THE CITY OF BEL AIRE, KANSAS
ORDINANCE NO. 506
AN ORDINANCE CHANGING THE ZONING CLASSIFICATION FROM
"AG" TO "C-1" ON CERTAIN PROPERTY LOCATED WITHIN THE
CORPORATE CITY LIMITS OF THE CITY OF BEL AIRE, KANSAS.
WHEREAS, The legal description of the tract of land is as follows:
A tract of land located within the corporate city limits of Bel Aire, Kansas, described as:
Commencing at the Northwest corner of the South half of the Northwest Quarter of
Section 20, Township 26 South, Range 2 East of the 6th P.M., Sedgwick County,
Kansas; thence along the north line of said South half of the Northwest Quarter N89
degrees 38' 19"E, 50.02 feet to the point of beginning: thence continuing along said
north line of the South half of the Northwest Quarter N89 degrees 38' 19" E 440 feet;
thence S01 degrees 56' 19"E, 1320.37 feet parallel with the west line of said South half
to the south line of said Northwest Quarter; thence S89 degrees 22' 45"W, 439.95 feet
to a point 50.01 feet east of the southwest corner of said Northwest Quarter; thence N01
degrees 56' 19"feet east of the southwest corner of said Northwest Quarter; thence N01
degrees 56' 19"W, 1322.66 feet parallel with said west line to the point of beginning.
Said tract of land contains 581.179 square feet or 13.34 acres more or less.
WHEREAS, A public hearing was convened on the matter of rezoning the afore described tracts
on December 15, 2011, by the Planning Commission for the City of Bel Aire, Kansas in
conformance with the requirements set forth in Article Five of the Zoning Regulations of the City
of Bel Aire, Kansas;
WHEREAS, Following the public hearing, the Planning Commission found that the evidence
supported recommending approval of this requested zone change based upon the guidelines
set forth in Article 5.15 of the Zoning Regulations of the City of Bel Aire, Kansas;
WHEREAS, The Planning Commission for the City of Bel Aire, Kansas recommends approval of
the application by the property owner to change for the tract of land, as described above, from
AG to C-1;
WHEREAS, the Governing Body has considered the factors set forth in Article 5 of the Zoning
Regulations of the City of Bel Aire, Kansas.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BEL AIRE, KANSAS:

SECTION 1. The Governing Body adopts the recommendation of the Bel Aire Planning
Commission and approves the Planning Commission's recommendation for rezoning of the tract
of land described above, from AG to C-1.
SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3. This Ordinance shall take effect and be in force from and after its publication in
the official city newspaper.
Passed by the City Council this 3rd day of January, 2012.
Approved by the Mayor this 3rd day of January, 2012.
