Present: Mayor, Thomas Anderson; Councilmembers, Wilfred Scherer, William Reiser, Anne Heideman; Clerk -Treasurer, Donna Roehl; Planning and Zoning Adminis- trator, JoEllen Hurr; Police Chief, Michael Sankey; Public Works Director, James Dillman; Attorney, Richard Schieffer; Engineer, Glenn Cook; Building Inspector, Loren Kohnen Absent: Councilmember, Robert Mitchell 1. MINUTES OF AUGUST 8, 1986 Moved by Heideman, seconded by scherer to accept minutes of August 8, 1986, as presented. Motion declared carried 3. MINUTES OF AUGUST 13, 1986 Moved by Reiser, seconded by Scherer to accept minutes of August 13, 1986, as presented. Motion declared carried 4. POLICE DEPARTMENT Cheyenne Tr., Traffic Signs Michael Sankey reported that he had received a request for installation of a Yield Sign at Cheyenne Tr., onto Holy Name Dr. He recommended that Council authorize the Public Works Department to install the sign. Moved by Reiser, seconded by Scherer to authorize the Public Works Department to install a Yield Sign on Cheyenne tr as it intersects with Holy Name Dr. Motion declared carried Woodlake Landfill, Burning Permit Michael SAnkey reported that trees have been removed and burned at Woodlake Landfill, under a burning permit that he had issued. He stated that complaints had been received and he asked Council for direction as to how to proceed. JoEllen Hurr stated that they had removed all the trees that are to be removed and that Woodlake anticipates two additional weeks will be needed for burning. Council discussed other options available for disposal of the trees. Moved by Scherer, seconded by rEiser to revoke Burning Permit'86-138 because of the nuisance being created and to inform Woodlake Landfill that they should dispose of the remainder of the trees by either burying them or hauling them to a tree chipping site. Motion declared carried Firearms Ordinance Michael Sankey presented a suggested addition to the Firearms Ordinance that had been made by the Sportsmens Group, that would allow discharge of a firearms for the purpose of destroying a preditor or non game animal by a landowner, Moved by Reiser, seconded by Scherer to adopt Ordinance # 232, amending Section 230 of City Code relating to Firearms. Motion declared carried Minnesota Waterfowl Association Moved by Scherer, seconded by Reiser to approve the issuance of a gambling license to the Minnesota Waterfowl Association for a raffle to be held at the Medina Ballroom on September 11, 1986. Motion declared carried 1 1 2 Willow Dr and Hackamore Rd., Speed Zones Council discussed the request from the City of Corcoran to State Transportation Department for a study to be completed regarding lowering the speed limits on Willow Dr. and also on Hackamore Rd. (62nd Ave.) to 30 mph. Thomas Anderson stated that a speed of 30mph on Willow Dr. would not be reasonable or practical. Michael Sankey explained that the request for a lower speed limit on Hackamore was probably due to the dust problems. Moved by Thomas Anderson, seconded by Scherer to notify MnDot that Medina does not believe that lowering the speed limit on Willow Dr. would be reasonable or practical but Medina agrees that a study could be done for Hackamore Rd. Motion declared carried 5. PUBLIC WORKS DEPARTMENT Independence Beach Boat Ramp and Beach Clean-up Jim Dillman asked that the engineer be directed to prepare plans for repair of the boat ramp at Lake Independence. He stated that the ramp needs to be repaired every year and that a concrete ramp would be much more permanent. Glenn Cook stated that the ramp would be from 12-51 ft. in length and cost approximately $10,000. Moved by Heideman, seconded by Scherer to proceed with plans for a concrete boat ramp at Independence Beach and secure quotes for Council approval. Motion declared carried Independence Beach Shoreline Clean-up Jim Dillman stated that he would apply for a permit from the DNR for beach and ramp improvements at Independence Beach and that it would cost about $1000 to clean up the beach area and shoreline in the area of the park. Moved by Heideman, seconded by scherer to authorize the Public Works department to proceed with cleaning up the beach area at the Independence Beach park. Motion declared carried Hamel Rd./Kilkenny Ln., Improvements Glenn Cook presented the Plans and Specifications for improvements to Kilkenny Ln. and Hamel Rd. He stated that work could proceed this fall if Council approved the plans and ordered that bids be taken. He stated that an easement would be needed from Joe Raskob for the storm sewer project. Moved by Scherer, seconded by Heideman to adopt Resolution 86-61, approving Plans and Specifications for the Kilkenny Ln./Hamel Rd. project and ordering bids to be taken on Tuesday, September 16, 1986, at 10:00 A.M. Motion declared carried Pick-up Truck Jim Dillman stated that he primarily in city parks. Moved by Scherer, seconded a 3/4 ton pickup truck and Motion declared carried would like to purchase a 3/4 ton Pick-up truck to be used by Heideman to authorize Jim Dillman to secure quotes on to take payment from the Park Fund. 6. PLANNING AND ZONING DEPARTMENT Dorothy and Leroy Martin, Conditional Use Permit Moved by Reiser, seconded by Scherer to adopt Resolution 86-62, approving a Conditional Use Permit for Dorothy and Leroy Martin to operate an Off -Sale Liquor establishment at 712 Hwy. 55. Motion declared carried QX Inc. Conditional Use Permit JoEllen Hurr stated that she had reviewed the prepared resolution and believed that Item 10 should be modified as the entire asphalt area would not need to be brought to 9 ton standards, merely the driveway, as approved plans indicated. Moved by Scherer, seconded by Heideman to adopt REsolution 86-63, approving a Con- ditional Use Permit for Ron Peterson to operate QX Inc. at 2705 Hwy. 55 and to change Item 10 according to the Zoning Administrators recommendations. Motion declared carried Robert Bradley, Preliminary Subdivision Approval Moved by Reiser, seconded by Scherer to adopt Resolution 86-6all granting preliminary subdivision approval to Robert Bradley to subdivide property on Willow Dr. and Hamel Rd. Motion declared carried Leonard Schlosser, Final Subdivision Approval JoEllen Hurr suggested that Item 7 of the resolution be resolved prior to filing the Schlosser plat. Item 7 concerns a Discharge of Lis Pendence on the property. Moved by Scherer, seconded by Heideman to adopt Resolution 86-64, approving the final subdivision of the Leonard and Bernice Schlosser property on Co. Rd. 19 and Hwy. 55. Motion declared carried Woodlake Landfill JoEllen Hurr reminded Council that a tour of the Woodlake Landfill and Leachate Coll- ection system would be on August 27th at 2:00 P.M. Park Reserve District Sign JoEllen Hurr stated that she would need to calculate the square footage of buildings at Baker park because they have very fuew buildings although they have 2000 acres. She explained that the sign ordinance does not cover such permits although the type of sign that they want is similar to a directional sign. Moved by Heideman, seconded by Scherer to table the sign application of the Hennepin County Park Reserve District pending receipt of information from JoEllen Hurr. Motion declared carried 113 Dabrowski/Cavanaugh, Final Subdivision Approval JoEllen Hurr stated that she would release the plat for filing after a deed from the State of Minnesota has been received. Moved by Reiser, seconded by Scherer to adopt Resolution 86-65, granting final subdivision approval to Dabrowski/Cavanaugh for Lots 11-16, Block 2, Independence Beach. Motion declared carried Jim Lutz, Elm Creek Estates JoEllen Hurr stated that Mr. Lutz would like to move a trailer onto Lot 9 of Elm Creek Estates to live in while his house is being built. She stated that the septic issue needed to be resolved. Jim Lutz asked that the city issue building permits, at this time, with the understanding that no connection to the sewer and water would be made until the work is approved by the city. Glenn Cook stated that he needed a letter from Mr. Lutz' engineer stating that construction is in accordance with plans; he would then recommend issuing the permits. JoEllen Hurr stated that Council minutes specify that the road, sewer and water construction must be approved by Council. Glenn Cook stated that there is a problem with the streets and that some areas will need to be redone. Anne Heideman issued if the guaranty. Moved by Heideman, seconded by Scherer to allow issuance of building Creek Addition upon streets being brought to city specifications and approved by city engineer and that no occupancy permits be given until the sewer and water installation is approved by the city engineer. Motion declared carried stated that she would have engineer approves the road no problem allowing the building permits to be and if the city retains the proper financial permits in the Elm Moved by Heideman, seconded by Scherer to request that the Planning and Zoning Admin- istrator prepare an agreement for Jim Lutz to sign regarding the use of a trailer during construction of his house in Elm Creek Addition. Motion declared carried Hunter Farms Development Contract Donna Roehl stated that a request had been received from Harvey Homes for removal of the terms of the Hunter Farms development contract so that a lot title could be cleared. { /� Moved by Heideman, seconded by Scherer to authorize preparation of a resolution 1_1`k removing terms of the Hunter Farms Development Agreement from the titles of the lots in Hunter Farms. Motion declared carried 7. MEDINA MORNINGSIDE WATER REVENUE BONDS Donna Roehl reviewed resolution regarding payment of outstanding principal balance to banks and subsequent borrowing from the Park Fund in an effort to reduce interest payments from the 11% owed the banks. Moved by Heideman, seconded by Reiser to adopt Resolution 86-66, authorizing full payment of principal for Medina Morningside Water Revenue Bonds to the Farmers State Bank of Hamel, State Bank of Loretto, State Bank of Long Lake and to borrow $48,000 from the Park Fund at 7% interest, through September, 1988. Motion declared carried Moved by Reiser, seconded by Scherer to reduce the interest rate charged Medina Morningside home owners for the Water Revenue Bonds to 7%. Motion declared carried 8. METROPOLITAN WASTE CONTROL RATE STRUCTURE JoEllen Hurr stated that the Waste Control Commission had studied the rate structure very carefully and according to projections an increase would not affect Medina for ten years. She stated that Medina had been charged $3000 less than they should have been charged for 1984, which would be added to the 1987 charges, but that interest is never charged for underpayment. Anne Heideman agreed that she would attend the hearings on September loth regarding the rate structure. 9. RECYCLING ORDINANCE Donna Roehl explained that Hennepin County Ordinance 13 requires cities to carry out recycling programs and that all those who spoke at the Public Hearing on August 13th had spoken in favor of it but had comments on individual sections. She stated that County staff would rewrite the ordinance taking into consideration those comments. She asked that Council send a letter of comments to Commissioner Mark Andrew, either for or against the Ordinance. Moved by Anderson, seconded by Heideman to support Hennepin County Ordinance 13, re- garding mandatory recycling if it is economically feasible to do and to request that the County find markets and uses for the collected materials. Motion declared carried 10. BILLS Moved by Reiser, seconded by Scherer to pay the bills; Payroll # 9356-9377 in the amount of $ 17,908.41 and Order Checks # 5063-5064 and 5052-5054 in the amount of $52,240.38. Motion declared carried 11. BUILDING INSPECTOR Moved by Scherer, seconded by Reiser to accept Proposal # 3 from Loren Kohnen for building inspecting for the city, that is, payment for services shall be at 80% of permit fees until payment reaches $30,000, at which time percentage shall be re- duced to 60%. Also a final agreement shall be brought back to Council for signing and that Robert Mitchell and Wilfred Scherer continue working on the 1987 contract. Motion declared carried 12. JACK AND JOANIE KAIN Jim Dillman explained that a mistake had been made when an employee flushed the Independence Beach hydrants on Tuesday, rather than Thursday, the day on which residents had bee notified that hydrants would be flushed. As a result Mrs. Kain had a washer load of white clothing ruined by rust. He explained that to rid the system of_34st would require installation of an iron filter system which would cost from $250ro $300,000. Moved by Heideman, seconded by Scherer to refer the Kain claim to the cities insurance carrier and if not paid by them to bring the claim back to Council. Motion declared carried 13. SCHERER MEATS Councilmember Wilfred Scherer was absent for this portion of the meeting. 115 Richard Schieffer explained that some years ago Wilfred Scherer had obtained a permit for his meat shop business with Council approving a Building Permit with some restrict- ions, including a non transferable clause. He suggested that the city hire another Attorney to represent the city, on the matter, and he explained that he had advised Wilfred Scherer also seek legal counsel. JoEllen Hurr stated that he would need a Conditional Use Permit with a variance to allow a home occupation. Moved by Heideman, seconded by Reiser to hire Curt Pearson for legal counsel if Scherer Meats makes an application and legal advice is needed by the city. Motion declared carried 14. LUCY MITCHELL Council discusses the letter from Lucy Mitchell regarding the need for a horse trail along Tamarack Dr. that had been decided when the road plans were apprpved. Jim Dillman stated that the work is not completed but that the best access for horses would be provided. Wilfred Scherer stated that he would explain the plans to Lucy Mitchell.
