HomeMy Public PortalAboutOrd. 1367 ORDINANCE NO. 1367 ,~', AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, ESTABLISHING A MORATORIUM ON AUTOMOTIVE RELATED LAND USES (CITY WIDE) FOR A PERIOD OF FORTY-FIVE (45) DAYS. THE CZTY COUNCIL OF THE CITY OF LYNWOOD CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. The City Planning Commission and City Staff are hereby directed to develop an ordinance which will control and direct the location and number of automotive land uses in the City and will report back to the City Council within (45) forty- five days from the effective date hereof, with a written report proposing measures to be taken to alleviate the conditions herein referenced. SECTION. 2. Pending the completion of the contemplated zoning ordinance directed to the City Planning Commission and staff by Section 1 hereof but not to exceed forty-five (45) days from the effective date hereof any land use involving automotive repair or sales in the City of Lynwood is hereby prohibited except those that are in active operation or in the process of obtaining discretionary approval from the City Planning Commission at the time of the effective date of this ordinance. SECTION. 3. The staff shall not issue any business license, building pennits, conditional use permits, variances, site plans or zone changes relating to the use, maintenance operation of land which would be in violation of the provisions of this °" ordinance. SECTION. 4. That any interested person affected by the provisions of this ordinance shall have the right to petition the City Council of the City of Lynwood for relief from the provisions hereof, and the City Council is, upon the proper showing of hardship to the property owner, empowered hereby to provide such relief as is necessary in order to, in their sole discretion, balance the interests of the individual with the interests of the City. SECTION 5. That this ordinance is an ordinance affecting public safety, health and welfare of the City of Lynwood and of the inhabitants thereof and that same shall therefore take effect and be in full force and virtue immediately upon the final passage and adoption thereof. The facts constituting the emergency are that, as stated herein, there is an excessive ^'•;m!`er O° '.and ::=_es reluti::g t0 vii i. uTUiii:i'r~ Yi3ji4ir and Salem WhiCtl have a detrimental and negative effect on the City image. Further, such excessive development in abundance is not consistent with the goals and policies of the City General Plan. SECTION 6. A study has already been undertaken by City staff to determine how the public safety, health and welfare may best be protected by the regulation of such uses and now an ordinance must be written and reviewed by the City Planning Commission and submitted to the City Council for review, consideration and adoption. r~ SECTION 7. Pursuant to the provisions of Government Code §65858, this ordinance shall take effect immediately upon adoption and shall be effective for a period if 45 days unless extended by the City Council, or until such time as the Council determines that the public health or safety is no longer jeopardized by continued construction of automotive related land uses. SECTION 8. The City Clerk shall certify to the passage and adoption of this ordinance and cause the same to be published in the manner prescribed by law. First read at a regular meeting of the City Council of said City held on the 17th. day of December, 1991, and finally adopted and ordered published at a regular meeting of said Council held on the 7th day of January , 1992 by the following vote: AYES: COUNCILMEMBERS BYRD, REA, RICHARDS, WELLS, HEINE NOES: NONE ABSENT: NONE ABSTAIN: NONE ATTEST: Andrea L.
