Absent: Dion Dugan Also present: Ellen St. Sure, Jeffrey Hayes, Steve Jones, Sally Gunning, Patsy Roberts, Bill Roberts, Janet Hicks, Paul Hicks and Chi-is Miller The Chair called the meeting to order at 4:32 pm Video&Audio Recording or Taping Notification: "As required by the Open Meeting Law we are iffOrMilig YOU that the Town will be audio taping this mecting, In addition if anyone else intends to either video or audio tape this meeting they are required to infonn the chair," 1. Review/Correction/Approval of 09/24/2014 minutes. Motion made by Roland Bassett to approve the meeting minutes of September 24, 2014 as revised. Elliott Carr seconded. VOTE: 7-0-1 2. Cobb House acquisition- Status update and review/discussion of award letter and possible modifications of conditions. Paul Ruchinskas reviewed the Cobb House award letter that was distributed to the Committee. He also noted that the permit requirement is in the purchase and sale agreement and that the house would not be purchased until the permits were in place, The award letter is an executed agreement and any changes to the award letter have to be mutually agreed to by both the CPC and the Historical Society. The requirements of the Secretary of the Interior standards for historical restoration and rehabilitation and what is required to be in compliance were reviewed. The Historical Commission has suggested that the grant be converted to a loan and that protections be put in place to insure that this historic property purchased with CPC funds continues into the future as its intended use. Steve Jones and Sally Gunning reported on the status of the Cobb House acquisition. The CPC Wetiflig MirlUtCS October 8,2014 Page I of 4 engineering pians were secured and submitted to the town for a site plan review with the Planning Board. The hearing has been scheduled for November 12, 2014. This is the last permit required. The purchase and sales has been extended to October 15, 2014 and it is expected this to be extended again until November 15, 2014. All funds for the purchase have been secured. The Historical Society will continue to fundraise for repairs, renovations, and restoration of the property. The amount of funds raised to date will be provided to the CPC in the Historical Society's next budget report. The conditions in the award letter were reviewed and monies will not be released until the conditions are met. There was also a request for an ongoing schedule for the project. The law has been silent in the situation of how to structure the CPA award. Up to this point the CPC has been formatting their awards as grants. If the Historical Society purchases the property, they must place a permanent preservation restriction on this title. There was a discussion on whether this should go forward as a grant or a loan. There was discussion and a consensus of the Committee that now that this has been approved by town meeting, the CPC should not now restructure the agreement and it should go forward as a grant. Motion made by Peter Johnson that the award letter be amended that the Historical Society not to proceed with the Cobb Horse project unless all necessary permits are received from the town. Roland Bassett seconded. VOTE: 8-0-0 It was felt that the Nantucket preservation restriction and the Meeting House preservation restriction documents would be used as a guide in developing the Cobb House preservation restriction. There was discussion on who would review and approve the preservation restriction. It is expected that the Brewster Historical Commission will review and make recommendations to the CPC on the preservation restriction, but the final version will be reviewed and approved by the CPC and/or the town attorney and Selectmen before it is submitted to the Massachusetts Historical Commission. There was discussion on problems that may arise and a discussion over major or minor changes that may want to be made to the preservation restriction. The draft of the preservation restriction will be submitted to the CPC and the Selectmen for approval. The recording of the preservation restriction will be done following this approval unless there is a need for approval from the Massachusetts Historical Commission. The historic preservation restriction on the property to be held by the town and it is up to the town to enforce adherence to the restrictions. Motion made by Peter Johnson that condition #4 of the award letter add the following line "evidence of a draft preservation restriction has been reviewed and approved by the CPC and BOS and has been submitted to the Massachusetts Historical Commission." Roland Bassett seconded. VOTE: 8-0-0 CPC Meeting Minutes October 8,2014 Page 2 of 4 3. Treasurer's report. Elizabeth Taylor reviewed the most current budget dated 10/7/2014. This budget does not include the return of the Millsites money, but other than that shows money that is available to the CPC at this time . 4, Review of revised Town Meeting articles 13 and 14. Articles 13 and 14 were shared with the CPC members. It is felt that these final versions are ready to be printed, 5. Report and discussion of meetings with Finance Committee and Board of Selectmen on CPC Town Meeting articles. Paul Ruchinskas went before the Selectman's meeting on Monday with a favorable outcome. His presentation before the Finance Committee did not go as well and there were no votes taken. Articles 13 and 14 just need to be updated for the Finance Committee's approval. Article 9 with acquisition of the open space was a sticking point with concern raised about taking property off the tax rolls. The Finance Committee requested a report showing all of the open space bought with CPC funds listing the loss in revenue with the properties being taken off the tax rolls. It was felt that the report to the Finance Committee should also include all of the benefits of purchasing open space and the cost savings to the town especially with regard to wastewater. Chris Miller stated that there is no formal management proposal for the Eldredge property currently. Should the state grant be received, the parcel will be made somewhat handicap accessible though possibly not by a wheelchair, There are a number of trails around town that are handicap accessible, but not all of thein are handicap accessible. This is being purchased as a buffer to the Drummer Boy Park and it may be wheelchair accessible down the road. CPC could receive an application from the Recreation Department to place a walkway out to the overlook. It was the consensus of the Committee to take "handicap accessible" out of the article and leave in "to an overlook". At this time, it is not known about what it would take to make this parcel handicap accessible with regard to grades etc. Quivett Marsh Vistas is wheelchair accessible to an overlook and the Whitecaps field were recently made handicap accessible so a wheelchair is able to access the field to watch the game, Nickerson State Park has handicap trails available. The current owner has a vista permit and the parcel has a view. - 1 6. Review of CPC application. The review of the CPC application was postponed to a future meeting. Updates on open projects: a) Crosby Mansion- George Boyd: The Crosby Mansion porch work project is complete, the final bill was submitted, and there should be money coming back. The rebuilding of the columns was well done and they look beautiful, b) Viprino acquisition- Elizabeth Taylor: The Viprino property has been purchased. c) Millsites dam restoration- Elliott Carr: Chris Miller reviewed the Millsites dam restoration project. The CPC money not expended to date will be returned to the CPC and Chris will come back with a new proposal for work to be done at the Millsites. There was discussion on whether current work needed should come out of free cash. d) Habitat Tubman Road acquisition- Paul Ruchinskas: Everything is set and Habitat is ready to go for a closing on October 14, 2014. Habitat has received an easement from NSTAR that their attorney is reviewing. The deed for the town is being prepared that will kick in if the project is not started within 2 years. The funds will be released when it is certain the title is clear. e) Brewster Baptist Church- Elliott Carr: There has been progress on the Brewster Baptist Church project. S. Items the Chair could not reasonably anticipate. There were no other discussions. 9. Schedule next meeting. The next meeting is scheduled for Wednesday, October 22, 2014 if necessary, but more than likely the next meeting will be on Wednesday, November 12, 2014 at 4:30 pm.
