HomeMy Public PortalAboutOrd. 1307 ,~ ~'. a ORDINANCE NO. 1307 AN URGENCY ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, PROVIDING FOR THE INTERIM REGULATIONS FOR THE POSTING, HANGING AND DISPLAY OF BANNERS ON AND OVER PUBLIC STREETS, AND AMENDING SECTIONS OF THE LYNWOOD MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. The City Council of the City of Lynwood does hereby find and determine as follows: (a) That the City Council has heretofore adopted a Resolution prohibiting the hanging or display of any banners other than for City approved events. (b) The City has received a claim against it in connection with the application and enforcement of its Resolution on the grounds that such constitutes a violation of rights under the First Amendment to the Constitution of the United States. SECTION 2. The City Council of the City of Lynwood has hereby adopted the following regulations by adding a new Division 4, to Article III of Chapter 3 of the Lynwood Municipal Code: "DIVISION 4. STREET BANNERS" Section 3-72 Posting in Public Places Unlawful. It shall be unlawful to paste, paint, print, hang, imbed, nail, tack, staple, or otherwise fasten any card, banner, handbill, sign, poster, advertisement, or notice of any kind on any curbstone, lamp post, tree, pole, post, hydrant, bridge, monument, lawn, or parkway located upon or in a public street, sidewalk, walkway, park boulevard, or parkway, maintained by the City or any property of a public utility maintaining such property under easements granted by the City, except as specifically permitted by this chapter. Seci:ion 3-73. Exceptions. The previsions of Section 3-72. of the chapter shall not apply to any of the following: (a) Public notices posted pursuant to law, signs erected by public agencies and public utilities, informational, directional, and warning signs required for the protection of the public health, safety, and welfare, or other signs or notices required by law; (b) Signs posted by or at the direction of any City officer or employee, and announcing City-sponsored activities and events. rosLea in violation of Laws. Any City official designated by the Administrative Officer shall have the authority to remove any sign posted on public property in violation of this chapter after 24 hours notice to the party responsible to remove the same. SECTION 3: By reason of the foregoing findings, this Ordinance shall take effect immediately upon passage hereof. SECTION 4: The City Clerk shall certify to the passage and adoption of this ordinance, and cause the same to be published in the manner prescribed by law.
