Upon motion cf Mr. Broeman, seconded by L:r. Fa lkner, the
minutes of the previous meeting of Larch 2:,, 1;»61 were atproved as
submitted.
Hr. Andercon informed the Council that they shoulo canvas
the election returns fur the election helu April 4, 1961. Thereupon,
the Village Clerk JC Clerk of the election; :Bade the fallowing retort.
At the recent council election 42 voters, being 27.9x of the 168
registered voters, took part in the election. The votes were counted
by myself and election clerks, Helen H. Cilman and nancy A. Landis, in
the presence cf witnesses and found the vote to be as follows: frank
C. }fart, Jr. 32; John F. Beatty 31; Fred Faulkner 27. Thereby ;:Ir. Dart
and Mr. 3eatty will serve until the electich in 1969 and Hr. Faulkner
will serve with Hr. Broeman and Mr. Hhite until 1963. Cla motion of
Mr. aroeman, seconded by i.r. Faulkner the report was unanimously ac—
cepted. The oath of office was then taken by .:r. Bart and Mr. Faulkner.
Mr. Broeman moved that the organization of the Council which
was attempted at the organizat.icn meeting held April 17, 1901 be con—
tinued until the full council is present and that the present officials
as members of the council continue in office until that time. The
motion was seconded by Mr. Faulkner and unanimously voted.
Mr. .iebb read a letter from Mr. Larion Butler regardi,.y a
sign on Lot 13 of the Cceau front election of Bay Harbor. Mr. Butler
appeared before the Council and explained that the present, sign of 6u
square inches is not large enough to be seen from the street. After
discussion the Council agreed that in a hardship case a larger sign
could be permitted on a temporary basis and instructed Mr. Butler tc
write a letter tc the Council saving the sign would be removed b. him
within 9c days. It was moved by Kr. Faulkner., seconded by MI. Broeman
and unanimously voted to permit a temporary sign to be placed on Lot 13
for 90 days not larger than 2' by 3' with the words "temporary permit
.;rdinance +r37" to be shown in small letters at the bottom of the sign
in addition to other wording to be approved Ly
Mr. ebb introduced Mr. Richard L. 'Brady and Mr. Tracy B. hare
who represent a group of medical :yen interested in operating a diagnostic
clinic in the Bal harbour Hotel. .oebb read a letter eutlihing their
plans. Mr. Brady spoke briefly to the Council explaining that IL .weulU

not be a health spa and there .could be GC ahLul;r:,ces, nurses or faci—
lities for treatment. The diagnostic clinic would use It rooms of
the Lal Harbour hotel which would include consultant rcorns, x—ray
rooms and laboratories. It is intended for executives of corpora—
tions wl.o desire a coapi?te physical examination and vacation at the
same time. There wculcd Le no advertisi;ig but a personal approach
through the ,aedicel ditectorc of different corporations would be
used. Lr. Brady and Cr. rare were questioned by i.:r. Broeman and thc.
other .members of the Council ;.s to type of operation, services ren—
dered, who would Le eligiLle for these services aid tie opinion of
the local medical society. After discussion :'.ayor hart asked for
Anderson's opinion and he advised tae Council that the indivi—
duals connected with the plan had met with him. He cautioned the
Council that the individuals applying w uld he immaterial to the
Council and stated there is no provision in Mao ordinance permitting
such an operation although it has been a time honored practice of
hotels tc have some medical assistance on hand to treat guests if
necessary. ilr. Andersen advised the Council that the first step
would be to amend the ordinance to permit in certain restricted arcs
the use as proposed in this hotel and that it couldn't be confined
tc the 381 }arbour Hotel but must be a law of general operation and
application. After further discussion i,a,yor Part asked Lr. Andersen
for a written opinion on the matter by the next ccuncil meeting and
suggested that it be tabled until a council meeting could Le arranged
with a full panel present at which time kr. urady will be invited tc
appear.
Mr. ';;ebb advised the Council that three bids fcr construc—
tion of the storm sewer pumping station to le located in an easement
in Tract "E" of the Residential Section of :3a' liarbc.ur had Leen re—
ceived. The total cost will be 1:2G,36L.00 which is well within the
initial figure mentioned at a council neetin.r some months ago. The
low bid of $12,740.00 offered by Intercounty Construction Company
was submitted for the actual installation and building of the under—
ground vault with Bal Harbour Village furnishing the equipment. The
other bids were as follows:
$13,620.00 offered by Atlantic Foundation Company, Inc.
$15,000.00 offered by Reed Construction Corporation
Mr. Broeman moved that if in the opinion of the Villaga
Lrana.ger the bids axe the best that can be obtained, then on his recom—
mendation the Council authorize him to get the work done as soon as
possible to be paid out of our contingency fund. Seconded by G.r.
Faulkner, unanimously approved.
The next item of business on the agenda was Resolution
No. 79 regarding a new county. 11r. Broeman, who attended the Legis—
lative Session explained the situation in Tallahassee as they found
it when they appeared last week in behalf of this Bill. Mr. Broeman
moved that the Council accept Resolution No. 79 as presented by the
Village Aitorney and present copies to the proper authorities. The
motion was seconded by Mr. Faulkner and unanimously approved.

Mr. Webb read a letter from the betropolitar, Advisory Board
requesting permission to meet with the Council and discuss the overall
zoning cf Dade County. After discussion he was instructed tc invite
them tc the next regular council meeting to be held on Lay 27th, 1961.
A copy of the six month audit was given to each councilman.
Mr. Hebb advised the Council that Bal Harbour Village was i.0 good finan—
cial shape and balance, kr. Faulkner move] to accept the six month
audit as submitted by the Village iianager. The motion was seconded l;y
Mr. droeman and unanimously adopted.
There being no further business. Faulkner moved to adjourn
which was seconded by b:r. Broe:m.

A continuation of a special 'Council meeting called April 17,
1961 was held May 10, 190] at 9:30 A.;.;. ;,, the Vi11a 3e ,.all for the
purpose cf electLr a P_ayor and Assistant sayer.
Present: heasrs. Dart, Beatty, i roe:aan and Jhite
Absent: r. Faulkner
Also present were Mr. W. H. edebt:, Village LSanagur; Lary r.
netterer, Village Clerk; and Thcm.rs H. Anderson, Village Attorney.
Mr. Richard E. Brady appeared in behalf of a nroup of medical
men who are interested in operating a diagncstic clinic in the Dal
Harbour hotel. sir. Anderson advised kr. Brady that the Council had
voted tentative approval to the plan which '.:r. iirady had presented
tc the Council at their .meeting ou April 25, 1961 but that it would
be necessary to dray up au crd;nance to cover this new field as far
as the hotel is concerned. Mr. Anderson said he will furnish each
councilman and ,;r. 3rady a copy of the ordinance for study so that
action can be taken on the ;natter at the next regular Council meet—
ing to be held en bay '27, 1961 at which tine kr. Brady was reque:.ted
to appear.
