HomeMy Public PortalAboutOrd. 1254 ORDINANCE N0. 125a AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, ESTA4LISHING A FILING FEE FOR CANDIDATES FOR ELECTIVE OFFICES OF SAID CITY WHEREAS, there are costs in processing a candidate's nomination paper for an elective office at municipal elections held in the City of Lynwood; and WHEREAS, Section 22843 of the Elections Code of the State of California authorizes a City Council to impose a filing fee proportionate to the costs of processing a candidate's nomination paper but not exceeding $25.00: NOW, THEREFORE, the City Council of the City of Lynwood, DOES ORDAIN as follows: Section 1. A filing fee of $25.00 is hereby established for candidate's nomination papers for elective offices at municipal elections held in the City of Lynwood. Section 2. The filing fee shall be paid to the City Clerk by each candidate for an elective office at the time the candidate's nomination paper is filed with the City Clerk. Section 3. The City Clerk shall pay to the City Treasurer all fees received which shall be deposited in the General Fund. Section 4. Severability. If any section, subsection, subdivision, sentence, clause, phrase or portion of this ordinance, or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance or its application to other persons or places. The City Council hereby declares that it would have adopted this ordinance, and each section, subsection, subdivision, sentence, clause, phrase or portion thereof, irrespective of the fact that any one or more - 1 - sections, subsections, subdivision, sentences, clauses, phrases or portions, or the application thereof to any person or place, be declared invalid or unconstitutional. Section 5. The City shall certify to the adoption of this ordinance and cause the same to be published in the Lynwood Press, a newspaper of general circulation, printed, published, and circulated in the City of Lynwood. First read at a regular meeting of the City Council of said City held on the 4th day of dune, 1985, and finally adopted and ordered published at an adjourned meeting of said Council held on the 11th day of June , 1985, by the following vote: AYES: COUNCTT,MFTT HIIVNING, MORRIS, ROWE, THOMPSON, BYORK NOES: NONE ABSENT: NONE ATTEST: o.
