AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE,
FLORIDA; AMENDING CHAPTER 28 "SIGNS" OF THE CODE OF
THE VILLAGE OF KEY BISCAYNE; SPECIFICALLY AMENDING
SECTION 28-5, TEMPORARY HOLIDAY DECORATIONS;
AMENDING SECTION 28-6, RESIDENTIAL DISTRICT
PERMANENT SIGNS; AMENDING SECTION 28-7 NON
RESIDENTIAL DISTRICT SIGNS; AMENDING SECTION 28-8,
TEMPORARY SIGNS; PROVIDING FOR SEVERABILITY,
INCLUSION IN THE CODE AND AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS:
Section 1. Section 28-5 of the Code of the Village of Key
Biscayne, Florida is hereby amended as follows:
Sec. 28-5. Signs not requiring a permit.
The following signs do not require a permit.
(2) Temporary holiday decorations, provided they carry no
advertising matter, and further provided that they are
not in place more than seven days prior to a holiday and
are removed within seven days after the holiday ends. The
time limitations contained in this paragraph shall not
apply during the period November 1 through January 15
each year.
Section 2. Section 28-6 of the Code of the Village of Key
Biscayne, Florida is hereby amended as follows:
Sec. 28-6 Residential District Permanent Signs.
The following Signs are authorized in all residential
districts and residential -office districts:
(1) Development Identification Sign: Permitted only for (a)
multifamily buildings with over five units; (b) single-
family developments with over five units; (c) religious
institutions, schools id public uses. Where multifamily
dwellings are part of a larger development, there shall
be only one such Sign on each public or private street
frontage on which the development faces. Prior to the
issuance of a permit, the owner shall covenant that such
Sign shall be continually and properly maintained.

Section 3. Section 28-7 of the Code of the Village of
Biscayne, Florida is hereby amended as follows:

districts in the Village:

No real estate open house signs shall be permitted to be
placed in the median of or on property abutting and
facing Crandon Boulevard nor within 5 feet of any right-
of-way line.

Section 5. Severability. The provisions of this Ordinance
are declared to be severable and if any section, sentence, clause
or phrase of this Ordinance shall for any reason be held to be
invalid or unconstitutional, such decision shall not affect the
validity of the remaining sections, sentences, clauses, and phrases

of this Ordinance but they shall remain in effect, it being the
legislative intent that this Ordinance shall stand notwithstanding
the invalidity of any part.

Section 6.
Inclusion in the Code. It is the intention of
the Village Council, and it is hereby ordained that the provisions
of this Ordinance shall become and made a part of the Code of Key
Biscayne, Florida; that the sections of this Ordinance may be
renumbered or relettered to accomplish such intentions; and that
the word "Ordinance" shall be changed to "Section" or other
appropriate word.
Section 7. Effective Date. This Ordinance shall be
effective upon adoption on second reading.

ered on Second reading by the Key Biscayne Wage Council at a
meeting to be held on Thursday, November 14, 1996, at 7100 p.m., in
the Council Chamber, located at 85 West McIntyre Street, Second
Floor, Key Wscayne, Florida:
