THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That City Council of the City of Lynwood Municipal Code is amended to read as follows: 25-3.1 Classes of Districts R-1 One family zone R-2 Two family zone R-3 Plultiple family zone P-R-D Planned residential development zone P-C-D Planned commercial development district z one P-1 Automobile parking zone CB-1 Planned business zone C-2 Light commercial zone C-2A Medium commercial zone C-3 Heavy commercial zone M Manufacturing zone CF Community facilities zone H-M-D Hospital-medical-dental zone T17e loca tion of said zoning districts is shown and delineated on the Zoning Map of the City of Lynwood, a copy of which is on file in the Office of the City C].er1c, and which is incorporated her ein and made a part hereof by this referenee.(Ordinan ce No. 11151. Section 2. That Section 25-34 of the Zoning Oi:•di.nance is hereby added as follows: 25-34 PCD - PLANNED COMMERCIAL DEVELOPMENT DISTRICT 25-34.1 Intent This distri.et is intended to provide for flexibility and creativity in the design of large scale Planned Commercial Developments. This district is also intended to provide for the development or• redevelopment of parcels of land as a coordinated project involving mixtures of commercial uses, community facil.i.ties, both pubaic and private. Section 2. That Section 25-34 of the Zoning Ordinance is hereby added as Follows: 25-3~ PCD - PLANNED COMMERCIAL DEVELOPMENT DISTRICT 25-31.1 Intent This district is intended to provide for flexibility and creativity in the design of large scale Planned Commercial Developments. This district is also intended to provide for the development or redevelopment of parcels of land as a coordinated project involving mixtures of commercia]. uses, community facilities, both pubai.c and private. The PCD (Planned Commercial Development) District is further intended to provide A. The following uses may be permitted in the PCD District only if a Conditional Use Permit- has been granted in accordance with Section 25-2 and Section 25-25: 1. Amusement Arcade (provided Section '25-8.9 requirements are met) 2. Automobile Service Station (provided Section 25-16.16 requirements are metj 3. Automotive Parts and Accessories Sales and ancillary installation and repair service. 4. New automobile sales and ancillary used automobile sales (provided Section 25-16.15 requirements are met). 5. Home / Improvement Centers and Building Supply Stores. 6. Child Care Center 7. Electric Distribution Stations 8. Electric Appliance Sales (New) and Servicing. 9. Hotels and Motels (provided Section 25-9.1(cj are met. 10. Indoor Entertainment Facilities, including gymnasiums, health clubs, night clubs, billiard parlors. 11. Nurseries 1.2. Sales of Alcoholic Beverages for on or off site consumption (provided Section 25-16.20 requirements are met, except that such uses within the PCD District may be located closer than three hundred feet (3U0'j to a similar use. 13. Theaters B. The following uses are expressly prohibited: 1. Funeral Parlors and Crematoriums 2. Garment or Clothing Manufacturing 3. Medical Laboratories 4. Storage Garages 5. Taxidermist 6. Trade School 9. Warehousing 10. Wedding Chapels, Social Halls or Meeting Halls 25-34.3 Development Standards All development within a PCD District shall conform with the development standards set forth in the approved Development or Redevelopment Plan for the area. Development standards within the PCD District shall be as follow: 1. Setbacks shall be as established by the Development Plan except that building setbacks from property lines fronting on major streets shall be a minimum of fifteen (15) feet to permit landscaping and pedestrian ways. Setbacks from adjacent residential uses shall be a minimum of twenty (20) feet. All other setbacks between structures shall be as required by= the Uniform Building Code and the Uniform Fire Code, as amended. 2. Building heights shall be a maximum of one hundred ninety feet (190'). 3. Lot Coverage shall be as established and indicated on the approved development plan. 4. Parking requirements shall be as established by the Lynwood Zoning Ordinace Section 25-14, Development Standards for Off-Street Parking and Loading Areas. 5. Landscaping The following shall be the minimum requirements for the provision and. maintenance of landscaped areas: (a) A landscape plan shall be submitted. (b) All landscaped areas shall be provided with an automatic ix•rigation system capable of complete coverage of the areas and designed to mi.ni.mize runoff and wasting of water. Such system shall be maintained in a fully operational condition. (c) All landscaped areas shall be landscaped with a mixture of ground cover, shrubs and trees, and may include decorative rock, sculpture, and walkways. (d) One tree shall. be provided for each ten (10) parking spaces. The trees shall be of (1) Trees - at least fifteen gallon t2) Shrubs - at least five gallon (3) Ground cover - lawn shall be of sod and shall cover the proposed area If adequate space to plant a fifteen gallon tree is not available, three five gallon shrubs may be substituted for each tree, upon the approval of the Community Development Director. (f) All landscaped areas shall be maintained in a neat and orderly condition and free of weeds and litter. 6. Lighting The parking area shall be illuminated with lights directed and shielded to prevent light intrusion to adjacent sites. The lighting system shall be designed as an integral part of the development plan and shall be as indicated on the approved development plan. 7. Fencing All. uses abutting a residential zone shall be screened by a solid concrete block wall not less than six feet in height, except in the front- yard area of such residential lot, where the wall shall be four feet in height. All walls or fences shall be in good repair at all times without broken parts, holes, or litter. 8. Signage shall be provided as permitted in the Lynwood Zoning Ordinance Section 25-33, Regulation of Signs, except that uses within seventy-five (75) feet of and fronting on a r..ajor street shall have monument identi.ficat.ion signs. All plans for monument signs shall be submitted and approved. Billboard signs shall not be permitted in the PCD District. 9. The exterior architecture of the proposed development shall be submitted and approved prior to the submittal of construction documents for review and shall be considered as part of the development plan. 10. All developments in a PCD District shall be governed by Conditions, Covenants and Restrictions (CC&Rs) which shall be submitted and. approved prior to submittal of construction 25-34.5 Establishment of PCD District Application for classification of property to the PCD District must include a Development or Redevelopment Plan which may include, but shall not be limited to the following: a) A site plan illustrating: 1) 7'he dimensions and. orientation of each lot or parcel i:o be built upon or otherwise used; 2) The permitted use of a.11 land within the subject area; 3) A statistical inventory of the square footage of the site devoted to buildings, parking, other paving, open space, and other improvements. 4) Location, size and shape of all proposed structures on the site; 5} Location of streets, walks, bikeways, and other right-of-way; 6) Location and arrangement of parking areas; 7) Internal circulation patterns and points of ingress and egress; and 8) Existing topography and finished grades. b) A statement of the objectives to be achieved through the planned development of the property. cy Development standards regulating setbacks, building height, distances between buildings, lot coverage, required parking, landscaping, signing, architecture, and energy conservation. d) If the development is to be phased, a phasing plan setting forth the sequence and timing of development within the PCD District;. e) Any other conditions or requirements deemed ^ecessary or desirable by the City Council.. 25-34.6 Required Findings The Planning Commission after a public hearing may recommend establishment of a PCD District, and the City Council, after a public hearing may by resolution establish a PCD District provided they find that: a) The uses proposed will not be detrimental to the present and proposed surrounding land uses, but will enhance the desirability of the area and have a beneficial effect; b) That any deviation from the standard code requirements is warranted by the design and additional amenities incorporated in the Development or Redevelopment Plan which compensates for an,y deviations that may be permitted; and 25-34.8 Exuiration Any PCD District Development or Redevelopment Plan shall be nu.11 and void if it is not exercised within the time specified, or if the plan is not exercised within one ,year from the date the approval becomes final. Any extension shall be approved in writing by the Director of Community Development. 25-34.9 Modification Any condition imposed upon the approval of a PCD District Development or Redevelopment Plan may be modified, eliminated or new conditions added provided that the granting body shall first conduct a public hearing thereon, in the same manner as required fox granting of the same. No such modification shall be made unless the granting body finds that such modification is necessary to protect the public peace, health, safety and welfare, or that such action is necessary to permit reasonable development under the development plan as approved. Section 3. Effective with adoption of this ordinance the commercial development identified and commonly known as the Hopkins Development" located in the Lynwood Redevelopment Project Area "A" and for which a Disposition and Development Agreement has previously been approved by the Lynwood Redevelopment Agency will. be designated as Planned Commercial Development District Number one (P-C-D-l.). Section 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this Ordinance, or the application thereof to an,y person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent juridiction, such decision shall. not affect the validity of the remaining portions of this ordinance or its application to o-thee persons or places. The City Council. hereby declares that it would have adopted 1;his Ordinance, and. each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. First read at a regular meeting of the City Council of said City held on the 2nd day of December ,1986, and finally ordered published at a regular meeting of said Council held on the 16th day of December 1986.
