Resources Code as the law to be followed where a prodedure is not specifically covered in the Public Resources Code. One example of such use would be a District' s option for an unopposed Board candidate to be appointed and not have to run for election. Another example would be ex- tra filing time if an incumbent doesn't stand for re-election. 9) Claims - EBRPD wishes to allow the approval of demands within the confines of budget by the Controller without the individ- ual claims list approval. 10) Board Members ' Compensation - A bill has been introduced increasing the number of meetings to four per month for which Directors of municipal utility districts may be com- pensated. The East Bay Regional Park District Board may wish their district to be included. 11) Emergency Vehicle Legislation - Our staff is proposing that vehicles used by park district peace officers be allowed emergency vehicle privileges. Last year, the final version of SB 867 which dealt with such vehicles did not cover us. 12) Trails Legislation - A new version of last year' s defunct trails bill SB 969 is being drafted. Each of the districts is interested in this bill. 13) Tax Reform - The districts are quite interested in following the course of tax reform legislation in Sacramento. 14) Emergency Loan Fund - The Districts want to support a pro- posal to set up a $10 million emergency State loan fund so that local agencies can acquire threatened needed park lands. Recommendation: It is recommended that the Board direct Legal Counsel to pursue these and other legislative matters and report back to the Board as appropriate. I would work with Legal Counsel as time allows. Individual Board members may be interested in be- ing responsible for certain legislation, such as trails legisla- tion, where sufficient staff time may not be available. Grench, General Manager SUBJECT: Proposed Amendment to PERS Contract Background: At its November 14 , 1973 meeting, the Board of Directors approved a contract between the District and the Public Employees Retirement System providing for employee membership in PERS. At that time, the employer contribution rate to PERS was 7 . 67% of monthly salaries of District em- ployees. As of July 1 , 1976 , the employer contribution rate was increased to 8.67% . The possibility of decreasing the District's employer con- tribution rate has been investigated by staff. According to an evaluation made by PERS at the District' s request, it appears that the District can "unpool" from the miscellaneous member group it is presently in by adding a Final Compensa- tion benefit not offered to employees belonging to the miscel- laneous member group. The Final Compensation benefit would provide for computation of an employee 's retirement allowance based upon his or her twelve highest paid consecutive months of employment, rather than the thirty-six highest paid con- secutive months as is done for miscellaneous members. When an agency "unpools" from the miscellaneous member group, its employer contribution rate is recalculated based upon the characteristics of its own employees , rather than the charac- teristics of employees from the numerous agencies in the group. Since District employees have the characteristics of being relatively young and having short lengths of service with the District, this among other factors has the effect of decreasing the District's employer contribution rate from 8.67% to 6.155% , while at the same time adding a benefit for District employees. Based upon the $22 ,003 which the District has budgeted for PERS payments in the 1976-1977 fiscal year, this change would result in a savings to the District of approximately $6 ,400 per year. R-77-6 Page two Recommendation: It is recommended that the Board adopt the attached Resolution of Intention to Approve an Amendment to Contract Between the Board of Administration of the Public Employees ' Retirement System and the Board of Directors of the Midpeninsula Regional Park District. Should the Board approve the Resolution of Intention, staff will request the additional documents required by PERS (see attached letter) which will be submitted for further Board approval.
