Present: Mayor, Thomas Anderson; Oouncilmembers, Wilfred Scherer, Sarah Lutz, William Reiser; Clerk -Treasurer, Donna Roehl; Planning and Zoning Administrator, JoEllen Harr; Public Works Director, James Dillman; Police Chief, Michael Sankey; Eng- ineers, Glen Cook. Paul Pearson, Paul Dries; Attorney, Richard Schieffer Absent: Councilmember, Thomas Crosby 1. ADDITIONAL AGENDA ITEMS Council agreed to discuss the following additional items: City wells, protection device Rolling Green Country Club Hennepin County Landfill Medina Morningside water main and well repair, Repayment agreement Dockside Development letter regarding signs 2. MINUTES OF AUGUST 3, 1982 JoEllen Harr stated that Comprehensive Plan item on Page 93 should read "before October 19th." Motion by Lutz, seconded by Scherer to approve minutes of August 3, 1982, as amended. Motion declared carried 3. PuBLIC WORKS DEPARTMENT Wendy Stuhr Donna Roehl reported tha former part-time employee Wendy Stuhr has made application for un- employment compensation. She stated that she did not know why she had left the city as there was no record available. Motion by Reiser, seconded by Scherer to have Donna Roehl ask Ron Duran for information re- garding Miss Stuhr's reason for leaving. Motion declared carried Water Meters Donna Koehl stated that Public Works Department had contacted North Star Water Works and had been given a price of $43.00 on a plastic water meter. She stated that new meters should be installed in the Medina Morningside area, particularly the cubic foot meters and she presented the meter readings of a specific home as an example of the problems involved in computing bills. Council asked that Richard Krotzer provide more information as to the number of meters that should be changed and advised that the Calvin Headley's be sent a bill averaging several past bills. Ostlund Sewer Lift Station Paul Pearson presented plans for installation of a sewer lift station to serve the Arnold Ostlund property at 4525 Walnut St., Independence Beach. He reported that the installation of the lift station with two pumps would cost approximately $11,000. Donna Roehl explained that the Special Assessment appeal settlement of Mr. Ostlund included the requirement that the city would install a lift station to serve the Ostlund property and that the remainder of the Independence Beach construction funds had been transferred to the Independence Beach Bond fund so there was a sufficient amount of money available for the project. Motion by Scherer, seconded by Lutz to advertize for bids on September 7, 1982 at 10:00 A.M. for installation of a sewer lift station to serve Lots 7,8,9,Block 10, Independence Beach. Motion declared carried Well Shut -Off Switch Jim Dillman stated that four pump shut-off switches burning out as the Medina Morningside pump had done $500 each. Motion by Lutz, seconded by Scherer to request that off switches for the September 7, 1982 meeting. PLANNING AND ZONING DEPARTMENT Demeules Road Paul Pearson reviewed items that needed completion before the city could accept Cheyenne Tr. as a city street: A one inch bituminous overlay as a leveling course, now changed to a one and one half inch overlay with surface reduced from 25 ft. to 24 ft. to allow for repair of curb. Maintain a$25,000 bond for one year; a $12,500 bond after that until 2/3 of the homes or 6 houses are constructed. Developer to provide city with location of a privately owned drain tile line which bisects Parcels B and J. Developer should be required to seal coat street after approximately three years at a cost of approximately $5400. Tom Budzinski,representing the developer, stated that items being discussed were not in- cluded in the Development Contract nor in the letter from Engineer, Lyle Swanson. He stated that the engineer should have been inspecting the project as it progressed and corrections should have been made during that time. The street contractor stated that he had received a list of corrections during the fall of 1981 and had completed them and did not expect to receive another list. Thomas Anderson stated that he did not want the citizens of Medina to pay for repairs and would not accept a road that might not hold up. The contractor stated that if a road is constructed according to city specifications then the city should accept the road and not expect a developer to do more than the specifications require. Mr. Budzinski stated that they to get such a road; also if a repairs. Thomas Anderson stated that if want a good street and they want to know what needs to be done city snowplow wrecks a road does the developer need to pay for a city would wreck a curb the city would repair. Richard Schieffer stated that the city should not accept the road without a bond to guar- antee it for a couple of years. Thomas Anderson stated that there is a disagreement as to whether or not the road has been built properly and the developer should take the letter, work from it, or come back on September 7th. Tom Budzinski stated that he could not commit to a long term bond on behalf of Mr. Deineules. Motion by Lutz, seconded by Scherer to table action on the Demeules road, at the request of the applicant. Motion declared carried Co$ Rd. 116, North -South Road, 8:30 P.M. Jo llen Hurr reported that legal notice 21st and an article had been written for ing Co. Rd. 116 to connect to Hwy. 12. She stated that she had information from Comprehensive plan includes reference to had been published in the Crow River News on July the same paper regarding the possibility of extend- 1973 regarding a possible extension and that Medina's such a route. Vern Genzlinger, representing Hennepin County stated that a road is not in the counties 5 year program; that the plan is added to each year with the first step to be taken is the establishment of alignment, which the city is now being asked to do. Police Chief Sankey stated that if road was installed the emergency resRonse time would be cut from 8 minutes to 5 minutes between Medina Morningside and Hamel. e stated that the majority of ambulance calls are to Medina Ballroom and with the ambulance responding from Long Lake the route is either Hwy 12 to Co. Rd. 29 or Hwy. 12 to Hwy. 101, never the gravel roads. Jim Di11man stated that there is a lot of traffic on graveled roads and a blacktopped thru street would mean less maintenance on graveled roads. Doug Knudsen, 1460 Willow Dr., asked what the traffic counts were for Co. Rd. 24 and 6. Mr. Genzlinger stated that Co. Rd. 6 had 6500 trips per day; Hwy. 12--14,000; Hwy. 55-- 13,00 and Co. Rd. 24--1900. Don Conley, 2352 Co. Rd. 24: Who is asking for this and for what compelling reason? Thomas Anderson stated that the city has asked for the road; it is needed for health and safety reason; it had been included in the cities comprehensive plan; a lot of roads in the city are in bad shape and cannot be maintained properly, especially in the spring. Dave Iverson, 2235 Co. Rd. 24: Would there be traffic controls at Co. Rd. 24? Mr. Genzlinger: There would probably be a stop sign on Medina Rd. John Prest, 1575 Willow Dr.: I am opposed, do not need to add to traffic nor spend more money. Dennis Hagen, 2422 Morningside Rd.: This is a rural area not a lot of heavy thru traffic. Why couldn't billow Dr. north and Hamel Rd. be upgraded? Kathleen Hansmann, 2482 Holy Name Dr.: Speaking as the secretary of the Northwest Suburban Chamber of Commerce, the Chamber of Commerce reaffirms its posistion of 1977 asking for a north -south road. Bob Mitchell, 1745 Willow Dr.: I think that this is a poor idea; long range plans of the State are to upgrade Co. Rd. 116 to a Hwy. 100 status. Janet Conley, 2352 Co. Rd. 24: Are there developers interested in any of this land, at this time? JoEllen Hurr: No one that I am aware of. Phil Zietlow, 875 Co. Rd. 24: The Planning Commission spent a lot of time on the Compre- hensive Plan trying to keep it rural I do not remember that the Planning Commission ever wanted this road upgraded. I propose a volunteer committeebe organized to handle emergencies. Agnes Kukacka, 3575 Pinto Dr.: Has the County purchased property from anyone at Hamel Rd. as surveying has been done? Ms. Hurr: Northwestern Bell has given a 7 ft. road easement along their property. Rose Anne &onei, 1462 Willow Dr.: Ten years ago this project was discussed and nothing came of it. Road in front of my house is 24 ft. wide; how much work would be done on the 80 ft. right-of-way; Also hills act as noise barriers, what grade is planned? Mr. Genzlinger: We did not lay grades south of Willow Dr. but the road would need to meet the 45 mph criteria. An 8 ft. shoulder and ditches are needed. Fred Keller, 1255 Willow Dr.: Has Orono been involved? JoEllen Hurr: They have not. Bob McCrea, 1532 Willow Dr.: We moved to Medina to get away from the city, a thru-way does not maintain a rural atmosphere. Don Conley, 2352 Co. Rd. 24: How can citizens express themselves if they are opposed? Could the question be put on a ballot? Richard Schaeffer: Opinions are expressed through Public Hearing, such as this. If the question were to be put on a referendum I would want to get the Attorney General's opinion. LuoY Mitchell, 1745 Willow Dr.: If approved Medina would have a thorofare such as Co. Rd. 116 north of Hamel. Polly McCrea, 1532 Willow Dr.: We moved to Medina with the full understanding that fire and ambulance service would not readily be accessible. Doug Knudsen, 1460 Willow Dr.: I am opposed because of cost to taxpayers. Ken Hammerschmidt, 2455 Bobolink Rd.: This is a rural area; graveled roads should be up- graded to accomodate traffic. Dave Iverson, 2235 Co. Rd. 24.: I am opposed. In looking at the map the road goes through my house. l0 0 Ron Rogers, 2152 Medina Rd.: The County wants the City to approve this route; it may be needed at some time; Hennepin County should given a committment as to the time a road may be built. I have not heard of any alternative routes, should a straight road be looked at? Mr. Genzlinger: Under State law the county cannot build a road without city approval. Mr. Anderson: Could this be put into the County's five year plan? Mr. Genzlinger: The County Board sets the plan. Emil Jubert, 1182 Hwy. 55: Several years ago I and several other residents attended meetings for designation of a route. Don Conley, 2352 Co® Rd. 24: This is a small sample of points of view, it should be put on a ballot. Bob Roehl, 1735 Medina Rd.: I do not object and I have property on both sides of Medina Rd. I also have driven 40 years on gravel roads and have wrecked about 35 oars. Emil Jubert, 1182 Hwy. 55: Another reason road should be centrally located is for fire protection and the fact that a fire department may be located near the City Hall, some day. Bruce Neumann, 25 Hamel Rd.: I am opposed. Trained firemen from Hamel are never called out in emergencies. Jim Tiller, 145 Hamel Rd.: Let's get some return for our County tax dollars. A North -South road would benefit all people living in Medina. RoseAnne Eppel, 1462 Willow Dr.: Do you have a cost estimate? Mr. Genzlinger: Cost has not been determined. Ken Hammerschmidt, 2455 Bobolink Rd.: What papers are legal notices put in? Mr. Anderson: Crow River News. We will also use our community newspaper that will be put out shortly. Sandra Vrooman, 1475 Blackfoot Tr.: Items such as this will be included in a newspaper that will be published once a month. Clyde Libby, 2232 Co. Rd. 24: When the County finds out how much this road will cost the road will be further away than we think. I do not believe the need is here for a road. Donna Roehl, 1735 Medina Rd.: In looking over the addresses of those who have spoken I find that the people who are opposed to the road now live on an upgraded street; no one who lives on a gravel road has spoken against it. Ralph Anastasia, 1400 Co. Rd. 24: The need for a road is not the magnitude that we are talking about here tonight. I drive twice a day to Hamel on gravel roads. Phil Fettig, 960 N. willow Dr.: I live in urono and would like to know what they will do at Hwy. 12. Mr. Genzlinger: Traffic counts would be done and signals may be needed. Doug Sorenson, 2645 Morningside Rd.: It took a long time to get the signals at Hwy. 12 and 01d Crystal Bay Rd. at a cost of $300,000. Bruce Neumann, 25 Hamel Rd.: There still is a road easement from Hamel Rd. to Medina Rd. connecting Tamarack Dr. Motion by Reiser, seconded by Scherer to close the Public Hearing. Motion declared carried Public Hearing closed at 9:30 P.M. Motion by Scherer, seconded by Lutz to table action on road alignment for Co. Rd. 116 extension. Motion declared carried Wright -Hennepin Electric, Street Lighting Joq1en Hurr stated that there were several alternatives available to the city to hand1 street lighting charges and asked that she be allowed more time before Council would make a decision. Neil McMillin of Wright -Hennepin Electric, stated that it would be a hardship for the Co-op if it had to contract with all developers. Police Chief Sankey stated that perhaps ornamental lighting may not be needed. Thomas Anderson stated that he would not want to pay more for one kind of light than another. JoEllen Hurr stated that perhaps the developer could pay for taking out the ornamental lights. Neil McMillin explained that eight alternatives had been put together for the Board of Dir- ectors and they had decided on the three that were being proposed. Mr. Anderson stated that if the developer were to pay the difference in costs at this time the City would then pay the same fee as is being charged for other street lights in the city. Mr. McMillin stated that an agreement could be madft whereby the city would purchase the orn- amental lights and then maintain them with Wright- ennepin Electric charging a monthly feed - charge fee. Donna Roehl stated that the city pays for additional street lights that Rolling Green Country Club had requested and bills them once a year. Mr, Anderson stated that something should be worked out that would be fair or the ornamental lights should be taken out. JoEllen Hurr stated that she would continue her research. Displaymasters Jo611en Hurr reported that Displaymasters would not need encroachment from front yard set- back as they would be getting fill material from the Hicks concrete project across Tower Dr. 5. INFILTRATION -INFLOW ANALYSIS REPORT Paul Dries of McCombs -Knutson explained in detail the I and I report they had prepared in- dicating that approximately 77% of the water flowing into the Hamel treatment plant is clean water resulting from faulty sewer lines, manholes and sump pumps. He reported that work done 1979 and 1980 had failed to correct the problems in the manholes. He explained that the purpose of the study is to provide background for securing grants to correct the problem; that the report would be sent to Metro Waste Control the PCA and the EPA; if grants are secured Federal share would be 75%, State share, 15% and City share of costs would be 10%, with no approval before 1983. JoEllen Hurr suggested waiting to see what Metro Waste plans to do with the interceptor. Paul Dries stated that the interceptor would run along Hamel Rd. from the lift station near the treatment pond. Sarah Lutz stated that she would went Glen Cook to look at the report before it was approved. Glen Cook suggested submitting it as it had been prepared. 6. POLICE DEPARTMENT Typewriter and Dictaphone Police Chief Sankey explained typewriter typewriter an SCR at a cost of $550. and contract of "208 per year. Motion by Reiser, seconded by Lutz to aut ine, as outlined by Chief Sankey. Motion declared carried and dictaphone he would like to purchase; the the dictaphone a Lanier at $1421.25, plus a service horize purchase of typewriter and dictaphone mach - Police Reserves Police Chief Sankey stated that an organizational meeting had been held with seven interested Reserve candidates. He stated that some are trained and the program would begin at a time when Hennepin County could train the remainder. He stated that the Northwest Suburban Chamber of Commerce will be responsible for the uniforms and that there should be no other capital expenses. Union Contract Chief Sankey stated that the proposals for contract would be completed in about two weeks. 102 7. CABLE TV Thomas Anderson reviewed terms of resolution regarding agreement for Cable TV. He stated that Medina's share of expenses would be S1600 which would be reimbursed by a company if one were accepted. He also stated that Medina would have two votes on the board. He recommended signing the agreement as Medina is part of a group and may not see Cable TV if it does not continue with this group. Richard Schieffer stated that he would like to research legality of payment ,of the S1600 when no service has, as of yet, been received. Motion by Scherer, seconded by Reiser to table action on Cable TV agreement pending City Attorney calling Attorney Tom Creighton. Motion declared carried 8. ST. ANNE CATHOLIC CHURCH LICENSE Motion by Reiser, seconded by Scherer to grant a non -intoxicating malt liquor license to St. Anne's Catholic Church for Sunday, August 29, 1982 from noon until 6:00 P.M. Motion declared carried 9. ROLLING GREEN COUNTRY CLUB Richard Schieffer stated that he had attended the August llth hearing and a decision may not be received from the judge before August 31st which is the deadline for settlement under terms of the agreement with Medina. He recommended extending the deadline until the September 7th meeting. Motion by Lutz, seconded by Scherer to table action and extend the agreement date with Rolling Green Country Club until September 7, 1982. Motion declared carried 10. MEDINA MORNINGSIDE/PARK FUND REPAYMENT AGREEMENT Discussion of terms of agreement, interest rate and amount that needs to be borrowed from the Park Fund for repairs to the Medina Morningside water system. Motion by Reiser, seconded by Scherer to adopt Resolution 82-21, repayment of $33,000 to the cities Park Fund from Medina Morningside Water at 11% interest for 7 years. Motion declared carried 11. HE NEPIN COUNTY LANDFILL JoEllen Hurr stated that the Metropolitan Council has told Hennepin County to provide them with the names of three more sites and that Baker Park would probably be considered again. She stated that the city should coordinate with citizens groups if the Council wishes to oppose. 12. ILLEGAL SIGNS Richard Schieffer presented Council with a copy of a letter he had sent to John Spaeth regarding off premises signs that are not allowed under city ordinance. Emil Jubert reported that the Loretto Hardware shign at Hwy. 55 and Co. Rd. 19 had been removed. 13. BILLS Motion by Reiser, seconded by Scherer to pay the bills; Order Checks # 1451-1454 in the amount of $1168.49 and Payroll Checks # 6777-6787 in the amount of )5133.36. Motion declared carried 14. JUNK ACCDMULATION JoEllen Hurr was asked to look into various sites in the city that have become unsightly and proceed with having them cleaned up. Motion by Scherer, seconded by Lutz to adjourn.
