The Council of the City of Medina met in regular session on Tuesday, August 17, 1976 at 57
7:45 P.M.
Members present: Mayor, Wayne Neddermeyer; Councilmen, Donald DesLauriers, William Reiser
Arthur Theis, Robert Franklin; Clerk, Donna Roehl; Planning and Zoning
Administrator, Anne Dorweiler; Attorney, Richard Schieffer
Motion by Arthur Theis, seconded by Donald DesLauriers to accept minutes of July 27, 1976.
Motion carried unanimously

1. DOUGLAS WALL
Mr. and Mrs. Wall and attorney, Harry Coult re -appeared with request for side -yard variance .
Dean Bailey who owns property adjacent to the two 30 ft. lots expressed opposistion to grant-
ing of variances because it would constitute a fire hazard and the fact that he also intends
to build an addition to his house which would leave 10 ft. between the 2 houses.
Sheldon Hoff, owner of the adjacent 30 ft. lot, also voiced his opposistion to the Wall's re-
building and stated that he had offered to purchase the lot from the Walls but they did not
wish to sell. Be also stated that he would not sell his lot to them at the price he had offer-
ed the Walls.
Marie Hopfenmiller stated that she had no objection to the malls' rebuilding and suggested
that they be allowed to build closer to her lot line to allow for extra footage on the side
adjacent to the other 30 ft. lot.
Council discussed Planning Commission recommendation that location of houses on the 2 lots be
staggered to allow for a buffer in case of fire. They did not feel that this was the solution
to the problem. They also discussed cancelling one sewer and water assessment if either owner
should purchase the other lot, or Mr. Bailey and Mr. Wall purchasing from Mr. Hoff.
Mr. Schieffer stated that Council could not deprive property of its value but they must weigh
the hazards irhatltaygr-result from rebuilding.
Mrs. Hopfenmiller approved of the Walls' house being constructed 1 ft. from her lot line which
would allow 5 ft. from Mr Hoffs' lot.
Motion by Robert Franklin, seconded by Donald DesLauriers to grant variance to Doug Wall to
build an A -frame house on the SE of Lot 2, Block S, Independence Beach, with the following
variances: 1. Side yard minimum of 5 ft. on the NW side and 1 ft. on the SE side, average
side yard clearance of 9 ft. on the NW side and 5 ft. on the S.E. side.
2. Front yard set -back from lake of 55 ft. and 55 ft. set -back from road.
Variance granted because of size of lot and inability to combine property with larger neigh-
boring parcels.
Motion carried unanimously
2. GREG SMITH
Mr. Smith appeared, at request of Council, to discuss the possibility of his selling, separ-
ately, a cabin and a house, located on 2 lots at Independence Beach when the property had been
assessed as one unit. Mr. Smith stated that it would be impossible to winterize the cabin and
that it is used very little in the summer. Council agreed that it could be sold as two units
but that a second assessment would need to be paid on the second unit.
3. ANNE DORWEILER
Gordon Tauer
Anne Dorweiler read memo regarding a request from Gordon Tauer to consturct a new home on his
property on Morgan Rd. and to divide approximately 16 acres into 3 bites. At present two
property owners to the North have an easement to use the driveway through his property. Mr.
Tauer stated that the driveway is a 50 ft. wide limerock road and may or may not meet standards
for city roads.
Discussion of location of Morgan Rd. and the fact that it would be very costly to locate on
the section line because of steep embankment to the north.
Mr. Schieffer stated that with roadway easement through the property 3 small lots, of less thai
1 acre, would be created on the westerly edge of property and this may cause problems at a
later date. Be also said that a restriction could be placed on the deeds.
58 Motion by Robert Franklin, seconded by William Reiser to authorize attorney to prepare
road contract to include Morgan Rd, dedication, 30 ft. either side of existing center line and
60 ft. over present driveway easement to include assurance that the parcels west of easement
not be built upon without land being added to them. Also to authorize the engineer to deter-
mine what upgrading needs to be done on the easement and to calculate the acreage of the
parcels.
Motion carried unanimously
Mr. Schieffer stated that he would draw up an agreement and Mr. Tauer could sign it before
the next regular Council meeting as Mr. Tauer would like to obtain a building permit as soon
as possible.
4. INDEPENDENCE BEACH SEWER AND WATER PROJECT, FINAL PAYMENTS
Report by William Reiser and Robert Franklin that they had inspected the project with Leo
Leuer. The minor repairs to manholes may be made within the one year warranty. Discussion
of a water drainage problem on Fern St, and what needs to be done to correct the condition.
Motion by Robert Franklin, seconded by William Reiser to release the final payment to ABJ
Enterprizes.
Motion carried unanimously
Motion by Robert Franklin, seconded by Arthur Theis to release the final payment to GL Con-
tracting, iwth a request that the water drainage problem on Fern St. be corrected.
Motion carried unanimously
Motion by Robert Franklin, seconded by Arthur Theis to ask that Clerk write letters to all
contractors stating that they have done an excellent job.
Motion carried unanimously
Motion by Robert Franklin, seconded by Donald DesLauriers to have Leo Leuer purchase approx-
imately 30 manhole markers at $3.00 each and take the cost out of the construction fund.
Motion carried unanimously
5. FERN STREET LIGHTING
Ron Kath requested that a street light be installed on Fern St. Clerk was asked to con-
tact Northern States Power Co, for a cost estimate.
6. HAMEL WELL
Leo Leuer reported that the Hamel well had been treated in 1971 and again in 1973 and that
38 million gallons of water had been pumped since that time. If treating were to be done it
should be done before November as we can purchase water from Rolling Green Country Club and
they turn off their well in November. Council must also decide if they wish to have the pump
pulled or treat without. Leo has talked with McCarthy Well Co, and will contact other comp-
anies to secure quotes both with and without pulling pump.
7. ELECTIONS
Motion by Wtitbrne:_Neddermeyer seconded by Robert Franklin to employ Diane Dingmann to take
voters registrations on the appropriate days as set forth in State Laws and to pay her and
forthcoming election judges $2.30 per hour.

8. TAX FORFEIT LOTS
Motion by Robert Franklin, seconded by Arthur Theis to ask Hennepin County fora private land
sale for Lot 17, Block 9, and Ni of Lot 26, Block 7, Independence Beach.
Motion carried unanimously
Discussion with Wm. Fenholt of lots he wishes to purchase and costs involved in securing a
Torrens title. Mr. Schieffer stated that an agreement could be written to include buyers
acceptance of the title as would be given by the court.
9. FEE STUDY
The following have been selected to serve on a committee to study fees collected by the
city: Robert Franklin aqpointed William Fenholt
William Reiser appointed Jack Wahlfors
Wayne Nedderme er appointed Tom Crosby
Arthur Theis and Donald DesLauriers will have members by the September 7th meeting.
10. WETLANDS STUDY 5 9-
George Wyse presented copies of wetlands conservation areas study as prepared by the Elm
Creek Conservation District.
11. HAMEL STREET DANCE
Members discussed the recent Hamel Street Dance. Police Chief Hoover reported that there were
no incidents on the street, but 3 accidents may have been related to the event. Underage
drinkers probably had brought their own alchblic beverages into the area undetected. Anne
Dorweiler reported that various Hamel residents are unhappy with this type of affair.
12. INDEPENDENCE BEACH PARK
Donald DesLauriers reported that he would bring a number of barrels to the city shop for use
in parks and other areas where needed.
13. CONTINENTAL TELEPHONE
Dave Penney of Continental Telephone had contacted Robert Franklin and stated that they would
attempt to have the subcontractor return to the Independence Beach area and make the necessary
road -side repairs.
14. DISK AND STEIN REFUND
Motion by Wayne Neddermeyer, seconded by Robert Franklin to refund the Disk and Stein $175.00
overpayment on sewer and water bill.
Motion carried unanimously
15. ASSESSOR
Motion by William Reiser, seconded by Robert Franklin to pay Willis Kohnen and to send him
a copy of the memo prepared by Mr. Schieffer regarding salaries of assessors.
Motion carried unanimously
16. JUSTICE OF THE PEACE RECORDS
Robert Franklin presented to Medina the Justice of the peace records of Melvin and Arthur
Gertz on behalf of Mrs. Gertz.
Motion by Arthur Theis, seconded by Robert Franklin to accept the records with a "Thank You"
letter.
Motion carried unanimously
17. STATE LEGISLATION REGARDING ROADS
Discussion of methods that could be used to determine road -aid money for small communities.
Motion by Robert Franklin, seconded by Donald DesLauriers to ask that Northwest Hennepin
League work toward a change in the formula to secure more Aid monies for small cities.
Motion carried unanimously
18. BILLS
Motion by Arthur Theis, seconded by Robert Franklin to pay the bills. Payroll # 4160-4165,
in the amount of $2106.95
Motion carried unanimously
19. ROAD OIL
Discussion of paying a portion of the bill for road oiling that was done on Willow Dr. N.
Motion by Donald DesLauriers, seconded by Arthur Theis that we not contribute toward the bill
because we are not paying for oiling of any roads.
Motion carried unanimously
20. CERTIFICATION OF SEWER AND WATER BILLS
Attorney will prepare a resolution to be submitted to the county along with amounts of those
bills outstanding.
21. COLONIAL DRIVE IN
Motion by Robert Franklin, seconded by Arthur Theis to have attorney take action on Colonial
Drive In hazardous building that has not been removed.
