HomeMy Public PortalAbout1996-08 Amending Chapter 28 Signs re Temporary Holiday DecorationsORDINANCE NO. 96-8 AN ORDINANCE OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; AMENDING CHAPTER 28 "SIGNS" OF THE CODE OF THE VILLAGE OF KEY BISCAYNE; SPECIFICALLY AMENDING SECTION 28-5, TEMPORARY HOLIDAY DECORATIONS; AMENDING SECTION 28-6, RESIDENTIAL DISTRICT PERMANENT SIGNS; AMENDING SECTION 28-7 NON RESIDENTIAL DISTRICT SIGNS; AMENDING SECTION 28-8, TEMPORARY SIGNS; PROVIDING FOR SEVERABILITY, INCLUSION IN THE CODE AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE VILLAGE COUNCIL OF THE VILLAGE OF KEY BISCAYNE, FLORIDA, AS FOLLOWS: Section 1. Section 28-5 of the Code of the Village of Key Biscayne, Florida is hereby amended as follows: Sec. 28-5. Signs not requiring a permit. The following signs do not require a permit. (2) Temporary holiday decorations, provided they carry no advertising matter, and further provided that they are not in place more than seven days prior to a holiday and are removed within seven days after the holiday ends. The time limitations contained in this paragraph shall not apply during the period November 1 through January 15 each year. Section 2. Section 28-6 of the Code of the Village of Key Biscayne, Florida is hereby amended as follows: Sec. 28-6 Residential District Permanent Signs. The following Signs are authorized in all residential districts and residential -office districts: (1) Development Identification Sign: Permitted only for (a) multifamily buildings with over five units; (b) single- family developments with over five units; (c) religious institutions, schools id public uses. Where multifamily dwellings are part of a larger development, there shall be only one such Sign on each public or private street frontage on which the development faces. Section 28-7 of the Code of the Village of Biscayne, Florida is hereby amended as follows: Sec. 28-7 Nonresidential District Signs. The following Signs are authorized in all districts in the Village: (1) Monument Sign or required) : • Number (maximum) • Area (maximum) Key nonresidential V -Sign (Village Council approval 1 per parcel; A parcel that has a minimum of 300 feet of street frontage and is served by two (2) or more access points may have one (1) additional sign. 24 sq. ft., except for gasoline station parcels where a 32 square 2 foot sign shall be permitted. • Sign Height (maximum) 4 ft. • Sign Width (maximum) 8 f t . • Setback (minimum) : From right-of-way line 5 ft. (6) Window Sign (permanent) : " Number (maximum) 4 per establishment " Area (maximum) 8 sq. f t . " Supplemental Provisions: " Instructional signage not exceeding 2 sq. ft. in area affixed to or installed on windows or doors shall not be counted toward the overall window signage square footage. " Any graphic or attention getting device that is located three (3) or more feet above the finish floor, that exceeds 16 sq. inches in area and is less than 3 feet from a window shall be considered a window sign. Section 4. Biscayne, Florida is hereby amended as follows: Sec. 28.8 Section 28-8 of the Code of the Village of Key Temporary Signs. The following Temporary Signs are authorized in the Village: (1) Grand opening or seasonal Banner Sign (permit from Village Manager required). Severability. The provisions of this Ordinance are declared to be severable and if any section, sentence, clause or phrase of this Ordinance shall for any reason be held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining sections, sentences, clauses, and phrases 6 of this Ordinance but they shall remain in effect, it being the legislative intent that this Ordinance shall stand notwithstanding the invalidity of any part. 65v Section 6. Inclusion in the Code. It is the intention of the Village Council, and it is hereby ordained that the provisions of this Ordinance shall become and made a part of the Code of Key Biscayne, Florida; that the sections of this Ordinance may be renumbered or relettered to accomplish such intentions; and that the word "Ordinance" shall be changed to "Section" or other appropriate word. Section 7. Effective Date. This Ordinance shall be effective upon adoption on second reading. PASSED AND ADOPTED on first reading this 15th day of October , 1996.
