HomeMy Public PortalAboutOrd. 1334 ORDINANCE NO. 1334 AN INTERIM ZONING ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA ESTABLISHING A MORATORIUM ON THE DEVELOPMENT AND OPERATION OF FACILITIES PRODUCING, PROCESSING STORING AND DISPOSING OF HAZARDOUS WASTES. WHEREAS, the Lynwood Municipal Code lacks adequate provisions to regulate facilities engaged in the production, processing, storing and disposing of hazardous substances, including wastes; and WHEREAS, it is the intent of the City Council to direct the Planning Commission to study an amendment to the zoning ordinance to update its provisions relating to the development and operation of these type of facilities; and WHEREAS, continued development and operation of these type of facilities can have permanent negative impacts on the surrounding neighborhoods should they be permitted under the current outdated regulations; and WHEREAS, a total prohibition on these type of facilities is.not necessary during the moratorium imposed by this ordinance, because the potential adverse impacts outlined above can be adequately controlled or mitigated through the conditional use permit procedure NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION l: For the duration of this ordinance, no variance, building permit, occupancy permit, or other applicable entitlement for use which is required in order to comply with the City's land use regulations shall be approved for any facility producing, processing, storing and disposing of hazardous sub- stances including wastes, unless a conditional use permit is first issued pursuant to Chapter 25-25 of said code. SECTION 2: Notwithstanding the provisions of Section 1 of this ordinance, building permits may be issued for the follow- ing work on existing public and community uses; work related to the correction of violations of the City's building and housing codes; minor repairs; work related to construction and repair of retaining walls which are not a part of a building; and work related to the repair and/or replacement of heating, ventilation, air conditioning, plumbing, natural gas, and electrical systems. SECTION 3: Pursuant to the provision of Government Code 65858, this ordinance shall take effect immediately upon adoption and shall be effective for a period of 45 days unless extended by the City Council. SECTION 4: The City Clerk shall certify to the passage and adoption of this ordinance and cause the same to be published in the manner prescribed by law. F:zoning • - PASSED.
