HomeMy Public PortalAbout15643 Holly Hills Community Garden Lease Agreement OrdinanceORDINANCE NO. 15643 AN ORDINANCE, authorizing the Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District to lease certain real property of the District in the City of St. Louis, Missouri known and numbered as 3820 Bates to Holly Hills Improvement Association (HHIA), for use as a community garden, and to execute a Lease Agreement upon the terms and conditions hereinafter set out. WHEREAS, The Metropolitan St. Louis Sewer District owns certain real property in the City of St. Louis, Missouri, incident to its public functions and responsibilities, said property being a corner lot located at 3820 Bates Street, St. Louis, Missouri; and WHEREAS, Holly Hills Improvement Association (HHIA), a non-for-profit entity is desirous of leasing said real property to be used as a community garden; and WHEREAS, The Metropolitan St. Louis Sewer District is willing to enter into such a lease and believes it to be advantageous an in the public interest to do so. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Metropolitan St. Louis Sewer District does hereby lease to Holly Hills Improvement Association (HHIA), upon the general terms and conditions hereinafter set forth, the real property known and numbered as 3820 Bates in the City of St. Louis, Missouri. Section Two. The lease term shall be for an initial term of five (5) years, commencing May 1, 2021, at the rental of One Dollar ($1.00) per year, with one (1), five-year option to renew the lease upon the expiration of the initial term on the same terms and conditions. Section Three. The Executive Director and Secretary-Treasurer on behalf of The Metropolitan St. Louis Sewer District are hereby authorized to execute a Lease Agreement giving effect to Sections One and Two of this ordinance hereof and embodying such other terms and conditions as approved by the Office of General Counsel of the District. Accordingly, this ordinance shall take effect upon its enactment. The foregoing Ordinance was adopted on April 8, 2021.
