HomeMy Public PortalAboutOrd. 1343 ORDINANCE NO. 1313 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ADDING TO LYNWOOD MUNICIPAL CODE OF SAID CITY, CHAPTER 3 DESTRUCTION OR DAMAGE OF PROPERTY (PUBLIC SAFETY REGULATIONS) OF SAID MUNICIPAL CODE PROHIBITING THE DEFACEMENT OF PROPERTY The City Council of the City of L ~, as follows: ~I SECTION 1. That Chapter 3 to be ~' as Chapter 3-17.7 "DESTRUCTION OR the same is hereby added to Title the Municipal Code of said City, follows, to wit: Inwood, California, does ordain known, numbered and designated DAMAGE OF PROPERTY" shall be and 3 (PUBLIC SAFETY REGULATIONS) of and which Chapter shall read as CHAPTER 3-17.7 DESTRUCTION OR DAMAGE OF PROPERTY 3-17.7 DEFACING OF PROPERTY A MISDEMEANOR 3-17.8 PUBLIC SERVICE WORK FOR OFFENDERS 3-17.9 LIABILITY OF MINOR IMPUTED TO PARENT 3-17.10 AUTHORIZATION FOR REWARD 3-17.11 SEVERABILITY 1. 3-17.7 DEFACING OF PROPERTY A MISDEMEANOR. Any person who without the consent of the owner defaces property by paint or other means is guilty of a misdemeanor punishable by not less than five (5) nor more than ninety (90) days in the City Jail. 2. 3-17.8 PUBLIC SERVICE WORK FOR OFFENDERS Any youth found guilty of vandalizing private or public properties shall be required to render public service in the City of Lynwood either in the removal of graffiti or cleanup of alleys, streets or side walks. Hours of service to be determined on a case to case basis. 3. 3-17.9 LIABILITY OF MINOR .IMPUTED TO PARENT. Any act of willful misconduct of a minor which results in the unauthorized defacement of property of another with paint or any other substance shall be imputed to the parents having custody or control of the minor. The parents having custody of said minor shall be liable for all damages so caused by said minor in a sum not to exceed Two Thousand ($2,000) Dollars, in addition thereto said parents shall be liable to the City of Lynwood for any sum which shall have been paid by the City of Lynwood by way of a reward as provided for herein. 4. 3-17.10 AUTHORIZATION FOR REWARD. The Chief Administrative Officer of the City of Lynwood is hereby authorized and directed to pay as a reward Three Hundred ($300.00). Dollars in the aggregate per case where claim for reward is made for information leading to the arrest and conviction of any person who shall deface the property of another with paint or r'^ any other substance without the consent of the owner. 5. 3-17.11 SEVERABILITY. If any section, subsection, sentence, clause or phrase of this chapter is for any reason held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this chapter and the City Council of the City of Lynwood, California, hereby declares that it would have passed this chapter and each section, subsection, sentence, clause and phrase thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION 2. That the City Clerk shall certify to the passage and adoption of this ordinance; shall cause the same to be entered in the book of original ordinances of said City; shall make a minute of the passage and adoption thereof in the records of the proceedings of the City Council of said City in the minutes of the meeting at which the same is passed and adoption thereof, ~, cause the same to be published once in The Wave, a newspaper of general circulation, published and circulated in said City and which is hereby designated for that purpose. SECTION 3. First read at a regular meeting of the City Council of the City of Lynwood held on the 20th day of Marc~fi 1990, and finally ordered published at a regular meeting of said Council held on the 3rd day of April 1990.
