HomeMy Public PortalAboutOrd. 1333NO. 1333 AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ESTABLISHING A MORATORIUM ON THE CONSTRUCTION, ERECTION AND INSTALLATION OF FREE STANDING SIGNS WHEREAS, recent commercial development in the City of Lynwood has lead to a rapid increase in the number of free standing signs in the City; and WHEREAS, the presence of large numbers of free standing signs can create visual clutter, decreasing the attractiveness of the commercial area and presenting traffic hazards; and WHEREAS, once such free standing signs are installed, the removal of such signs is restricted by state law, which, in many cases, has the effect of imposing a permanent negative effect on the surrounding neighborhood; and WHEREAS, only a stringent and increased implementation and monitoring of the compliance with sign ordinance and conditions of approval will mitigate aforementioned negative impact; and WHEREAS, such implementation and monitoring policy requires an increased expenditure of public funds; and WHEREAS, such increased expenditure of public funds would disproportionately benefit applicants for said signage; and WHEREAS, it is the intent of the City Council to direct the Planning Commission to study an amendment to the zoning ordinance to impose a reasonable fee structure to cover the expenses of a stringent monitoring of the signage conditions; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1: For the duration of this ordinance, no sign permit, building permit, variance or other applicable entitlement for use which is required in order to comply with the City's land use regulations shall be approved for the erection of ar.}' free standing sign, as such term is defined in Section 25-33.1 of the Lynwood Municipal Code. SECTION 2: Notwithstanding the provisions of Section 1 of this ordinance, building permits may be issued for the following work on existing free standing stands: work related to the correction of violations of the City's sign and building codes; minor repairs; work related to demolition of such signs. SECTION 3: Pursuant to the provision of Government Code Section 65858, this ordinance shall take effect immediately upon adoption and shall be effective for a period of 45 days unless extended by the City Council. SECTION 4: The City Clerk shall certify to the passage and adoption of this ordinance and cause the same to be published in the manner prescribed by law.
