HomeMy Public PortalAbout2018-11-191 REGULAR COUNCIL MEETING, NOVEMBER 19, 2018 CALL TO ORDER The Regular Council Meeting of November 19, 2018, was convened at 6:00 P.M. by Mayor Carrie Tergin. ROLL CALL The f ollowing Council Members were present for the roll call: Present: Fitzwater, Graham, Hensley, Hussey, Kemna, Prather, Schreiber, Ward, and Wiseman Absent: Mihalevich A quorum was declared present. ADOPTION OF THE AGENDA A motion was made by Councilwoman Ward to adopt the agenda. Councilman Prather seconded the motion. The motion to adopt the agenda was approved unanimously. MISCELLANEOUS AGENDA ITEMS a. Mayor Tergin introduced the Jefferson City, Missouri Museum of Modern Art 2018 High School Art Contest winner, Cora Walsh. Mayor Tergin purchased the painting for City Hall and invited Ms. Walsh to speak about her paintin g. b. Lt. Christopher White from the Salvation Army and campaign co-chair, John Sheehan presented the 2018 Red Kettle Campaign. Those wishing to volunteer as a bell ringer can sign up on-line at registertoring.com. Mayor Tergin, along with four other local artists, will each have decorated a kettle up for auction to raise money for the campaign. On Saturday, December 15th from 8:00 A.M. to 9:00 A.M., Bernie Fechtel and Lt. Gov. Mike Kehoe will be ringing the bells at the Hy-Vee location. c. Mayor Tergin introduced Hal Dulle as the 2018 Kevin Meinhardt Award recipient. Gail Strope, Human Resources Director, introduced Kevin Meinhardt’s family members in attendance. She then made a presentation to City Council about Mr. Dulle. d. City Administrator, Steve Crowell presented the November Outstanding Employee Service Award to Brian Allen. Mr. Crowell and Mayor Tergin thanked Mr. Allen for his hard work and presented him with a City coin and gift certificate. 2 REGULAR COUNCIL MEETING, NOVEMBER 19, 2018 e. Jayme Abbott, Neighborhood Services Manager and Lillian Kinard of Republic Services presented an update on Republic’s recycling audit and their efforts to education the community on what items are accepted in the single stream recycling containers. PUBLIC HEARINGS a. Rezoning 2.08 Acres of Land Addressed as 105 Jaycee Drive from M-2 General Industrial and RS-3 Residential to C-1 Neighborhood Commercial i. Associated Pending Bill 2018-065 A staff presentation was made by Eric Barron, City Planning Manager. Patrick Kremer of Central Missouri Professional Services spoke in favor of the bill. There being no others from the public to speak on the bill, Mayor Tergin declared the evidentiary portion of the public hearing concluded and stated that the Council would now take up the associated bill. 2018-065 sponsored by Councilman Graham, entitled AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING, AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE CITY OF JEFFERSON, BY REZONING 2.08 ACRES OF LAND ADDRESSED AS 105 JAYCEE DRIVE FROM M-2 GENERAL INDUSTRIAL AND RS-3 RESIDENTIAL TO C-1 NEIGHBORHOOD COMMERCIAL. Special Exemption Permit to Operate a Short Term Rental for Property Addressed as 500 East Miller Street i. Associated Resolution RS2018-22 A staff presentation was made by Eric Barron, City Planning Manager. 3 REGULAR COUNCIL MEETING, NOVEMBER 19, 2018 Aaron Clark, owner of the property, spoke in favor of the resolution. There being no others from the public to speak on the resolution, Mayor Tergin declared the evidentiary portion of the public hearing concluded and stated that the C ouncil would now take up the associated resolution. RS2018-22 sponsored by Councilman Graham, entitled A RESOLUTION OF THE CITY OF JEFFERSON, MISSOURI APPROVING A SPECIAL EXCEPTION PERMIT TO OPERATE A SHORT TERM RENTAL FOR PROPERTY ADDRESSED AS 500 EAST MILLER STREET Councilman Hussey motioned to approve RS2018 -22. Councilman Graham seconded the motion. ANNOUNCEMENTS BY MAYOR, COUNCIL, AND STAFF Announcements and Events  Mayor Tergin made the following announcements: 4 REGULAR COUNCIL MEETING, NOVEMBER 19, 2018  Johnathon Jackson was in the audience. He was the City Council’s first Lincoln University representative. He currently works for the Council for Drug Free Youth.  Veterans Day events were scheduled around the City last week. Mayor Tergin attended a National Guard deployment at the Jefferson City Memorial Airport. The guardsmen will be in Kuwait for nine months.  The Ceres statute on top of the State Capitol Building was removed this week for restoration. The State of Missouri’s Office of Administration has great documentation of the event.  The Special Olympics Polar Plunge event in the City of Jefferson is scheduled for December 5th, at 4:30 P.M. Mayor Tergin encouraged councilmembers and staff to participate. People can donate online at somo.org.  The Mayor’s Christmas Tree Lighting event is scheduled for Thursday, November 29th.  The annual downtown Living Windows event is scheduled for Friday, November 30th.  The Christmas Parade is scheduled for Saturday, December 1st.  Councilmen Fitzwater and Graham thanked City Staff members, Sonny Sanders and Eric Barron for attending the Saturday gathering of fourth ward residents at City Hall to answer questions about the Shermans Hollow rezoning bill. LINCOLN UNIVERSITY STUDENT REPRESENTATIVE UPDATE Caroline Wanjiru made the following announcements:  The student’s Thanksgiving Break is this week, Tuesday, November 20th thru Sunday, November 25th. Business offices will be closed Thursday, November 22nd thru Sunday, November 25th.  The men’s basketball team won their game against Missouri S &T today in Kansas City.  The women’s basketball team is currently undefeated at 3 – 0. COUNCIL AND STAFF RESPONSE TO PRESENTATIONS FROM THE GALLERY There were no responses at this time. NEW BUSINESS Sonny Sanders reviewed a memo received by the Missouri Department of Economic Development requiring the City to notify the department with the plans for 408 Lafayette Street by the end of the month. After discussion between City Council and Staff, the following motions were made: MOTION #1: Councilman Fitzwater motioned to continue with proceedings to allow for the demolition of 408 Lafayette Street. Councilman Graham seconded the motion. MOTION #2: After further discussing MOTION #1, Councilman Schreiber motioned for the previous question. Councilman Graham seconded the motion. The motion passed unanimously by voice-vote. A roll-call vote of Fitzwater’s MOTION #1 was then taken, and failed 5-4 by the following: Aye: Fitzwater, Graham, Schreiber, and Wiseman Nay: Hensley, Hussey, Kemna, Prather, and Ward Absent: Mihalevich MOTION #3: Councilman Hensley motioned to direct staff to seek a final agency decision from Housing and Urban Development on whether the grant money the City of Jefferson received would need to be refunded since FEMA declared the property in a flood plain after the property was purchased and the roof repaired. Councilman Hussey seconded the motion. The motion passed by the following roll-call vote: Aye: Hensley, Hussey, Kemna, Prather, and Ward Nay: Fitzwater, Graham, Schreiber, and Wiseman Absent: Mihalevich UNFINISHED BUSINESS There was no unfinished business at this time.
