ORDINANCE NO. 1315
AN INTERIM ZONING ORDINANCE OF THE CITY
COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA,
ESTABLISHING A MORATORIUM ON PUBLIC AND
COMMUNITY FACILITIES
WHEREAS, the provisions of the Lynwood Municipal Code
regulating public and community facilities are outdated; and
WHEREAS, City staff is informed that public entities seek
to develop such facilities in the City of Lynwood; and
WHEREAS, it is the intent of the City Council to direct
the Planning Commission to study an amendment to the zoning
ordinance to update its provisions relating to public and
community facilities; and
WHEREAS, development of new public and community
facilities can have permanent negative impacts on the
surrounding neighborhoods should they be permitted under the
current outdated regulations; and
WHEREAS, a total prohibition on new public and community
facilities is not necessary during the moratorium imposed by
this ordinance, because the potential adverse impacts outlined
above can be adequately controlled or mitigated through the
conditional use permit procedure; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:
SECTION l: For the duration of this ordinance, no
variance, building permit, occupancy permit, or other
applicable entitlement for use which is required in order to
comply with the City's land use regulations shall be approved
for any public or community use, including those uses permitted
in the CF Zone by Section 25-12.2 of the Lynwood Municipal
Code, unless a conditional use permit is first issued pursuant
to Chapter 25-25 of said code.
SECTION 2: Notwithstanding the provisions of Section 1
of this ordinance, building permits may be issued for the
following work on existing public and community uses: work
related to the correction of violations of the City's building
and housing codes; minor repairs; work related to demolition of
buildings and structures; work related to construction and
repair of retaining walls which are not a part of a building;
and work related to the repair and/or replacement of heating,
ventilation, air conditioning, plumbing, natural gas, and
electrical systems.
SECTION 3: Pursuant to the provision of Government
Code §65858, this ordinance shall take effect immediately upon
adoption and shall be effective for a period of 45 days unless
extended by the City Council.
