AN URGENCY ORDINANCE OF THE CITY OF LYNWOOD AMENDING CHAPTER
9 OF THE LYNWOOD MUNICIPAL CODE TO ADD SECTION 9-4 TO
PROHIBIT FORMATION FLYING OVER THE CITY OF LYNWOOD.
WHEREAS, formation flying at night at low altitudes is
imminently dangerous to persons and property lawfully below
because there is an increase likelihood of an accident due to
spatial disorientation while trying to avoid flight path
obstructions and maintain the formation and the course
simultaneously; and
WHEREAS, noise generated by formation flying at night
disrupts the ability of residents of the City to have quiet
enjoyment of their homes, especially since formation flying
increases the noise levels greatly; and
WHEREAS, beginning in 1989, the duration and frequency
of formation flying has increased to the level necessary to
require a legislative response from the City to protect the
residents from the imminent dangers posed by such flying; and
WHEREAS, because formation flying in the dark is an
"accident waiting to happen", it is necessary to protect the
health, safety and welfare of the residents of Lynwood by
preventing an accident-which would result in substantial property
damage and personal injury to residents of the City.
NOW, THEREFORE, The City Council of City of Lynwood
does hereby resolve as follows:
SECTION 1. Chapter 9 of the Lynwood Municipal Code is
amended by adding thereto Chapter 9 to read:
"ChAPTER 9 HEALTH AND SAFETY"
FORMATION FLYING
Section 9.4 Formation Flying Prohibited.
It is unlawful to engage in formation flying at altitudes of
700 feet or less within the boundaries of the City of Lynwood
between one half hour after sunset and one half hour before
sunrise without prior permission from .the..City Council:
SECTION 2. The number of formation flights has
proliferated in recent months and such flying is reasonably
anticipated to occur in the near future for an indefinite period
of time. This ordinance is urgently needed for the immediate
protection of the public peace, health and safety for the reasons
stated herein and shall become effective immediately upon its
publication.
