Meeting Minutes r
Wednesday, July 23, 2014
at The Brewster Town Office Building, 2198 Main Street, Brewster, MA
Present: Elliott Carr, Bill Klein, Jeanne Boehm, Paul Ruchinskas, Peter
Johnson, Roland Bassett, George Boyd, and Elizabeth Taylor.
Absent: Dion Dugan
Also present: Jillian Douglass, Ellen St. Sure, and Brett Peterson

The Chair called the meeting to order at 4:32 pm. The Chair introduced and
welcomed Peter Johnson as a new member to the Community Preservation
Committee (CPC).
1. Approval of Minutes of June 25, 2014
Motion made by Elliott Carr to approve the June 25, 2014 meeting
minutes as presented. Jeanne Boehm seconded.
Vote: 4-0-1

2. Habitat- 620 Tubman acquisition- review/vote on conditions needing
CPC approval in order to expend CPC funds for acquisition.
There was a review of the 620 Tubman Road acquisition. Before Habitat
can go forward with the purchase of the Tubman Road property there are
five conditions CPC needs to approve. These conditions were reviewed
at the Housing Subcommittee meeting last week. There has been an
extension put on the P & S to look further at the title issues, so Habitat
will be on the agenda at the August 13, 2014 meeting. The lot line where
the entrance to the property will be located is being reviewed. There may
need to be some adjustments to the signed P & S agreement. The P & S
will state no more than a maximum of 14 homes will be built on the site.
3. Treasurer's report/finances- discussion with Lisa Souve on amounts in
various funds available to commit to activities in FY 2015
Lisa Souve reviewed the budget sheet that she distributed to the
committee. The three percent (3%) that is raised on the annual tax bill
plus the money the town received from the state trust fund is the total
amount available to spend each year and the FY '14 numbers were
reviewed. There was a review of the open space, historic preservation,
and community housing accounts. Lisa reviewed all of the account
balances and computations.
The town estimated state funds of$213,000 but will be receiving
$475,000 and will need to go to town meeting to reallocate these monies.
It is advised not to reallocate all of the funds in the fifth account. There
was discussion on how much money should be kept in this account. This
is something the CPC will need to decide about how much is enough.
The additional $262,000 received from the state for this year will need to
be allocated. The estimated money has already been allocated
($213,000). Then every year at the special town meeting the extra funds
in this fifth account can be reallocated. It was suggested to keep the
following articles going to the special town meeting separate: new
allocations, current funds, and the allocations of reserve funds from
previous years.
A spreadsheet with the current balances in all of the CPC articles was
distributed.

4. Professional services funding request- open space.
Elizabeth Taylor requested professional services funds for open space.
Motion made by Peter Johnson to approve the $700 request for
Professional Services funds for Open Space. Roland Bassett
seconded.
Vote: 8-0-0
5. Review of CPC application:
Paul Ruchinskas gave an overview of the new CPC application with the
current changes including new members. George Boyd handed out the
Secretary of the Interior's standards. The Historical Commission has
reviewed their section of the CPC application. It was requested that a
line be placed in the application that projects requesting CPC funding
are to meet with the Secretary of the Interior standards. There was
discussion on the preservation restricting rehabilitation standards as set
forth by the United States Secretary of the Interior for the treatment of
historic properties. It is suggested that the rules be posted online. There
'$ are minor differences on rehabilitation and restoration. Ellen St. Sure
reviewed her research on the issue and stated that according to her
research, the Historic District Committee can do what they want, but
when CPC funds are used, the rules change. It was stated that the
Massachusetts Historic Commission has never discussed this issue in the
information they send out so more investigation was needed. There was
further discussion on the issue and it was suggested that this be placed
on the next meeting agenda for further discussion to give members some
time to read the standards.
Motion made by George Boyd to place this issue on the next agenda for
further discussion. Peter Johnson seconded.

Paul requested that language on Page 6 of the application include: "CPC will
seek input from the relevant committees before the determination is made by
the CPC." There was discussion on the application deadline.
It was decided that all incoming bills are to go to Donna for her to submit to
the correct person for approval.

Further review of the application will take place at the next meeting.
6. Historical preservation restrictions/rehab standards requirements and
policy:
Paul referred to the two informational items he forwarded to the
Committee on preservation restrictions and he asked that the Committee
read this information. Cobb House will meet the restriction
requirements, but the Brewster Baptist Church restoration is not clear.
The Historical Commission was asked to review the CPC information on
preservation restrictions and make recommendations to the CPC on
which projects should have preservation restrictions as a condition of
funding.
7. Brewster Woods update:
There was no update today. It was suggested that "update on open
projects" be a fixed agenda item.
8. Yankee Drive Town Home Condominium Association application.
Brett Peterson represented the Yankee Drive Town Home Condominium
Association. This Condominium complex is 50% affordable housing and
she reviewed the project. The members of the complex are being
assessed $3,000 each and this is a considerable hardship for the
affordable housing units. This is a community housing improvement
project. This application will be forwarded to the Housing subcommittee
of the CPC for review and there will need to be investigation as to
whether this is even allowable under the statute.
9. Executive session to consider the purchase of real property for open space
such that an open meeting may have a detrimental effect on the
negotiating position of the public body.
Motion made by Paul Ruchinskas and seconded by Elliott Carr with a
roll call vote to enter into executive session to consider the purchase of
real property for open space such that an open meeting may have a
detrimental effect on the negotiating position of the public body.

10. Topics the Chair did not reasonably anticipate
Roland Bassett stated that the playground is not going forward as it is
located over a septic system, and the contractor is concerned that the
footings would interfere with the leach fields and has halted work on the
installation in that area.
11. Schedule of the next meeting
The next scheduled meeting will be August 13, 2014 at 4:30 pm.
