ORDINANCE NO. 1285
AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF i,YNWOOD ADOPTING LIMITATIONS ON
THE RECEIPT OF TAX ALLOCATIONS FOR THE
ALAMEDA PROJECT AREA PURSUANT TO HEALTH
AND SAFETY CODE SECTION 33333.4
WHEREAS, Health and Safety Code Section 33333.4
requires the City to adopt certain limitations required by Health
and Safety Code Section 3333.2 prior to December 31, 1986; and
WHEREAS, the City has considered the appropriate
limit for taxes to be allocated to the Agency pursuant to the
Plan and the appropriate 'time limit for establishing of loan
advances and indebtedness to finance the redevelopment project,
P10W, THEREFORE BE IT ORDAINED BY THE CITY OF
LYNWOOD AS FOLLOWS:
That certain redevelopment plan for the Alameda
Project Area approved by the City Council of the City of Lynwood
by its Ordinance No. 993 adopted on November 18L 1975,is hereby
amended as follows:
Section 1. The number of dollars of taxes which
may be divided and allocated to the Redevelopment Agency pursuant
to the Plan and Section 33670 of the Community Redevelopment Law
shall not exceed $100,000,000.00. Taxes shall not be divided and
shall not be allocated to the Redevelopment Agency for this Plan
beyond such limitation.
Section 2. No loans, advances or indebtedness to
finance in whole or in part, this redevelopment project shall be
established more than 25 years from the date of adoption of this
Ordinance. No loans, advances or indebtedness to be repaid from
the allocation of taxes shall be any such loans, advances or
indebtedness may be repaid over a term longer than such
limitations.
Section 3. The Agency shall commence eminent
domain proceedings to acquire property within the Project Area
within 12 years from the date of adoption of the Ordinance
approving these amendments.
Section 4. The City Clerk is hereby ordered and
directed to certify to the passage of this ordinance and to cause
same to be published once in the Lynwood Press, a newspaper of
general circulation, printed, published, and circulated in the
City of Lynwood.
Section 5. All other provisions of the Plan
except to the extent inconsistent herewith shall remain in full
force and affect following adoption of the ordinance.
First read at a regular meeting of the City
Council of said City held on the second day of December, 1986,
and adopted and ordered published at a regular meeting of said
Council held on the sixteenth day of December, 1986, by the
following vote:
